  1. BearGator56: That is a better exam write up than mine. I was rated 30% IBS GERD. Dont put too much thought into prognosis notes.
  2. Pete992 No mention of TDIU. I haven't worked in over 3 years. Im going to file for IU and im also going to file a NOD. The NOD will go against their decision on CFS, joint pain and body rash. For CFS, i have it documented with my doctor and mental health counselor on memory loss. Yet in their reason for decision they state the higher evaluation of 60% is not warranted unless there are debilitating cognitive impairments such as inability to concentrate, forgetfulness, confusion. For joint pain i just feel 10% is a joke of a rating. 10% for bilateral shoulder, ankles, knees, wrists, hips, chest, stomach (claimed as GWI) Body rash~ i assumed was a presumptive. My letter explained the first time I broke out in a full body rash. I went on to explain that this happened on 2 occasions while in service and tge Corpsman wouldnt even touch me. No, its not in my service medical records. My wife also talked about the rashes I break out in and how my 2 kids also break out in the same rashes. The decision made states "while your service treatment records reflect complaints, treatment, or a diagnosis similar to that claimed, the medical evidence supports the conclusion that a persistant disability was not present in service". I know a rating for a rash probably wouldnt amount to anything. But to be rated at 0% is a rating. Thanks Pete992
  3. My claim was rated, the end of September. Chronic Fatigue Syndrom 40% Irritable Bowel Syndrom GERD 30% Joint Pain 10% Body Rash~ denied. As not related to military service Degenerative Disk Disease from 10% to 20% Right Ear Hearing loss. Detetmined no change 0% The overall rating was 80%. Prior to this decision I was at 30%. Today, im at 80%.
  4. Thanks for all the comments. And Berta, you are always so in depth, to the point and resourceful. As far as rashes go, i dont think i have ever come across information on why GW Vets have them. I know its a big issue though. Rashes are something that my 16 year old daughter and 14 year old son get also. I have never looked at the rating schedule so im not sure if pusuing is worth it? After the War had ended, I was Detailed out with a large group. Our job was to retrieve all War gear. We stored it, accounted for it by scanning the equipments barcode, than eventually cleaned everything until they were spotless. We than loaded everything on MPS Ships. So yeah, depleted uranium, toxins from the cleaning chemicals etc etc. I went in depth in my letter about that. I have never read anything on sleep apnea. The other part of my claim was PTSD. In my 2 year wait, there has never been a C&P Exam for PTSD. I was diagnosed PTSD by my local mental health professional. So I am not sure why the bypassed PTSD. In my award letter, it states that a PTSD Exam has been requeasted. BUT, when they break down each part of my claim in "Reason For Decision" PTSD Service connection for ptsd has been established as directly related to military service. A noncompensable evaluation is assigned from Nov 11, 2011. A noncompensable evaluation is assigned whenever there are symptoms that are not severe enough either to interfere with occupational and social functioning or to require continious medication. A higher evaluation of 10% is nit warranted unless there are mild or tansient symptoms which decrease work efficiency and ability to perform occupational tasks only during periods of significant stress; or symptoms controlled by continuous medications. An at once examination will be requested to evaluate the current status of your medical condition. So the ptsd part had confused me. This is also what is confusing to me...... Future examinations will be scheduled to evaluate severity of your service connected CFS and IBS Why dont they rate these as permanent? Its not like I have been getting better these past 15 years.
  5. I had noticed that my claim read illnesses associated to the Gulf War. My award letter only showed the Joint Pain as due to GW. How can they outright deny me for body rash? My letter included my first episodes were full body rash 3 times in 92, although the Corpsman refused to touch me. I also included medical documentation, my wifes letter talking about me breaking out in rashes, both my kids breaking out in rashes, medication because of rashes. Shampoo meds for the rash on the head. Yet, I was denied.
  6. First off, I need to thank many members of this site, and this site in general. After almost a two year wait, and finally, a Congessional Inquiry, my claim was rated. I listed 6 illnesses (undiagnosed) that I have suffered from for years. Included in my claim was medical documemtation, letters from my wife and my own letter in support of claim. I had listed fatigue, joint pain, diarrhea, memory loss, skin rashes, chest/stomach pains. I was rated as follows: CFS (claimed as fatigue) 40% IBS (claimed as diarrhea, stomach pain) 30% Joint pain,to include, bilateral shoulder, ankle, knees andwrist, chest pain and stomach pain (claimed as due to Gulf War Illness) 10% Body Rash- denied. They determined it was not related to military service, so service connection couldn't be granted. Also, I was increased for my back from 10% to 20%. They determined my condition has worsened. (Degenerative disc disease, lumbosacral spine)
  7. My apologies. I did tell this doctor that it took me over 5 hours to get here. I am as remote as it gets, guaranteed. The documents i received from the VA, past visits, show all my blood work. So I will be bringing these documents to my PCP. This doctors exact words, after my visit, "compensation isnt as important as getting care. You need to see a VA doctor for your illnesses." It was as if it were a threat, the compensation part. I have a doctor. It just so happens he isnt a VA doctor. He is 5 minutes from my house. Not over 6 hours and a ferry ride.
