  1. I started having trouble with constipation pretty bad while I was in the army. Upon my ets at the exam I told the doctor that I had a lot of trouble going. I had also been seen twice for constipation while in the service I received a letter from the va a few months after getting out stating that consipation is a symptom not a diagnosis and that my claim was denied and if I could provide new and material evidence the claim could be revisited. That was in 2004. I reopened my claim september 2015 and went to a c and p in San Francisco. The doctor was a gasteroentrologists and he was pretty helpful. He stated that I have ibs constipation predominate. this is his exact medical opinion in the remarks section of the disability questioner. In my opinion as a gastroenterologists, mr. B 's condition of abdominal bloating and chronic constipation represents irritable bowel syndrome, constipation predominate. It is more likely than not this this is the same condition for which he was seen in the army on these dates. His complaint was never properly evaluated by the army prior to his discharge on. this condition has been continuously present by history and has been documented to present in va records at least since presentation to the sr va in 2009. In my opinion his prior denial of va service connected status was in error in not recoginizing that his medical condition present since 2001 , is irritable bowel syndrome, constipation predominant.
  2. I Finally got a C and P exam for my claims from 2003 which were deferred every since then. my claim was for left hip disorder which while I served I was diagnosed with left and right hip strain. I have a copy of the C and P exam from a month ago. I cant figure out how to understand what all this means. He said I think you have some injuries in your back. He also claimed that my left leg was weaker than my right and noted that.   4. Update I went to my c and p on April 30th the doctor was nice understood my issues and told me I am not here to deny your claim I will advocate for you. He spent 90 minutes with me instead of 45. Shook my had at the end and said done what I can for you now lets see what the va says. I called the 800 827 1000 and they still claim my smr have been lost. Thought I'd share this.

  9. Update I spoke with the va today and according to them my service medical records have been lost now what should I do?

  11. I totally agree with and see what you are saying. Thank you for your input. I will have to play their game this September is 11 years since I filed the claim. I'm hopeful that the va will order a c and p and x rays and see the degeneration and link the degeneration with my claim of lower back pain from 2003 since they should have ordered and c and p in 2004. But like you said this is dog eat dog so any input is greatly appreciated.

  13. That is exactly the thing. I don't. But as I understand things the va has the duty to assist the veteran in developing the claim. I filed this claim in September 2003 two months prior to my gets. After I gets I got a letter stating that my claim was deferred for additional development, had the va developed my claim would have had evidence but they didn't and it is now 11 years later. I would have also had evidence after I got out but I made to much to qualify for va or state insurance but not enough to afford private insurance. So right now the va acknowledged that my claim is outstanding and has again deferred it for additional development. I have Dr x rays from my chiropractic doc showing he degeneration in the area where I have pain.

I have pain and spasm in my back it has been 11 years.I have x rays showing degeneration of the lower thoracic spine. Will the va grant compensation if I told the c and p doc about my back pain prior to ets and the va never developed my claim.my claim is still being Developed.
  15. I have mild degeneration in my t12 and t11 I hurt my back numerous times but never went to sick call, so I don't have anything noted in my smr. Will the va grant sc if you told the c and p doc about your pain prior to ets and they are currently still developing your claim. I have x rays showing degeneration of my lower thoracic spine. I'm only 33 and never injured my back prior to my 3 years in the infantry.
  16. I went and had x rays of my lumbar spine at the request of my chiropractor and the x rays revealed mild lower thoracic degenerative changes t 11 t 12 loss of disc space mild spondylytic changes at t10. 11
  17. I have a similar claim it is listed as: ten year old forgotten claim now in administrative review. Thanks ketchup56 for your input and telling me about your post here. I put a call in to NOVA but am waiting to hear back from them about my claims. Anyone use NOVA legal?
  18. Ketchup56 was your claim ever finished kr is it still open? What can i expect from the va at this point? Do you think they will order a c and p exam? Thanks for your input.

This is the statement i wrote but didnt send it.This statement is in support of my claims for lower back pain and hip disorder which were filed on september eighth 2003 and ddeferred by the v_a on february 13th 2004. Before I joined the army I had no hip or lower back pain and I had no need pain I was pain free and in good health during my enlistment I started having pain discomfort swelling caused by the wear and tear off road march is with your that work 12 to 20 miles long this cause injury to my lower back hip knees feet and ankles since my ETS these issues have progressively gotten worse specifically my lower back pain pain in my hips and my knees on March 10th 2014 I called and spoke with a VA claims worker who is knowledge that the VA had not completed my claims from 2003 he was also very understanding about my pain and situation he advised me that I should write a statement in support of my claims I also expressed to the claims worker that I had taken steps since my ETS to try to alleviate my pain but without success I have been to the VA for my pain as well as to chiropractic care and massage therapy but my condition has worsened overtime because of this my quality of life has been negatively affected mi pleasurable activities reduced to include running and hiking I have gained 80 pounds because of this currently my pain is effecting my ability to work because I am a driver in addition my left knee has gotten worse and I compensate with my right which causes hip and lower back pain please consider my statement and your decision thank you

I did call the va yesterday to check the status of the claim and the claims worker suggested that i send a statement in support of claim and he sent oakland a message saying that i would do that with in 15 days and not to make a decision entill they receive my statement.
  22. Is a statement in support of my claim a bad idea it is form 21- ----, i forget the other numbers. Basically i would this is a statement in support of my claim from Sep 8, 2003. That was deferred by the va feb 13 2004. Then explain that my condition has worsened and is affecting my daily activities. Is this a goodor bad idea?
