    Also---re CHAMPVA- I went in to pay my Home Owners  and Car insurance one day and the Manager asked me what kind of Health Insurance I had, and when I said CHAMPVA he said- no way I could sell you anything better then CHAMPVA.

    Yes, you could save quite a bit of money- I am surprised you found the coverage limiting....?

    The wording on their site made it seem limiting, like some things wouldn't be covered. I will have to do more research.

    Depending on the Chapter 35 DEA EED, if any of your kids served in the Military, that might extend their Chap 35 eligibility to include their years of service.

     

    Personal example: My Chapter 35 for me and my daughter came 3 years after my husband died. She had already enlisted into the USAF.  She sent in the paper work ( her DD 214 and copy of the award letter )to VA EDU department and they made a major error on her Cert of eligibility as she was soon to turn 26-.She called me up and was furious because the regulations are right on the form she had to file.

    I had to explain that VA EDU is often an oxyoron and I wrote a NOD but she said I also called CUE on them-( dont have copy anymore) mailed it to her, she signed and mailed it to VA EDU , a mere 3-4 weeks later she got the right Certificate 7 years and one month of Chapter 35.

    I used Chap 35 ,myself but my limiting date soon  ran out.I paid for the rest of my degree myself but when I won my SC death claim, they sent me a new Chap 35 eligibility date , and ended up reimbursing me for 6 or 8 thou- forget- that I spent on my tuition after my first entitlement ran out.

    My daughter got so many college credits from her Mil time, she Clepped some more credits and  never even used her Chapter 35. She did not want to deal with the VA at all.

    It is Very unfair the way VA handles Chap 35, sometimes. But that all depends on the EED they decide on,.

    ChampVA, which the spouse would eligible for too , and maybe the kids-depending on their age- has a reimbursement scenario as well- and CHAMPVA is wonderful.

    They have their own web site and the application form is on their site. I have had only one problem regarding CHAMPVA-that is I was charged for a med because a new pharmacist said CHAMPVA would not cover it. I checked in my CHAMPVA booklet  as soon as I got home and they sure were suppposed to.

    I called CHAMPVA and they handled this in a heart beat. About 10 minutes later the pharmacist called me to tell me my cash refund was there.

    I wish veterans could get CHAMPVA- VA seems to mess up the Choice Program, as it is.

     

    I was just wondering about champva today. I currently carry bcbs insurance for my wife and kids. The champva site makes the coverage sound very limiting. I was originally thinking I could drop the bcbs and save a ton of money. Anyone want to weigh in on this?

       Been a long time since I posted. It's been about 4 years since I got my BBE with 100% rating. Even though I was 100%, 4 of my conditions required reevaluating after 5 years. I stressed every day for the last 4 years, as money was tight and I couldn't afford to lose 100%. 

    I signed up for USPS informed delivery and it showed today that a letter was coming from the VA evidence intake center. Did some research and worried all day about what it could be. It showed up and was a letter that said they reviewed my original claim and decided to just make them all permanent! I'm now 100% P&T, the kids have education assistance, and my property taxes are now $0!

    Since P & T is a medical determination,a strong IMO by a doctor or Vocational expert could help you

    Also if Voc Rehab finds a vet un vocrehabable solely due to their SCs, that also suggests they should be P & T.

    But should wont do it.

    I was awarded under a CUE recently,and all of my evidence indicated P & T, but to RO somehow did not state P & T and even the director said the rating was "temporary"

    They agreed to the Total 100% but not the permanent status

    Death however makes any 100% SC P & T.

    It would not even be an issue but I think they denied my accrued benefists (20 months, pls SMC, vet and 2 dependents)

    by saying this was nOT a permanent disability.

    I can hear my dead husband rolling overin his grave.

    This specific CUE issue ( presently at VACO) regards a 100% P & T issues that VA found many years ago had contributed to his death (1151) Documented FTCA/1151 DIc. He is totally and penmanently dead from all the lousy VA care I charged them with.

    All of my evidence, to include a neuro C & P exam, whereby he was declared P & T at 100% , by the VA neuro (I was present at the exam)

    supports a 100% P & T status for this CVA 1151 disability.

    If I were you I would consider getting an IMO.

    The doc here at the Bath NY VA specifically checked the P & T status on the NYS Higher ed form.I have copy of here.

    The doc also asked me if my husband had applied for higher PTSD rating and I told him yes ( 30% went to 100% P & T SC for that

    as well.

    Maybe your form is different than the one we had from NY state higher edu.

    If I were you I would pursue this because P & T gives your dependents some. wonderful benefits.

    I get those benefits under the PTSD award, and my 2 SC deaths awards , Sec 1151 does not come with those benefits.....

    They can harm or kill a vet, and award "as if 1151 SC or DIC under 1151

    but the spouse and children get diddly squat,when it comes to CHAMPVA and Chapter 35.

    They completely changed the application process. All you have to do now is submit your AB8 and and the application (if you are 100%) with no Doctor signature required. I will look into an IMO. Thanks for your help!

  6. They usually only discharge student loans for anyone disabled, if they are P & T:

    A NYS Dept of Higher Ed waiver a VA doctor signed for my husband in his lifetime was instrumental in my 2012 1151 100 P & T award.The VA doc checked the P & T part of the waiver application.

    It is also evidence for my pending CUE claim.

    Maybe you should seek P & T status now.

    Thats what I thought too, saw a couple of people that said they were approved and not P&T and read all the documentation. The Dept of ED CFR uses the term P&T differently than the VA does. The application form even states:

    The following two types of VA determinations meet this requirement: (1) a determination that you have a service-connected disability (or disabilities) that is 100% disabling; or (2) a determination that you are totally disabled based on an individual unemployability determination.

    So, as long as you ahve disabilities that equal 100%, you should be approved. I verified this with nelnet and the dept of ED before applying.

    How hard would P&T be to get? I am due to be re-evaluated on two conditions but even if they are rated at 0%, I still would be 100% with my other conditions.

    • You are totally disabled based on an individual unemployability determination.

    And with P&T I cant work, right?

  10. Congrats!

    I agree w US VET, probably 1 item was deferred. You can Go on E benefits under start a new claim and go through the pages to about the 10th page and it will list all of your disabilities and the current percentages.

    Also be sure to file on E benefits to add your dependents --if that has not been taking care of yet.

  11. Great News Bud, and it sounds like either the VA deferred one of your conditions, or a big wig is reviewing you claim for accuracy. Either way it is a great way to start the weekend.

    Yeah, I did a little bit of searching after I posted and it looks like it is probably a deferred condition. I am okay with that, and it sure is a good way to start the weekend seeing as how my kids need shoes and clothes. Thanks for the congrats everyone! Now I just need to find a good doc for all this pain.
