i am working with a VA employee, and she really seems to be pushing for me in an honest way.  It may be a mistake to trust her, but there is no way to tell. What is really confusing is the VA Dan say anything they want. All they have to do is say "you didn't submit the required new and material evidence, claim denied", and that is all there is to it. They can say " you never made a complaint, or your service records do not show you had a disease". They can do anything they want. The people the DRO answers to screws everything up, and that's probably Washington. They do this remotely so vets can't track them down. Why would my claim go from St. Louis, to Georgia, to Nebraska, to Texas, when they all have the same system, with the same access? The NWQ is a phony put on. It is not even real. Why would Georgia take my claim because of lowest work load, then stop and Nebraska start? Then Nebraska gets started only to stop and have Texas take over? Then Texas just says "there never was a complaint, a disease, a hospitalization, no medical treatments and no records of any of it", knowing it is lying to me?

They will determine what is new and material, whether it is or not usable as evidence. The link Buck posted says it all, and I've been reading the regulations and laws for a couple years now, and they show that the evidence is completely in my favor, "but", this is all based on honesty, truth, and facts being accepted as facts. When the truth is perverted, the facts being said not to be true, and the laws and regulations that are used in verifying the facts become toilet paper, have the problems we do.

  2. Gaston.

I must be confusing my DRO with my appeal. I filed a NOD in January last year. I have talked to a number of people that tell me to be patient because the DRO hearing is taking an average of 310 days before it happens. I don't think they were talking about the conditions on appeal. I will try to look this up and answer better.

I haven't heard a word of an RO's Monday Morning report,  or what it means. I have probably been lied to again, and would not be surprised.  I won't be here in 4.25 years to worry about it, but how do you know about the Monday Morning Reports? How would I find the number of open appeals are listed.

  3. Gastone.

Yes, I have a fatty Liver, and yes, I do have it on appeal. I have quite a few conditions on appeal. I asked for a face to face DRO in January 19, 2016, and the 310 day average is long past. i am hoping it comes around soon. The VA maintaines I never complained, or had any conditions, and ignore the fact that I was hospitalized a month for an unexplained severe outbreak of atopic dermatitis and urticaria, which I had never had before Vietnam, but always had afterwards and still have. They are Intentionally delaying a resolution, and damages should be levied against the VA for obviously manipulating the outcome of my health over the last 45 years. I have some of the hospital records, but I am sure they picked through them, and probably destroyed some. I think the spleen was overwhelmed in Vietnam and years afterwards. I had all the symptoms of an enlarged spleen and remember reading a report of one of my illnesses indicating deep vein thrombosis and slowly bled for 2 months from a vasectomy, and lost half my bodies blood and had to be completely opened after an appendix laparoscopy. I tried to get all my records, but 5 years and they are gone. The VA would not treat me, so I had no records going back past very far.

  4. My A O Exam was a farce at the Kansas City VA Hospital. He actually told me to stop giving him anymore evidence and raised his hand to block my attempt to hand him documented evidence. I wrote and complained about him, and what a liar he was, but they weren't interested because he lies for them. He screwed the computer up and spent most of his time getting help from other doctors while I could have taken a knap and he wouldn't have noticed. Then one year ago I asked for another AO exam and that female doctor refused saying it would change anything, and I would have to use the same examiner I had before, because he is the only one around here that performs them.

  5. MikeHunt.

I Thought I replied, but anyway you are correct. They acknowledged IHD and PTSD, but they blatantly lie. Why not. They answer to no one, disobey any regulations or laws they don't like, and do what they please. Who is going to stop them? I am going to see what happens in the next 49 days, or 48. Then it will go one way or another.  Thanks for knowing the VA, and the way they operate. I will say one thing for them. To write down what they know to be 100% pure bull takes some gutsy rating officers, and for the VA to back them takes some really corrupt officials.

