  1. Sorry I'm still learning, I think I just posted an attachment without a reply. Berta, John999, and others the nearest thing to unemployable that was on my imo for the ptsd. is below. Severe Trauma and disability. When I went to see the dr., I went for help not an imo, but ended up using as such. When I filed for 70% I sent the imo mentioned above, in short under his assessment (Major Depression, recurrent 296.32 2. ptsd 3. ocd Axis 11 Obsessive Compulsive Personality characteristics. Axis111 As above, Axis IV.(_---- Severe trauma and disability----). Axis V. gaf 40. The social worker I see at the VA monthly, Pretty consistantly puts Axis 1 PTSD single episode, Anxiety and anger management. axis II none axis III cornary Artery disease Axis IV Other Paychosocial and Enviromental proplems Axis V gaf 45
  2. Tbird I recieved my records about two months after requesting them. My three years active duty consisted of about 30 pages. of which half of those were jump records. They said my records had been destroyed and had to be reconstructed. What I got represented about ten percent of my records. No mention of nam. I did recieve a packet about 1/2 inch thick of inactive reserves records which I never attended a meeting. kkp

Berta I love reading your post, but I don't know what a sf 95 is, perhaps you could enlighten me, and I absolutly love the fact that you are sueing the va and their employees. keep up the good fight and keep your nose up wind, It could get stinky. Also I will remember this (destruction of property thing ,) it could come in handy. kkp
  4. Iam becoming more concerned as I read of all the decisions gone bad here on hadit. I am also 50% ptsd, I appealed this for 70% along with this IMO from one of the best Board certified Psy chiatrist in West Virginia. I was granted 30% without a c&p when we appealed for 50% I had a c&p. The board certified Psychiatrist that did the c&p exam told me he could only help me so much if I wasn't willing to talk in some detail about Nam. At the time I just couldn't do it. None the less I was granted 50% because he tied major depression on with ptsd. And then of course I have an appeal on my rt. knee. Perhaps I should have let the appeals work there way through the system befor I applied for IU, but I didn't. Now every thing is being held up until a decision is made on the IU I would like some opinions on my status. I'm also wondering if the imformation in my ptsd appeal will be considered, with the IU. I am afraid I might have put the cart infront of the horse sincerely kkp
  5. Kathy Please accept my heart felt sorrow for your loss.I have lost four Brothers and a Sister all under thirty five year of age, and I still grieve each of them. I can't imagine losing my Wife of thirty seven years. God Bless and may time make it more bearable kkp
  6. I have a case on going thats allot like yours. Iam attacping an e-mail from the Huntington ro concerning my case . I hope this will help. I say file a year ago and tell your so where to go. I nearly had to threaten my rep to get him to file mine, as i also am only 50%. This is in reference to your recent e-mail concerning your various claims. In your case, we received a claim for Individual Unemployability (IU) on September 27, 2006, and are currently working on that issue before we can continue to process your appeals. Because of this claim, we cannot determine an approximate date when your appeals will be completed. Once we complete the initial review of your folder for your current claim for IU, we will send you a letter explaining any additional evidence we require to process that claim. We will then continue to process your appeals at that time.
  7. I think I have to wiegh in on Ricky's side on this one. I have a son-in -law and My Brothers son who have served in Iraq. My nephew is suffering from ptsd, and is in a very bad way at present. He is also recieving some kind of relief from the army while his claim is being processed.I don't know how the system is working now, but do know he is on medical leave while his claim is being processed. He is a member of the N.G. maybe that has something to do with it. I to support our felleow vets, and I am proud of each and every one of them, and hope they get all they deserve as soon as possible I'll have to say though I don't think they should be placed ahead of Nam vets. We have been humiliated, disgraced,and --- on since that blasted war. We were sent on missions that were never recorded because much of that war was fought under the cia, not the military. Especially the early part. and let me say straight out that many of those records will never be declassified as long as there is a kennedy in the senate. I'v read all this bull on this sight that all have been declassified. I say opnen your eyes, because many will never be able to prove their stressors. I was fortunate that I had some very smart People working behind the seens and sneaked mine in the back door. I was granted 30% without a c&p. I'll bet there is 100 that will never be as fortunate as I. 100 to 1 and maybe more. I can appreciate Berta's oppinion but fully disagree on this one. I know plenty who are dead now that might be alive had the va and the us gov. acted responsibly. We were screwed then and we will be screwed until the last nam vet is dead. Have to go see my shrink now. But thats my opinion. kkp
  8. As some of you know I am appealing a 50% ptsd rating from feb. 2004. I filed a iu about two months ago. I filed an nod with knew evidence on my sc right knee injury,about ten weeks ago. Some way the appeal on the knee got lost or sent to the wrong department. To make a long story short my rep resent it a couple of weeks ago, and again it got lost. A few days ago I taked to a fellow at the ro and he ask me to have my rep fax it directly to him and he would personally put it in the computer. By now I don't trust anyone, so I e-mailed my ro in hunington wv. via iris. Believe it or not I got an e-mail back confirming it's arrival and intry into the computer. I know it's hard to believe but I got my reply back in fourty three minutes. So with all my conplaing I want to give credit wher credit is due. And I hope this person gets a promotion to claims department