  8. I had my C&P Exam this morning. A couple of things I found odd. First things first, the examiner told me I HAVE to be seen by the VA, pertaining to my claims of GWI. Am I missing something here? I have my own Primary Care Provider, and submitted documented evidence. #2 he questioned my rash claim, as if it seemed like he was trying to discount my claims. Granted, I had no irashes during my appointment. Once again, this is documented through my Primary Care Provider. I had an awkward feeling, so I had asked him for a copy of my Gulf War Registry Exam I had taken almost 4 years ago. So I go to med records and get them. My claims arent any different today than what they were 4 years ago. What I had come across was very high white blood cell counts every time I drew blood, meaning my body is fighting an infection. Also, this guy had diagnosed me with PTSD. At no time, was I notified of this. Odd. So, whats the opinion on HAVING to be seen by a VA doctor?
  9. USMC5811: I appreciate the thorough response. Very helpful information. There is so much information that I have come across, it has my head spinning.
  10. I had filed claims with the VA. Some were new, and some claims were to reopen certain claims. This was almost one year ago. Recently, I received a letter a letter from the VA. It mentions they are still working on my claim, but need more information on GWI. What do we still need from you? We need evidence showing that the following conditions existed from military service to present time: Body rash, joint pains, diarrhea, chest/stomach pains, all due to GWI. The letter goes on to state.........you have claimed exposure to an environmental hazard based on your service during the GW. We can take no action since you did not claim a specific disability. Tell us your specific disability that resulted from your exposure so we can process your claim. As you all are aware, this is getting old and very frustrating. I submitted all information I had that listed my symptoms. I was pretty specific filing form 21-4138. I went as far as listing the health effects of my children and how it affects me emotionally. What else does a guy have to do? Yes, I had a VSO. She was the one who initially opened this claim. BUT, when I told her I need to file for GWI, I got the deer in the headlights look. Needless to say, I went to this DAV for info on my claim, and was told she quit over a month ago. I face many obstacles, the biggest being that I live in the most remote place in Western Washington. Im well over 4 hours from a metropolitan area. At this point, I know I need to do what ever needs to be done for this battle. Any and all thoughts on my next steps will be highly appreciated.
  11. Berta, thanks for the response. Unfortunately, im strictly a smart phone kind of guy so as of right now, I have no access to scan my documents. To date, they have yet to schedule me for C&P. I have not been diagnosed for fibro or IBS or GERDS. But I do have medical evidence for diarrhea, joint pain, memory loss etc. I too googled this in respects to GWI and did come across some information but nothing really concrete. I do have my complete SMR's, but I do not have a copy of my VA Med Recs. Bbknor: i found similar info on webmd, the only difference is they now say spicy foods, caffeine, nicotine is not known one way or another to cause or worsen this. Thanks
  12. This past week, I checked myself into the ER for extreme chest pain. Turns out, it was the stomach. Yesterday, the Doctor received my blood results and I have H. Pylori. This stomach issue has been something I have been dealing with for years. It just so happened to become unbearable and impossible to get sleep. My question, is H. Pylori tied in to GWI? If so, how do I proceed from here? 9 months ago, I did file a claim for GWI; memory loss, diarrhea, joint pain, stomach pains, sleep apnea, rashes. Any help is appreciated.
  13. I too have gotten a bad case of dandruff. Well, truthfully, I get something worse than dandfuff. I get open sores on my head. Not really bad, but open sores none the less
  14. Im right there with you on the c&p for back issues. I had mine 3 weeks ago. I actually stopped when I felt the pain, refusing to move another inch. I also had an opportunity to discuss at length with the Doctor, all my shortcomings, limitations and the daily pain. That wasn't the case during my initial claim 10 years ago. I had no clue what the process was. When he said bend over and touch your toes, i bent over and touched my toes. When he said bend backwards, i did just that. 5 minutes later, it was over. No questions asked. No interaction. I cut my own throat during my initial claim
  15. Carlie: I have no clue as to my doctors credentials. In my medical records, he listed my symptoms and reason for visit. Prescribed meds to help me sleep. He noted in my records that it is related to my military service.