  6. Berta.

Maybe I can clear some of this up. The VA denied every claim and all service connection and treatment until about 20 months ago when I got 30% PTSD and 10% IHD, I ask for reconsideration and got increased to 30 + 30 or 50% with unemployability denied. I ask for another reconsideration, caught DAV in several lies, revoked their POA, so the VA denied my reconsideration at DAVs insistance and immediately i was denied any increase and unemployability. I just this January 20, 2017 got to 70%, 50PTSD, and 30% for IHD with U.I. still denied. I had a pretty bad stroke 7 years ago, and have been disabled since then. I had another stroke last July and I believe these are directly connected to me exposure in Vietnam. I was hospitalized 21 days in Vietnam,  issued a permanent profile on DA3349 for Permanent defects in my "Physical capacity and Stamina, and permanently nondeployable on a world wide scale, then Medevacd to Japan for more tests for the cause of my skin disease. They could not figure it out, had no clue how to treat it, so I was airlifted to the Naval Hospital in Chicago. After several more days in the infectious disease ward, I appeared well enough to be released, so I was sent "Home Awaiting Orders". They sent me 800 miles to a MEB or IDES, I don't know which, but I thought I was going to be medically discharged by things that were said in the other countries. I was not told what the Medical Board was for, why it was held, or when, until I was being driven to it. I was told they could kick me out of the Army's Military Service, so I agreed to stay on duty, even though I was still ill. I continued to deteriorate with the itching skin, swelling skin and limb areas, acne got worse, unexplained fevers, soaking night sweats, chest pains, urinating blood, migraine headaches, pain behind the eyes, ears aches, swallowing problems, sinusitis, pharyngitis, severe abdominal cramping, ringing in the ears, fatigue, irritability, insomnia, urinating blood, continuing bone and back pain, undetermined respiratory infections with hospitalization, shortness of breath, painful and sensitive prostate, and 2 months after my discharge I had extreme fever, convulsions, and COMA for almost a week. I never recovered, but got help locally because the nearest facility was way too far. After suffering enough and learning some of what Agent orange does, I knew I was a victim and filed a claim on April 4, 1983. On January 11, 1983 a blanket denial of all agent orange claims was issued, so I was denied before the local VARO even received my treatment records. The VFW requested them for me, but we never received a thing, not even a turned down request, and it's only been in the last 10 months that I got some treatment records. The VA has lied to me a hundred times or more, and manipulated my documents. I was well over 30% disabled all my life, but I got by without the VA spending one cent treating the atherosclerosis or any other issues. I have too many issues to list, because of the AO, but it's like the VA and I I was ever ill in any way. It says I never complained but I was hospitalized several times and for a month on one of those occasions. Why would they say I didn't complain when they treated me in half of May and half of April 1971 in Vietnam four conditions that could not explain? I hope this clears a few things up. I am now receiving some disability but they continued to lie why I am not 100% and why I wasn't 100% in June 1971, they are lying about the real reason I was evacuated out of Vietnam, and everything about my case has been a scam. One thing after another, lie after lie. I think I was part of an experiment, but no matter what it was, it happened in the service, in a combat zone, IN The Ilne of Duty, through no fault of my own, and to this day the cause is unknown and unspecified. The residual damage wasn't known about in 1971, SUPPOSEDLY. What do you need to see exactly Berta? I will try to post it, and thank you.

