Question

I read the notes in the C & P exam and the doctor put information in my records that he did not cover with or untrue, should I just print it out and make corrections and send it in with my grievence?

NHB,

You can send in a "statement in support of claim" and point out any incorrect info or omissions in your C & P exam report. If your other medical evidence contradicts the responses in the C & P exam report, point this out in your statement and make references to the parts of your other medical evidence that differs from the C & P examiner's responses or comments in his/her report. JMO

Hi everyone :biggrin: I requested for a increase in about 8 contentions that are currently service connected from 0% to 30% per, a couple of weeks ago i had a C&P that i thought was the best i ever had by far.. I also asked for TDIU, the C&P exam notes were on ebene's for the past weeks and i have tried my best to pick it apart but i am a Rookie Monster and would like some help. Special inquiry to my TDIU? The Dr. per C&P Medical opinion section makes a statement that after all the comments made in my favor per condition. :ohmy: For example i will put a bit of the exam notes that show impact, its not all, but some conditions

time". On top of it he has major issues with significant chronic
headache condition.
Now here is my question .. for TDIU.. i think it does not look good, but why after several "yes it impacts employability"
His primarily condition for which he decided to quit working 28 months ago
as a Computer Technician is chronic frequent headaches which he states also
affected his ability to concentrate. His chronic constant back and chronic
bilateral knees have affected his ability on weight bearing activitiees
including prolonged standing/walking and sometimes driving due to pain on
his
left knee.
The current headache frequency although is relatively is still frequent
2-3X/week from 3-5X/week with current medications his headache seems to be
easily alleviated by the prescribed acute medication of
Bultalbital/Naproxen.
He is also bothered by the decreased concentration on the job due to
headaches.
His musculoskeletal joint conditions which include lower back and bilateral
knee pains affects his ability to travel, prolonged standing and walking.
Although still chronic, he has regular medications of Motrin 800mg BID to
decreased its intensity.
Without question at this time, that his impairment affects his ability to do
any job which requires a lot of physical activities.
At this time, with all his current conditions mentioned & considered above,
it doesn't preclude him from doing any sedentary type of work.

the main issue I see is that you decided to quit work. The doc also is saying you can do something, even if it isnt something you want to do. Do you have SSDI? if so that will help your case as well.

I actually was let go from my 12 year job because, they removed me from a position in retail and gave me a 14 day to find another one and if i did not they would terminate me. I could not find a position that would accommodate medically .. going to appt's and therapy like my previous position so i was let go, i collected unemployment after fighting the former employer. Anyway.. i just told the C&P lady that i have not been working for 28 months, i might have said because of my disabilities etc.. but i never said i quit, well i expected a surprise from the exam and i guest i got one.

I applied for SSDI, and it is currently with there medical team stage* I am just bewildered by the comments from the DR from the VA.. as every increased contention examined the remarks were that it impacts my employability .. but then make a statement like that i can do sedentary work.. wow guest that TDIU is going to go no were in my opinion .. but i'll wait.. in the mean time... your suggestions and comments like others are appreciated so i know were i might be heading in direction...

Hi everyone,
Its been since 2000 that i have been back and forth with VA claims, conditions have worsen and i have been back and forth with VA with contentions in ref: to increase, reopen, new and unemployability, I have not worked for 29 months i am a single parent and need help. I have applied with SSDI(pending) i have a claim for increase on several contentions (C&P) completed and is in prep for notification. I was denied 2x for sleep apnea and it's in appeals but waiting for increase claim to go first.. why? o well. IN all i have asked for what i have should have long ago.. i tried to fight my conditions w/ out working.. becoming homeless as single parent and on.. i am reaching out to you all to give me a birds eye on if you think i stand a chance for increase from my 50% per C&P data. I am sure the IU will not fly considering what the DR. Wrote at the end, even though i have so many contentions that the Dr. indicates prevent me from employment or impact it. Please take a gander and post what you think.
