    Can anyone tell me if this may meet the CUE requirements.

    I had a claim reviewed and denied by the BVA in 1992 and left it drop.

    After reviewing my medical records, which I didn't have at my hearing, I noticed some statements that were not referenced in the VBA decesion. I believe these statements when read tell the story. Anyway about 2-3 years ago I had a C&P exam by a VA Doctor. After showing the Doctor these same records, he concluded that I have been right all along and the VA did grant service connection. I fogot to mention that I also had my family Doctor review my reecords prior the the C&P exam and I showed the VA Doctor and he agreed.

    So does this meet the burden, that when called to the attention of later reviewers compels the conclustion, to which reasonable minds could not differ, and the result would have manifestly different but for the error?

  2. you can be service connected for mst (military sexual trauma) ain't that some sh_t they even got an acronymn for it now.

    it is harder to prove than combat trauma, lot's of women and some men never report it for many reasons, if you told anyone get a buddy letter, if you sought any kind of treatment get those records, if any of your gyn records show sexually transmitted disease get those, did your performance evaluations fluctuate either go very low or very high that can also be used.

    it's tough but not impossible, i personally know some folks that got ptsd for mst, one had reported, another had not.

    so you can file a claim and win on this, don't be discouraged. here's the more important thing, get treatment, if you don't have a therapist get one, filing that claim is going to cause a lot of stuff to come up for you and it may set off triggers you don't even know you have, so it's very important to have a safety net under you and that is what a therapist will be. the claim is important, but you are more important and we don't want you to go through this alone!

    another note just from me. our webiste get's crawled and put in the search engines and mst is a very private thing. so you may not want to post the details on the board, just the general stuff we can help with.

    social security does not give percentages of disability like the va. with social security you can either work or not. so in a way social security is either 100% or nothing. an award letter from social security should help your claim though as clearly it is evidence that you cannot work.

    I know the VA gives you a percentage for your disability, does the SS do the same for SSDI?

    I have some non service connected disabilities that combined with what I hope to be service connected, make me TDIU as far as SS is concerned. Does the SS give a percentage for each area or part of the body that is affected by a disability or do they just make a total assessment of the disability?

    In my award letter from SS, they only listed what was sufficient for award purposes, they didn't go into detail and list every item I listed, as the cause of my unemployability and the perminance of their effects.

    Also I am curous if the VARO must consider TDIU even if not found to have a percentage higher than 60% since I am on record with the VARO as being awarded SSDI?

  4. got asked this the other day and it would seem this may apply to many folks.

    scenario

    at the end of your enlistment you get out just regular muster out and then within 1 year of your discharge you are being treated for what turns out to be a service connected condition.

    questions

    a. is the veteran entitled to go back to the military and try for military retirement?

    b. is there a presumption for certain conditions that present within 1 year of discharge?

  5. wierd my close all tags works i'm still working on the refresh rate. though when mine refreshes it does not wipe my stuff away it's still there so hmmm see what i can come up with.

    i'll review Title 38 and see what i can come up with. by the way did you check under the Help section scroll down and you'll see i put VA Claim FAQ that you submitted there. i would really like to be able to use this as a place store items that we must refer veterans to time and time again. this will save us a lot of time and make the experience much easier for the new boar visitor. we can just point them to the help files.

    I agree that the main topics are gone over a lot and the same questions are asked and answered.  This would be great if we could stop the same questions from being asked and answered.  It would be a great idea to look over all of the past post and check to see what post are mainly gone over and then make a section for each one or at least make a similar section to cover them.  Claims and research is a broad area and really would be better broken down.  The main subject that really needs a topic is how to properly submit a claim.  Then add a section with comments on how a special claim should be done.  I know that this is a wide open area but it would help stop a lot of wasted web space from repeated post.  This would also be cheaper on you and easier for everyone to navigate through.  I do understand that it will not be easy to set up but you could outline it just like the title 38 law book.  That would be very well put together if you could pull it off.  It would also stop people from going back and forth to the laws to copy past an answer.  I do not think that the V.A. could get you for copyright laws for just making an outline of the laws.  Actually they should give you and award for helping define the book better.

    I kept having a refresh problem and had to do all of my typing in word and then copy past this into the post.  The refresh kept wiping away what I typed.  Why did it keep doing that?

Berta Check under Help top right first line Look for VA Claims FAQ that's where i put yours and i am planning on putting any other's there also. once i get enough i can clean it up and consolidate it. what do you think of in help, i think it's neat what other help files should we add for our veterans

    i'm not having that refresh problem anyone else having this problem? the screen does refresh but it does not wipe out my posts.