    Victor

  7. Mike Hunt.

Thank you, and yes, you are exactly right. Those are STRS and they deny their own documentation. After Vietnam,  I had no chance at a career and was nondelpoyable to most of the world. I had permanent defects and continued to deteriorate all the time on active duty and the rest of my life. I filed a claim in April 1983for Eczema and Systemic Residuals of Agent Orange Exposure and submitted my DAV 3349 as evidence because the Army gave me nothing at my Honorable Discharge, besides that form, discharge, and a few more documents. They maintained all my records from overseas were lost, but I know better. My requests for my 201 and all medical records were not answered and I received nothing until about 9 months ago and after 20 plus FOIA REQUESTS. I was urinating blood, had abnormal liver functions, diarrhea,  heart palpatations,  severe nausea and abdominal cramps,  bone pain, acne and rash with swelling around the eyes, ears, neck, swollen hands, swollen ankles, large wheels, swollen limbs where you could push the skin and inch deep and it would slowly fill back in. They had a medical board and four medical officers signed the DA3349 permanent profile for the permanent defects and nondelpoyability, one being the Commander of the 24th Evacuation Hospital. The PERMANENT DEFECTS are ignored by the VA, and all the other conditions and diseases that followed are also documented,  but the VA simply says they never happened. They refuse to admit I was hospitalized and especially why I was hospitalized. This is down right lies, and the lies began in Vietnam when they evacuated on the grounds I was allergic to Chloroquine even though the records prove I had no reaction to Chloroquine and they were completely lost. In Japan after more tests they were still lost and 7 or 8  months later they still had no clue, and that is documented too. I think I was part of an experiment because some records are still withheld. The damage is done, so why do they deny the Truth? Why claim these events never took place, that I never complained, or had a skin disease, and hide these all my Life? How can they be so dishonest when all those medical officers testified that they are True? It is beyond dishonesty,  and the VA is saying "go do something about it", flexing their power and Authority, and daring me to get an attorney, knowing I will die before resolution. I need the best litigation lawyers in the land, that can scare the VA from purposely making development to deny cases. Damages should be awarded for intentionally hiding the truth and hiding records going on 5 decades. Thank you for your patience and understanding.

  8. The VA lied to me and screwed up in June and July 1971, and know it, and they have drug this out to cover up the facts, and the Medical Board proceedings because they probably show the ramrod job they gave me. They had to cover up another agent orange case. In Japan where I was getting more tests, the officers came to my bed and said I was the 5th service member to come from Vietnam with urticaria to that degree, and they were at a loss to what caused it. They could only treat the symptoms, not knowing the cause, and would only be throwing knives in the dark, so I was going home. I never got any records from Japan or 7 months after Vietnam either, and still don't. 12 years later in 1983, it knew the truth, but was covering it up, and I was one of those hat were denied before it Ben examined any documents at all. I was denied before my treatment records had even been shipped to the VARO for a review for decision, so you see, your documents mean nothing, except to an attorney and the news, and now President Trump.

  9. Buck.

Thank you, and yes I have those records, and so does the VA, but they are meaningless. They look at them and say screw this guy. Make him die while we tie it all up in appeals and reconsiderations. They know exactly why they are delaying every step in this process. I want an attorney that won't sell me out, and wants to make an example out of the liars at the VA. I have many more records too. The VA told me they weren't going to releas the records for 7 months after Vietnam, and laugh at my 30 or so FOIA Requests. At times I had the lowest blood pressure the Army doctors had ever seen. They used 3 stethoscopes think they were all broken. That's why I say the facts don't really matter, or who documented it because they decided the outcome a hundred years ago, what the outcome will be regardless of the facts. Thanks for the encouragement.    Victor Ray

  10. Is it not illegal for a medical provider to withhold evidence from someone, that if they would have had the information, their health conditions would undoubtably be better? Life expectancy even increased by years?

By withholding medical facts affecting the vets length of life, is it not setting a death sentence to a date earlier than his natural length of life would have come? It's almost murder when they still withhold treatment records after 46 years, and I would like an attorney that's not a coward, and not afraid to expose the VA. They have no intention of being honest about any part of my claim because this would be the fourth reconsideration, and they are playing me for a fool. I am going to advertise on the front page that I need he best lawyers that money can buy. I am tired of the runaround, so the lawyers and press can handle it from here on out. Be watching the news in the near future. Thanks everyone.

PS it is a money thing, but it is equally an honor thing

  12. Gaston, it's the chloroquine that causes PTSD symptoms. I will try to find the articles and may be able to post them. I never was properly treated for malaria, and I bled for 2 months from a vasectomy,  and lost half my blood from an appendix operation. I have a brain hypodensity and 100% blocked carotid artery (inoperable too). I had several strokes, and have a fatty liver, but don't drink. I could go on about the prostate, bone pain, the atherosclerosis, degenerative bone disease,  swallowing problems, GERD, heat intolerance on skin, the headaches, urinating problems, diverticulosis, floaters and particles detached from the back of the eye, petechia, dozens of Cort ozone shots for tendons, the coma, the chloracne, the all amyloidosis I think I had. The VA hid all of my treatment records and lied them on top of that. All of 1971 records are missing after my return from Vietnam. They even lost the the local records from on that base. They will not release some and told me so. I am being put in for reconsideration but am going to speak to a tort claim lawyer too. I think it is criminal to withhold medical evidence, when if it had been known could have been managed for a better quality of life. In 1983 I was denied for all service connection and medical care for the conditions I was hospitalized for.

