I am trying to put together a chart on what is needed to file PTSD for MST. I was abused but tried to put it behind me. When I was in the Army no one believed you when you spoke of harrassment. They would find a way to give all the dirty assignments and give you a bad EER. I was attacked by both sexes in the military. I wrote my Senator because they tried to hold my promotion. I wrote a General and went to the IG.
The final straw for me was when they put the men in our tents in the field. I couldn't take it any more and I got out. I have been scared to file for PTSD because the pain was unbearable and I was embarassed.
I would appreciate any help so I can help my sister's in my group. They are getting turned down even with strong IMO's.

Pete appeal your decision your average GAF is 53 I know that is not how they calculate it but they should have considered your IMO and given you 70 percent.

Rich T is the person to ask on SMC. I believe you should get the R1 do you have a need for skilled care. R2

My original claim was also denied at the BVA. I understand it to mean if the BVA affirmed the regional decision then I have to file with the higher court. I believe I can win this but I want it to be right.

Are the reason for A/A and loss of use seperate disease pathology? If so he would be entitled to an "O" rating which entitles hin to an higher A/A R1 if he has skilled care under supervision of Dr he would get R2.

I am thinking about filing a CUE claim on my original decision. My understanding is that if claim was denied at the Regional office and held at the BVA you have to file CUE on the BVA decision. Has anyone encountered this before? Do I file CUE with the CAVC requiring me to get an attorney.

Berta, this is good news but is a shame that it took this long for the veteran to get what he is entitled to.

Agree! Since you have the C & P results -which I hope are favorable to your claim- I would if I were you- send the VARO a copy of those results and ask them to use this in support of your claim.
The c file most surely is at the VARO and they might have gotten the C & P by now but this covers you if that report gets lost.
