    I stormed the castle down in Detroit Last Monday and one of the things I wanted answers on was a dependent claim. At one time I had 4 of them chating in the corner behind the service desk trying to figure out what was happening. In relation to my Dependent claim the person indicated that one of the reasons no work had been done on my dependancy claim was that Detroit still had the paper system and was transitioning and my dependency claim was filed using the online dependent application...I asked "are you telling me my dependancy claim hasn't been worked, because it was filed in the on-line system" She got one of those looks in her eyes just like a deer in the middle of the road in the glare of an F150's headlights. Her nervous reply was "well I really don't know", she even had less of an answer when I plopped down a copy of the dependancy section from M21-1MR that states if the VA is made aware of the intent to continue school after the age of 18 the dependent should not be removed from the award and proceeded to inform her that I had the return receipt for VA's acceptance of the package that included his acceptance letter, deposit receipt and suggested freshman schedule. She indicated she couldn't explain that, but assured me they would include that with the promulgation work for the decision eBenfits says was mailed on the 26th of March.

    I only mention this in the rare occasion that you might be receiving the same excellent service due to the same situation (dependancy app filed on-line?).

    I'm too waiting closure on dependent claim and eBenefits to post evidence sent in twice. Also i'm awaiting two years of retro pay since 1 Dec 2012.

    For now - you've won !

    Don't worry about the effective date - till you get the decision

    and the retro hits - you can always NOD the ED.

    BUT, for the record I'm thinking that your C&P exams done in Feb 2013

    got you increased to 100 percent and this would prevent the ED of the

    100 percent from going back to the Dec 2010 date.

    Same thing as a staged rating per medical evidence of current level

    of disability.

    Also, this now also provides you with full dental care at your VAMC

    plus Chapter 35 for dependents and some other great benefits you will need to check into

    also probably some additional state benefits.

    Retro will be good - spend wisely.

    As Carlie said; "I'm a Winner" and I really feel like a Winner. On my initial/partial rating; I received a few denial ratings (for example: sleep apnea, diabetes, etc.) so i was making plans to prepare NODs.

    tongue.png With a recent 100% rating; I don't plan on spending the effort to prove my case. Should i rethink my plan?

  3. Congrats Rover. I'm so glad to see that you finally received your final rating.

    As for me brother, I am still here waiting with a 90% service connection with several issues deferred.

    It will be 3 years for me if the claim makes it to July.

    Congrats once again, now it's time to enjoy your retirement.

    If you're at 90% now with a few deferred claims; you ca a good shot at achieving 100%. Stay focus & keep the pressure on VA.

  4. I found the hadit site a few years ago and begain reading the post on how to work the va system and make it work for me. It worked and today I am 100 % P&T. A road to be traveled is a lot eaiser if you listen to someone who has traveled it before you. Thank you hadit members for all your help. I recomend this site to all my veteran buddies.

    This weekend, my son will submit Chapter 35 application so he can collect full time college monthly rate at $987.00 per month. His college level studies started Sep 2012.

  6. I think you are on target Rover. I think the Date is 1 Jan 2011. But with VA they could say from the date that you had the C&P exam.

    That's what happen to me.

    Reason for: is even though you filed the claim in Dec 2011. the Va can say that the condition did not worsen until the exam and date it the day of the exam. So, if the effective date is 2013, that is probably what the did.

    Today, I received VA brown envelope -- the effective date is Jan 1 2011 @100% so i'm speechless. biggrin.png biggrin.png biggrin.png biggrin.png

    Thanks Carlie....Please keep in mind; "this is my initial claim" The exams conducted in Feb 2013 was deferred (from the Dec 2010 original claim) because they needed additional information or evidence.

    Note: Claim received: Dec 2010 & Claim closed: 26 Mar 2013. So the ED should be 1 Jan 2011 @ 100%. Am I off target?

  8. Congrats youcan always appeal effective date. Have you gotten Social Security. If not apply for it ASAP

    I have not gotten Social Security.

    Currently, i'm still working a federal service job. Based on 100%; "are you recommending that i apply for SS?" Can i apply if i'm currently working?