I guess I was ranting. Sorry, and I will tone it down, but there isn't much to discuss. The VA has showed me that they have no intention of making a mistake right and correcting it. I paid all my life for all of my care and medical needs, and just started getting my medicines for heart, bladder, intestines, blood, bones, skin, about the last year or so. My file is 28426325 if you care to look at it.

  13. Buck.

Unfortunately,  it "does matter how long it takes". Many of us dont have the luxury of time, waiting for our turn to come around. All claims are treated the same, from a homeless deranged person that never was in the service, to a commanding General losing a leg in combat. That is, according to DAV! Lol. They expect us to believe that because we are not capable of making a medical opinion, but doctors are some of the most ignorant medical people in that field.

I started my claim over 33 years ago, after suffering 12 years already with the skin disease documented in army treatment records. I have the P-3 profile for permanent defects in the heart, gastrointestinal system, respiratory system, endocrine, blood disease. While in Vietnam I developed sharp chest pain, now heart disease, gastrointestinal problems cinfining me to the barracks and that caused 24 tumors so far and more coming I am sure, I was hospitalized 6 or 7 months after Vietnam for a respiratory infection that they could not determine, and now have shortness of breath, etelectasis, mid and lower lobe opposites, and the agent orange exam in 1983 showed spotty lungs, but that record was destroyed I suppose. I also developed a sensitive and painful prostate at 19 years old and about 6 months after Vietnam, now it is watch and wait but benign supposedly. I have a coagulation problem with my blood and take an aspiring everyday to thin it. The atopic dermatitus that developed or became known and documented in Vietnam for the first time ever, was confirmed at the 1983 AO exam, but the sneaky doctor removed the spotted lung information to satisfy the VA and keep his checks coming. It has now become malignant and benign skin cancer carcinoma,  but not matasticised yet hopefully.  One Examiner tried to say it was probably syphilis is that caused all this, along with migraine headaches, but I was tested for syphilis and was completely negative for any stds. My claim went from St. Louis, to Georgia, to Nebraska, to Texas, supposedly to speed the process up, but they all looked it over, searching for false information, wrong information, loop holes to keep denying me, and finally just said I had no skin disease, no complaints, no treatments, when they know I was evacuated out of Vietnam for a skin disease and the record was sent to Washington DC. I have copies too. The point here is to show that the VA is completely staffed with crooks and liars at every facility in America, especially St. Louis. They have ruined many lives, and this criminal activity will continue until there are public hearing against them. I would like to be the first witness against them because they are waiting me out, hoping I die before resolution,  like the other 300,000 plus before me. I am negative for a good reason. 46 years of lies and deceit.

  14. Gaston, that pill also causes symptoms that mimic PTSD.I don't recall ever having a problem with the pill, no outbreak, no allergy, even though the doctors in Vietnam used the chloroquine rule to evacuate me out. You can't remain in country if you can't handle chloroquine, but I handled 2.5 times the dosage at 300mg doses. I believe the cover up was in effect even then and that the VA knew even in 1971 of the reprocussions of those agents. The liars and idiot Secretary in Washington refused to accept the fact that I needed follow up treatments, and dismissed all laws and regulations in my case and did what it Damn well pleased and the rotten to the core VA backed them up. They take care of their own and pat themselves on the back.

They with held medical information from me all of my life, which absolutely would have made all the difference in my health, mentally and physically, but the VA denied every benefit it could. It is the VAs fault that my health is the way it is, that my life span is shortened, and that I suffered needlessly many decades because the inept of the VA to do the right thing, choosing to screw me over, deny medical help, and all other benefits. They set up these phony organizations all over like DAV, pretending to fight for you, but we have caught on to the ruse. Those clubs work for the VA by reducing, delaying, or denying benefits to veterans who believed the VSOs are there to help, lol. How could we have been so blind when it's so obvious. The VA says I never had an injury, illness, or disease, and never complained, nor was I ever treated or diagnosed for any medical condition. The examiners are complete liars, the raters are total liars, and their violations of the laws should not go unpunished, but it does what it wants, and the veterans health doesn't matter. The VA are totally corrupt at the upper level and need to be jailed with Bernie Madoff.

