  1. Congratulations apachegirl!! There has been a lot of movement of claims during the last week. Harleyman said that the RO's were working hard on completing as many claims as possible before any furloughs occurred. I'm happy for you and the others who are finally getting some success! Every win is a victory :smile:

  2. Hi rpowell, it actually only took 1 year from the time my lawyer ask for a hearing. A total of 16 months from the time of my 2nd application. My first application was archived because I didn't send in all of my medical records. So it actually was in the time frame quoted by my lawyer, it just seemed like it took forever. Thanks tonio and everyone, God is good!! The VA actually denied me again, they didn't even consider my IMO, they totally looked over it!! They didn't mention it in the SOC, so I asked for a reconsideration based on new and material evidence and I faxed it, uploaded it in Ebenefits and sent it certified mail attention to the RO's service center manager!

  3. Hello all,

    Just wanted to give you an update, checked social security online for benefit letter last night and there it was!! One-time payment dated 9/6/13 for $32,902.00!! My lawyers fees of $6000.00 have already been subtracted. I was informed by my lawyer that the judge did consider the 1st application date but because I did not submit all of my treating physician's names and medical information the application was never processed, therefore the only way to have it considered is to go thru the appeal's council. I am find with the April 1, 2011 date and I can take my children's birth certificates in and get back pay for them as well which would be about an extra $20,000. I am so thankful to God that this part of the fight is officially over!!

    As far as my VA case, I received an email from Pandi Van Houten, the Waco RO Service Center Manager on yesterday. She was wanting me to contact my AMVETS representative ASAP to clarify my intent regarding a NOD to grant service connection or to request a reconsideration based on new and material evidence. I haven't been able to contact a Rep, because I didn't choose one, they just assigned me to AMVETS based on my original claim in 1994!! Anyway, I check Ebenefits this morning and it shows that I have a claim Pending Decision Approval for an Administrative Review Claim and my reopened claim was closed today!! I'm praying that this is good news, God is so Good!!

  4. From my understanding, once a decision has been made on your claim, a rating supervisor will automatically review your file to make sure that there are no errors in the decision. This happened on my claim, I was denied on 4/10, and on 4/30 it was opened under Administrative Review. My claim is currently "reopened" because I submitted new and material evidence while it was under Administrative Review. I'm sure someone else has more knowledge about it than I do.

  5. Thanks Testvet,

    A social security rep actually explained that very thing to me yesterday. She told me that I would receive a lump sum because it was SSD, but my lawyer is saying that it will only go back to 2011 because my last application was 4/2012. I'm going to wait to see what social security says. They should be able to see the archived application from 1/2010. I will update you all when I finally receive the letter from social security. I definitely plan on saving for rainy days!!

    I hope that my back pay comes as quickly as yours did!! Social Security says the standard processing time at the payment processing center is 30 to 60 days???? Did you receive your back pay in 3 installments? I think that my monthly payment amount is because I still have one child under the age of 16. Thanks again and thank you Computer Tech

    Aggie54 it feels so good!!... It allows me to breathe a little while I continue to wait on a decision with my VA claim.

    Meghp0405 and Berta, my Rheumatologist did use my SMRs and used dates of treatment in his explanations. The words he used for no other etiology were, that I had no other know risk factors that may have precipitated her current diagnosis. Carlie, I am only at 10% with the VA right now and that is for sinusitis; as far as the Social Security award my lawyer told me that my monthly benefit amount should be a minimum of $2,000 a month which means that I should get a pretty nice retro pmt. but it will probably be paid out in 3 installments every 6 months. Thanks again everyone!!

  8. Got my Hearing Decision letter today!! Fully Favorable Decision going back to 10/2009. "The Claimant has the following severe impairments: Fibromyalgia, Mixed Connective Tissue Disease, migraine headaches, osteoarthritis in the bilateral knees, hips, and wrists, degenerative disc disease in the lumbar spine, and major depressive disorder, bipolar II disorder with undifferentiated somatoform disorder and pain disorder due to multiple medical disorders and psychological factor." I my claim with the VA is for Fibromyalgia and Depressions secondary to Fibromyalgia and TDIU. I finally got an IMO from my Rheumatologist which states in short... that my Fibromyalgia and depression secondary to fibromyalgia as well as migraines secondary to fibromyalgia are at least as likely as not incurred during service. I was going to file a claim for migraines and patella femoral syndrome and knee pain after my current claim is adjudicated, but I am excited to finally have 1 win!! and with retro payments going back to 2010 I should be able to get caught up on my bills with the first installment and save some of the other two installments. All smiles and thankful to God for everything :smile::smile::smile::biggrin:
