  1. no confusion here. i know the difference. what of those VA patients in florida that died due to VA delays in diagnosiing or treatment and if they had medical diagnositic data reports that were contrary to what their VA doctor was saying/doing, you don't think that VA medical file and non-VA medical data is the same thing versus different things? and you have that much faith in your VA doctor he/she would gladly call your non-VA doctor up and admit their medical mistake? you can see why veterans would like to be able to get pertinent non-VA data into their VA medical record wouldn't you?. btw, the VA years ago tried to bill my priv insurance company for service connect injury/illness. hows that for medical info privacy? you don't think "john999" had a very valid medical reason to get the data he mentioned into his VA medical record? let me ask again, is the VA required to acknowledge pertinent medical info that a veteran brings to the attention of a VA doctor or can the VA by regulations tell the veteran they don't have to acknowledge it. i thought i read, but can't remember where, VA was now required to acknowlwedge it thus a reason why a veteran would like it scanned into their VA medical record. not buried into a c-file that no one will care to read until a claim is filed. can someone steer me to a link that may answer this?
  2. i was at ROI when i was told that recently. if its up to a VA doctor whether civilian med data will be scanned into veterans va med file and they refuse, then what? i thought that the VA was to acknowledge non-VA medical data? if ROI won't do it and the VA doctor refuses, how is a veteran to get pertinent medical data into VA medical file?
  3. i don't understand continuity of care? i had some relevent medical tests and bone scans done that are relevant to my SC'd issues i wanted put into my va medical records so a doctor there can see it. i thought it odd they wouldn't do it and said it was up to my va doctor whether it gets put into my va medical records. i thought civilian medical reports were now allowed into a veteran's record, no?

  6. got all those, guess thats why IBS was listed as diagnosis. though now, they seem to lump any issue as "part of ms". it may not be life threatening, but it can be a real b!txx on one's social level and psych level. just as ms per se isn't life threatening but it can and does wreck havoc in so many subtle ways on one's life. most people cant see it unless the unfortunate ms'er is paralysed or such. good information pete
  7. yes, two different machines. sorry, i get a little mixed up. :-) thats the main reason to get it acknowledged, SC'd. at least to me. i see you see that also. and without more testing, who's to say it isn't something else & not IBS, ya know? i have a family member who was diagnosed with IBS. she went to another doctor who did other advanced testing and it came back chron's. she had surgery soon after that. years of only colonoscopies and endo's didn't show much on her. go figure. appreciate the feedback
  8. i guess the doctor during c&p filled this out. i also had a folder of cervical/lumbar IMO's from over the years for that MS secondary c&p appointment. however, afterwards, i could tell by his notes he didn't actually read it. so if i had taken in the folder for gastro issues & VA diagnosis of IBS over the years, i doubt he would have read that too. or maybe he read it and wrtoe the bare minimum for the raters. i could be wrong though. then when i showed the probelms with cervical with documents going back to service, gee, they added the cervical but reduced the lumbar into a combo of 10% for both. didn't make any sense to me at all. i was service connected at 30% for lumbar prior to the ms diagnosis claim so you know...which to (me) when it got reduced didn't make sense to me. but much of va math & proceudres don't make a lot sense to me. and if i brought this up with pva typcial response was "we got you 100%, so...". later on in life its a real big deal for the veteran in how/what medical treatment is given and acknowledged to the veteran and his/her family. i'm willing to bet the guys at pva and other SO's get/keep their claims and diagnosises in order, whatta ya bet?
  9. have no idea why it wasn't addressed in that claim. maybe since i'm not pooping on myself everyday or something. but IBS is rateable. so why pva and/or va raters didn't include that is a bit odd to me and why they reduced the cervical and lumbar at that time i thought odd. SO would just say you got 100% so whats the issue. as i mentioned, incorrect listings cause problems down the road for treatment and stuff. appreciate the link, i can use that for my claim
  10. cognitive(ms), bladder(ms), cervical/lumbar(though they reduced these for some odd reason), hearing(ms), migraines)ms), depression(ms), maybe weakness but i forget and don't have the paper in front of me.

  12. "i'm thinking outside the box". for adequate acknowledgement/treatment by VA for IBS i should file a claim, yes? my experience is that is the only way to get VA or a doc to acknowledge it
  13. no, it wasn't a consideration. it was a listed diagnosis, but wasn't included with the MS secondary. i was never rated for a IBS as i never filed a cliam for it. didn't realize one could until this year. and after so many menitons of its link with MS at MS seminars i started to consider doing so.
  14. i sent the NOD with some supporting evidence and 22-21a again yesterday. maybe i'm paranoid a bit but having not heard from RO after the last mail sent and attorney stating he sent a packet too and the attorney not getting something back from RO, i resent it yesterday. it was overnight delivered and signed for at RO. the deadline for NOD is next week in my situation so better safe than chance it. adding to the concern is that ServOrg still thinks it has POA when clearly docs were sent in over a month ago (more than once) to switch POA. so has RO not processed what was sent in yet or what? attorney called and now says they'll mail a copy of the green postal receipt to me so i guess they actually sent it. yet you can see, from your own experience why the concern level is raised in my thinking. i see from your reply, "deny claim" is very real in such situations even with delivery reciept, fax receipts, etc. good luch with that
  15. after i mailed in a NOD and faxed it back in July 2013, i did receive the green postal reciept plus the fax receipt. yet as of today, never received anything else from VARO about it. went i got an attorney, by recommendation by one your fav IMO doctors, and the attorney filed paperwork and 21-22a and said a green postal receipt came back. the attorney did mail me copies of what was sent but for some reason, a copy of that green postal receipt isn't sent to me and i've requested it 3 times. strikes me as odd. nor have i received anything from VARO about these papers this attorney says were mailed. i've emailed VARO IRIS to requesting status of the NOD, and the 21-22a. they only reply they are busy catching up due to that shutdown. i ask, as i don't want the VARO coming back and saying stuff wasn't sent or they didn't recieve it. there is a dead line for that NOD as you know. my question is, if i have the green postal reciept for the NOD i mailed in, is that OK? second question, why wouldn't an attorney send a copy of the green postal reciept along with the papers that supposedly were sent?