  15. Gaston, exactly right, with 30%for IHD which puts me at 70%. Individual employability denied.  I have had a couple Strokes and a 13x5mm brain hypodensity, and totally disabled for over 7 years now. My left carotid artery is 100% blocked and inoperable, I had 24 tumors removed and am sure I have more now. My blood was checked with the tumors for inherited qualities and there are none. They were environmentally acquired. My official diagnosis was a little confusing but the Washington doc. says "skin disease". The 24th Evacuation Hospital in Vietnam issued a P-3 profile signed by the the Commander and 3 other officers for permanent defects in my " physical capacity and stamina", and ""Discharge Disdiagnosis; Urticaria secondary to Chloroquine ingestion. Medevac to CONUS."".The code is 708.9 which is "urticaria:unspecified or unknown". I developed an enlarged sensitive and painful prostate just months after Vietnam, had paralyzing abdominal and bone pain which started in Vietnam, and it wasn't chloroquine.  I had no reaction to Chloroquine,  but they were desperate to get me out of their care. I went to Japan for more tests, but those results are withheld even today. I just got the treatment records from Vietnam last April, but requested them since 1983, and I have the requests, 30 give or take. They are withholding some they say. I was sent "Home Awaiting Orders" and orders were changed to send me 800 miles away for PCS with a MEB first. There, I was lied to and intimidated and was still 19 years old. I was NON DEPLOYABLE on a world wide scale, still ill from Vietnam, and had no chance at a Military Career. When you are threatened, injured, and afraid of reprocussions it is easy to go along with what they desire. I continued to deteriorate in every way for the remainder of active duty, with no treatment for the illnesses. They couldn't help me. 2 months after honorable discharge I was in a "coma" from extreme fever of 106+ and convulsions, and many illnesses since 1971. Yes, I can redacted the letter and post it. I don't know what good it will do, since you are not connected with the VA, but maybe a lawyer is. How many service victims were hospitalized a month and evacuated out of the war torn country for exposure to an unknown source and lied to their whole life with $0.00 in VA help or aid?

  16. I have found that the VA has had evidence decades before they say they knew. They have been deceiving us, Liang to us, and depriving due benefits for 5 decades at least, and me personally for 46 years. They are dishonest and deceptive, and have been the root cause of Veterans suffering to death, needlessly. Over 300,000 and it's probably double that at least. Your claims are delayed to deceive you and delay you, nothing more. NOTHING MORE. My claim went from the crooks in St. Louis, to the lazy jerks in Atlanta, to to numb nuts in Nebraska, to the warped minds in Waco, TX, before determining that the month I was hospitalized in Vietnam did little to nothing. Since July I had another stroke, now a brain hypodensity, and the coma and migraines on duty don't mean crap to the liars at the VA. They lied to deprive me of a life, and they did. Despite 20+ FOIA Requests, they withheld medical evidence and documents that could have changed my life, so they just say screw you, go die. They knew all along, and are lying to you now.

  17. Remember this. It is slimy people that rate you. They are liars, inept, unskilled, working at bonuses just like the slimy VSO'S are. The VA and VSO'S all work together to "Fxxx Yxx" out of all that they can. The doctors of the 60s and 70s were ignorant, unskilled or "more likely than not" ordered to falsify documents concerning Agent Orange in order to screw Vietnam Veterans out of benefits. They are so corrupt they let hundreds of thousands of Veterans die intentionally. A putrid disgusting, lying organization that deliberately made me suffer and deliberately withheld benefits just because they can. Hospitalized a month in Vietnam for something decades beyond their understanding and the dirt bags have not changed. The most deceitful organization in government. They deliberately kill vets, and the lawyers suckered what life is left out of them.