  9. Thanks Berta for your reply I just called the Huntington wv ro about the nod. I talked to another gentelman,as the one I talked to yesterday wasn,t available. He assured me that the two of them had talked about My case yesterday, and did in fact recieve the nod with Dr bash's imo. ( faxed from my reps office ) He said that mr. xxx that I talked to yesterday personally put it in the computer. Since he didn't ask for my case number, but was informed on the nod in question, I am assuming he is being straight with Me. I think He said my file was back befor the appeal board now. I asked him, since I have an appeal on the 50% ptsd, and an appeal on the right knee+A new iu claim how would it be handled. He said I should get a letter concerning the iu claim first. and then they would work on the appeals, because they take much longer. I think that is what Vike 17 told me also. The appeal on ptsd will be two years old in feb. 07. The iu claim is two months old, And the appeal on the right knee is about ten weeks old, even though it just caught up with my file yesterday.   10. Vike 17 and others Everything you say makes since, I really love it when you reply,and others also. Vike I dont know where you gained so much knowledge about these things, But I, and I'm sure many others appreciate you sharing. I did call My rep last wed. and he verified they didn't get a copy of My nod on My right knee. He called me back in a little while and said he re-faxed it to them. ( I'm not sure who them is) because I called the ro this morning and talked to a nice fellow, and He said they hadn't recieve it or it didn't go to the right department. He gave Me his name and personal fax number and asked me if I would called My rep and have it sent to his attention. Well I called My rep who has only been there for two months, But guess what He transfered to another city. I talked to the secretary who I'm absolutly sure must have been a blond be for She got gray and lost what little memory She had. She try to tell me that my rep. would not have faxed it to the ro, but to someone higher in his organization, who would stamp it and send it on to the ro., (this goes back to i'm not sure who them is ) It has been at least ten weeks since the nod was origanally sent, But at least ten times She kept telling me they are back logged at the ro and just havn't had time to put it in the system. The ro tells me they havn't recieved it. I finally told Her again what the man at the ro told me,that He wanted Me to call my rep and have them fax the nod to him directly. I gave Her his name and number again and told her what I wanted Her to send Him, Including the Imo to support my claim. I had a great rep when I started my case, but He retired about a year ago, and this office is like a ship without a rutter since. ( A little Navy lingo since I'm now a petty officer) I will give it a couple of days and call the ro again. If it's not there what would you guys suggest I do. I dont think I can blame the ro for any delays as they have tried to guide me through this mess. I feel like I am up that proverbial creek.(little more nave lingo) I am frustrated and really don't know which way to turn. kkp
  11. I just noticed I'm now a chief petty officer 2nd class. It must be related to a jump I made at Fort Bragg, when I missed the lz and landed in a river. I suppose I must be considered blue water navy. Some of you might remember The old t-ten shoot. you went where it took you. I have heard of having your mos changed but never your branch of servce. Oh-well some days I cant remember being neither.

  13. This is a series of e-mails between Myself and the RO. As with hadit You have to start at the bottom and read up to get in sequence. I hope you vets will read it and give me your opinions. I don't know what they are trying to tell me. I did call my rep and he called and verified My nod We filed on my knee was not in My file even though We sent it a couple on months ago. He faxed a new copy at their request. My Question is, are they trying to tell me, They are working on my IU claim, and my nod on my knee so they can consider my appeal on my ptsd, And if so would they put the iu and knee appeal on a fast track in order to meet the two year average they speak of on the ptsd appeal. How will this affect my ptsd appeal, and the unemployablility request. what is the time line for the knee. I mean will it be looked at first. My rep didn't know the answer to these questions. Can you give me a rough estimate of when I'll be hearing something. Also I am presently rated 50%. I sent in with other material a 21-8940 form for unemployability, will this be considered.I also sent in the side effects of the meds i take will this be considered. thanks

