Question

Hello all,

I have a question...I was medically separated after 14 years of service in 2010 at 20% DOD and 60% VA. After 2 years of fighting I was bumped up to 90% and then after another couple of years I finally got to 100%. My question to you guys is if I were to go for my the extra 10% on the DOD so I can apply for medical retirement would it effect my VA compensation? could I get both a retirement check from the Navy and the VA every month? would I have to pay back any money? Thank you for all the help.

VA disability rating of 50% or greater. Military retirees with a disability rating of greater than 50% are eligible to receive both payments under CRDP. They will receive their full military retirement pension, along with 100% of their VA disability compensation.

Even if you get the Military to up to a Medical Retirement, you will not collect your Retirement. You have to pick the higher of the two, which for you would be the VA, unless you can prove your Military Condition was directly a war injury. As stated above if you are not working, then you can apply for SSDI in your state. Good luck
