Army Physical Profile Record - Da 3349
I had a couple of these in 1977 and I've been researching the meanings of the section labeled P U L H E S . I think I've finally found out what these categories are for on Profiles: physical profile serial code [Pulmonary, Upper Extremity, Lower Extremity, Hearing, Eyes, and Psychology (PULHES). I'm just posting this for information as it might help out another vet. carlie

1151 Progress Report
Greetings Fellow Hadit Members, Not pushing up daisies yet but now and again I drop a message to the Hadit Board letting those interested in following 1151 claims stay informed what is happening with mine. In the previous chapters you may have read about how I got back in touch with a Senator who in turn had his VA Staffer file a congressional investigation regarding my case. The VA has been dragging their feet for years on this one and it appears we are "getting closer" to an answer. The medical files had been sent to Florida last September for review and were collecting dust on somebodies desk The good news they have been returned to the VARO in Texas …

I9 Box 9 General Form
The appeal development continues as more is learned. Love to cut an past from old information. Anyway an updated BOX 9 enty covers most angles I think. If you want to add suggestions. please feel free. 3/10/2006 8:13 PM updated Box 9 information to final status Box 9 I take exception to the decision forwarded and preserve for appeal all errors of law and fact, any misapplication of the M21-1 (Adjudication Procedures Manual), Title 38 Code of Federal Regulations, and invoke the Veteran Administration’s duty to assist in any further decisions by the VARO or BVA. In the upcoming pages, I will clearly outline and directly address the evi…

Has This Changed?
4. In VAOPGCPREC 12-98, the General Counsel noted that they could find no indication in the regulatory history that the provisions of § 3.400(q)(1)(i) do not apply to a claim for an increased rating based upon new and material evidence submitted prior to expiration of the appeal period or before an appellate decision is issued. Page 2 Director (00/21) A conclusion that the regulation does not apply in such claims would conflict with § 3.104(a) which governs finality of decisions. Considering this, General Counsel proceeded to consider the appropriate effective date for a claim for an increased rating based upon new and material evidence. General Counsel c…

Did You Download The Va's Understanding The Appeals Process Handbook?
I finally downloaded the 52 page Understanding the Appeals Process Handbook. (Not the comic book style, though its "cute" in its own way, black printer ink is costly, I avoid color ink here) Although somewhat helpful with the acronyms and the anticipated course of actions, I notice alot of vagueness regards the sixty days extension amongst other things. Of course I take everything with a HUGE grain of salt, knowing there is always more to the story especially when legal matters or money are involved! (For my young teens and God sent husband, I carry on!)

Vcaa And A Claim For Reconsideration
If things go like the phone clerk, at the VARO, has stated, that my claim file will be opened sometime in early April, when and/or should I expect a letter referencing the VCAA in a claim for reconsideration? Are you even allowed to offer new evidence in a claim for reconsideration after the Development stage is over? Does going from development stage to opening the file supposed to mean that they have all your most current VAMC medical files or is their a particular date in which they stop aquireing your VAMC records? My anxiety levels jump from level to level, depending like now, my mind is zero'd in on my claim and my anxiety level is quite high and I feel like …

Terry-is This The Cavc Opinion
http://webisys.vetapp.gov/isysquery/irl3819/5/doc (Belin V Derwinski) "In his motion for remand, the Secretary confesses that the Board of Veterans' Appeals (Board or BVA) erred by failing: to state adequate reasons or bases for its denial of the veteran's claim; to discuss certain applicable regulations, including the benefit-of-the-doubt doctrine; to explain its basis for implicitly rejecting, without discussion, statements provided by the veteran, as well as medical evidence provided by the veteran to support his claim; to require a more complete medical examination; to provide a medical basis for its own medical conclusions; and to consider the value of an indepe…

Has anyone heard of tdiu flying without dr. letter? I'm 70% for post prostate cancer, tinnitus and diabetes. I am taking early retirement from work because of incontinence, frequent urination (30- 40 times daily ) bladder spasms etc. have been on hydrocodone for last year and a half and recently oxycodone added as needed. VA has provided the hydro medicine for "post prostatectomy pain". They have also provided detrol la, aspirin, zocor and high blood pressure meds.
