How do I interpret exactly what the VA has decided on this: My letter goes like this: What we Decided: Left wrist condition: The evidence does not show a current diagnose disability. Shin splints left lower extremity: "same answer as above" Shin splints right lower extremity: "same answer as above" Cervical spine condition: "same answer as above" Back pain: "same answer as above" Left and right knee condition: "same answer as above" Bronchitis "same answer as above" condition of the duodenum "same answer as above" Rash over body "same answer as above" Stress "same answer as above" Now does this mean that I am not currently diagnosed with these conditions with a current doctor? Or does this mean something else. Insomnia: The evidence does not show an event, disease or injury in service. Moderator broncovet Posted September 25, 2012 Moderator Share Posted September 25, 2012 It means that they think you do not have a current diagnosis for those conditions. Example: Bronchitis. Maybe you had Bronchitis in the service. You got over it and it causes you no problems now. You do not have a current diagnosis of Bronchitis, and wont be compensated for it. There is no "pain and suffering" for bronchitis, rashes, etc that heal up, either on their own or with medications, that you suffered in service. If the decision is wrong, and you currently have symptoms of one of the maladies you mentioned, then you can file a NOD and protest the denial. This was part of my depression claim (insomnia) I am rated at 30% for depression, and anxiety. VA will most likely state something to the effect of your sleep problems that you have claimed as "insomnia" are already compensated for within your 30 percent compensation for a mental health disability. Occupational and social impairment with occasional decrease in work efficiency and intermittent periods of inability to perform occupational tasks (although generally functioning satisfactorily, with routine behavior, self-care, and conversation normal), due to such symptoms as: depressed mood, anxiety, suspiciousness, panic attacks (weekly or less often), chronic sleep impairment, mild memory loss (such as forgetting names, directions, recent events) . . . 30 Link to comment Share on other sites More sharing options...
