CODES FOR RATING PURPOSES

Anybody have the CFR Codes of rating disabilities?    THE CODE #  & What they mean?  

 like I have a code sheet I got from the BVA today, my PTSD code is 9411=70%

also on the same sheet (Legacy codes)  it has  combat code 1  / special prov cde?

anyone know what that means?

Also is the VA calling ''SERVICE CONNECTED''  ''INCURRED' 'Now?   The reason I ask this  is

because right beside all my S.C. Disabilities  it has the word INCURRED'' & Not Service Connected?...which all my disabilities are S.C.

 

For a lot of you veterans  you may want to pay your VAMC a Visit  or your local VBA(Veterans Benefit Administration) Request a copy of your  Rating decision sheet It has a list of your S.C DISABILITIES  & the codes/Dates you were rated by on them  and you can check the codes  to see if they rated you correct?

This is why I wanted my code sheet   to compare  what is in the CFR's 

you will need to sign the freedom of information act sheet  (same as a statment in support of claim form.)

It's on the Rating decision sheet the BVA printed out for me as  a copy

under Legacy Codes

I requested a copy of my rating  code sheet    they call it a Rating Decision sheet.

it has a list of all  service connected disability's and where they incurred. & the date they first awarded  & at the bottom of the page it has my SMC S-1 

all of mine were from (Vietnam)

I need mine because of a error (cue) about my EED back in 1998 at 50% And this has a list of all the dates, unless they made a typo? & or  the dates is incorrect  I may file a  complete review of this particular claim dated way back to 1998.  all my records show the 1998 Should have been the EED.

long story   when I was awarded TDIU back in 2003  I never recieve the compensation from back to 1998  they said my retro start date was the date I filled for increase  which was 2002 Awarded in 2003

so I was according to the VA Getting 50% back in 1998 ( I was not) and in 2003 I was Awarded 90% and given the TDIU P&T...Which was paid at the 100% with chapter 35 and the property tax exempt  when that went into effect.

However Stupid me  I Never caught this at that time NOD period run out  and last year I filed for PTSD and was awarded 70%  anyway I got to looking at all the dates  that they put on the award sheet and this  is what brought my attention/remembrance  to this  and also back then Phillip Rogers was helping me back then and he caught it  I just forgot to do anything about until now.

I realize it could be to late?

  but  I'm waiting on my C-FILE to recheck this claim and the EED Dates..if I have the correct records in my C-FILE , I Will definitely file for a complete review of this claim. May seek an Attorney to help...or ASK Asknod for help with it..but if I can't find anything in my C-FILE As to Where they may NOT have committed CUE with the EED...Then NO I won't fle.

just thinking about it...I hope to get my C-FILE in this month or next month as promised.

its just that all these years if I can prove it  there would be a substantial amount of retro.

If you know of any BVA decisions as to where a veteran went 15 years or more and  found a big mistake in his Award and the retro was incorrect and  the veteran was not paid the correct retro because the VA Screwed up

There are some very large retro awards in the CUE forum due to legal errors in past decisions.

Well Basicly I need to wait and see what's in my C-File???

if the dates are the same as what I have in 1998  that they said I was getting 50%   I will proceed with this  because in 1998 is when I was flat out denied and even for S.C.

 They VA say I was  being paid at 50% in 98...I finally got S.C. in 1999 at 0%..and file for increase in 2000 and was awarded a 30% rating for hearing loss, THIS WAS DONE FROM VA Audiologist that notice my hearing had got worse...as for as I remember no retro for that increase...I was sent the 30% check each month.starting in 04-22-2000 ( I WAS SO HAPPY TO JUST GET THAT)

My Hearing had got so bad I had to stop working...and just mowed yards to make ends meet and help my spouse pay the Bills, I would leave the car running all night I just could not hear machines and autos if they were running or not OR HEAR WATER RUNNING  MANY OF NIGHTS i HAD A MESS IN THE BATHROOMS WITH FLOODS. and then I fell into a DEEP ASS DEPRESSION.\i WAS BEGINNING TO THINK I WAS GETTING DEMENTIA OR ALZHEIMER'S at  age 48 back then  eh!

and then in 2002 I   filed for increase  from my VOC-Rehab counselor Advise, Had  a C&P AND that examiner had mention I should not be rated for hearing loss at all and be kicked out of the VA  System...and I got a proposal to reduce back to 0 %. This was 2002..I then filed the NOD just days after I got the proposal &  ASK FOR A DRO Hearing at RO (with Flip H help aka Phillip Roger)

 I took new and material evidence and new IMO from a specialist EAR NOSE THROAT Dr  and it all trump that VA Dr   the DRO gave me a 50% increase  on my hearing   which brought my rating up to 80% and added 10% for tinnitus (THIS IS SO SCREWED UP THEY SHOW i WAS AWARDED TINNITUS BACK IN 2001  Anywayz..now I'm at 90% and because I could no longer do the job I was trained to do the DRO gave me TDIU P&T &MENTION THAT THIS DISABILITY IS AS NATURE this disability will not improve in veteran life time  and no future exams schedule.

ok I still have all this paper work. but some how I don't have the SOC ?

.I just need to  see the SOC's & SSOC's to see the dates on them.?

Award letters and reason and bases for denial. Dates!

I realize they may have a typo  here and if that's the case   I  can't file a cue ON  VA Typo...at least I Don't think I can? 

If this is to be true  I guess I', just screwed and the VA wins out.

I sure miss Ms Carlie   to help me with this.   Rest  her soul.