  15. jIshand Just a thought, no politiacl views,( ha ) I posted a thread yesterday with political over tones, that leaned the other way in suport of the war. I caught flack evey direction, including T bird. I suppose it depends wich way You lean. Believe me brother Veteran you will be over sixty someday, perhaps you are already, At any rate, There are many vets that due their disability tried to work for years, but wern't fortunate enough to pay enough ss to qualify. They end up with ssi. Perhaps they have 50% ptsd. That comes to a grand total of 1250.00 amonth. Of course they continue to pay co-pays on their meds which could easily come to 100.00 amonth. Dont nobody tell me i'm wrong about this unless you are willing to go to the local va I go to. Its pitiful to see the large number of our brothers in such dire need. I went to subway one day not long ago for lunch ,A man about my age begged me for money for lunch. I didn't give any and I had a pocket full of money. I nearly choked tring to eat that sandwidch. I went out side to give him 5 bucks but he was gone. Well I got in my truck and didn't drive far until I found him . I gave the money, he thanked me and I drove off. I had an anger management class the next week and guess who was sitting there. I dont know if he didn't recognize me or just out of courtisy pretend not to know me. ( it was a ptsd class) He shared some of his life after military which I cant discuss due to privacy, but I believed every word he said. It wasn't pretty bad. Vet you have an opinion on iu and your political your persuation. You may be wrong on one or both, BUT THIS i AM SURE OF TO PUSH YOUR POLITICS ON THIS FORUM ON ELECTION DAY,IS JUST AS WRONG AS MINE WEHE YESTERDAY, and your psition on iu, I totally disagree. Iam fighting the va for what I think I deserve and encourage you all to do the same,But we had better remember there is more in our defense budget than us, and if we don't win this war ( and it is War )none of us will have to worry when our next va check is coming.   19. Berta Vike-17 and others I do remember what Dr. bash said about moving my case to DC. He didn't mean he could bypass any rules and get me ahead on the list. His exact statement was they were not backed up in Dc like they are in Hunington, Where the panel of Judges only comes twice a year. He said the average time to get a case docked there at the present time is about 3 months. They bon't have as big a back log. I'm sorry I didn't make it clearer to start with, but I always seem to try to take short cuts, and let people fill in the blanks I'll try to do better in the future. kkp
  20. Jr Reihs Actually I haven't had any problems with them either up to this point. They respond to my e-mails promtly, and I always get to talk someone whin I call. I have noticed things have slowed down lately, and my rep. did tell me they have had a lot of he old staff retire recently and are not replaceing them very fast and the new replacements dont know squat. Ill give them a reasonable amount of time, and then I'l have to do something. glad you got your case cleared. Maybe you got there at the right time. kkp
  21. I paid a co-pay for meds for ptsd from the time I was diagnose un til I filded a claim and was granted 30%. At that time the va paid me back my co-pays back to the date i applied for disability. I appealed the 30% and was granted 50% awhile later. the va then went back and payed me back for non service co -pays They had collected from me for the remainder of the meds I had recieved from them to the date of my original award, which covered over two years. I did have to pester them a little about it but they did pay me back hope this helps. kkp
  22. Berta, Josephine, and any one else who wants to jump in. First: what is a formal 1-9 form, and what is a cavc, Just when I think I'm catching on to this lingo I'm hit with another one. Berta I think the first time I spoke to Dr. bash he said I could have my whole case appealed to DC court of appeals, and He could have it docketed within three months. He said they didn't have that big of a back log there. From reading your's and Josephine's threads I am assuming this form-9 must be the way to get it out of huntington to DC. Is this correct or not. I am not positive thats what Dr. Bash, so I will call him again and make sure. I think he told me if I had it moved he would represent me on the knee claim, and he knew one of the best Shrinks in the area that would represent me on the ptsd. We talked quite awhile, but I can't hear some tones very well, and his was one of them , plus he is a very soft spoken man. The next time I call him ( I'll tell him of course but my wife can get on an extention ) So there wont be any misunderstandings. My wife has talked to him also and told me she has a little trouble hearing him. At any rate I am sure he told me the rating should be higher on the ptsd and my knee was absolutely service connected and should have been rated. I post his IMO on my knee.. But if Josephie is correct that the Huntington ro will not accept an IMO unless they request it, I suppose I'm up that famous creek without a paddle, because my appeal on my ptsd and knee are base on IMO's that I paid for. I did file a claim for iu, even though I'm only 50 % ptsd and the affects of all the meds I take. The ro tells me that is where my c-file is at present ( new claim ptsd ) Josephine I dont think I have had any dealings with Brimmer, Lipscromb, or carl ray. carl ray dose sound somwhat familiar. Are they at the huntington ro or are they vet rep's I certainly hope ( I think it was Time )said these Judges were coming out of retirement was doing so without any additional compensation. If so it makes me wonder if they have a bias and plan to reduce the back log in a hurry and get back to gulfing kkp
  23. John M You can scroll to the bottom of the forum page and see an example of commuticating with the ro by e-mail its under does new claim hold up appeals I post some back and forth with my ro. You know how it works, you have to scroll to bottom and read up. I seem to get more info by e-mail Sorry John M I put this on the wrong thread. By the way I had trouble posting all day.
  24. Berta Thats great news, Now if they could only do something at the ro level. I taked to my rep yesterday and he said the Huntington ro have the biggest backlog ever, due to retirements, and failure to get replacements. I called the ro and they confirmed a big back log. I am wondering if I would be better off to go ahead and appeal to the BVA in DC, I remember Dr. Bash telling me he could have my whole case docked in 3 months or less and could arrange reppresentation, Just a thought, what do you think. My case and Cavman are nearly identical. kkp