  18. This is exactly what happened to me Berta. I filed in 1983, but was denied because I used Systemic Residuals due to AO Exposure. The records show urticaria-unspecified as the reason for my skin disease. The affected areas were every item mentioned in the P3 for "physical capacity and stamina" right down to the letter. They documented everything themselves and had the evidence on hand, but denied everything. I have documents for every condition and finally just got some of them a few months ago, after dozens of FOIA Requests. Several diagnosis shows organism undetermined or unspecified.

i had been exposed to something they were not familiar with, or had never seen, and I had all the characteristics of AO Exposure. I did not receive the ""over 120 days recovery"" that was ordered for when I returned from Vietnam after a month of hospitalization. I was ""permanently affected"", and had some sort of board after ordered to active duty following being sent ""HOME AWAITING ORDERS"". I thought I was to have over 120 days recovery, and would medically retired, but I was ordered to active duty instead. I got no counseling at all, was basically led to believe it was some sort of disciplinary board, and may be discharged other than honorably. I should still be recovering at that time because I was still ill, and got worse all the time on duty. Every organ and every system was compromised by the exposure, it is being reviewed again now, and I hope this 4th time they see their oversight and incorrect award. Thanks.

PS. Here is another condition I had, and it has affected me my whole life, and now the lungs are partially collapsed causing permanent shortn SS of breath. I believe this happened in Vietnam, and kept recurring all my life.

    image.jpeg

  19. Gaston,

I am saying that on April 11, DAV notified the VA I had rebuked them, and to remember it when it comes time to award or not award benefits, and do it as soon as possible. Within 3 days, the VA made the decision and wrote up the LETTER stating there would be no change in benefits, "0" benefit increase. Of course I did not receive the letter for a couple days. The record for SC decisions is held by the American Legion-1 day. The next I believe is DAV-1 week. You can google it and the DAV claim was for Stephen Kelly was correcting a "CUE", if I remember correctly, and went back 12 years for retro pay. I forget the other off hand, but they both worked closely with the VA and hand carried the claims through the process. Yes, it can be done, but only when they want to be in the news.

as far as a redacted copy of the letter, there were several issues addressed. There was no names and no signatures, and appears no one to take the credit. Is that standard practice? I don't think so. Most items state they could be reopened with new and material evidence, and I did that, then I got put into the NWQ June 13 and am still there. The new completion date is April 4 2017.

The letter is 8 pages, so is there a particular page that would help? Let me say this, because it is important. The Army knew my heart was permanently damaged (along with all other organs), and ordered a recovery period of more than 120 days. I was issued a "permanent" profile for the defective heart, and the 120 was a trial period, to see if I would stabilize. I did not. I continued to deteriorate, and the next seven months of treatment records, after my return, are not found.

DAV and most of the VSOs expect you to come in their office with a big lie, like "I was hospitalized in Vietnam for almost a month from exposure to Agent Orange, and I was pissing blood, and my legs and arms were like balloons, my ankles were swollen real bad, I had fevers, bone pain, abdomen pain for weeks, headaches, I was weak, couldn't eat, and they medivaced me out of Vietnam because they couldn't help, and thought it was a chloroquine reaction, so they ordered 120 or more of recovery", and of course DAV busts a gut at how fantastic the story is, and THEN THE GUY PROVES IT ALL WITH ARMY DOCUMENTS and current civilian doctors reports, but DAV and the VA still won't admit their own documents are good enough evidence, so they wait the guy out.

You need to do the following, in this order:

    1. Email Robert McDonald and tell him:

    a) you need an immediate decision as you have failing health

    b) a Couple short sentences of MEDICAL EVIDENCE, with dates of exams, on how you deserve a higher rating (EED, higher percentage) etc..

    c)  Dont give your opinion...remember they dont beleive anything we say, but show how their decision is in conflict with the regulations and your evidence.   Dont call VA crooks, even if/especailly when its true.

    2.  Get a lawyer.  Dont mess with VSO's.  Decide which heir (wife, son, etc) you want to be "substituted" as a claimant in the event you die before your claim is completed.  Our own Berta has won her late husbands benefits because VA killed him with poor medical practices.

    3. Continue on with more important things, hobbies, friends, grandchildren.  Make amends with everyone.

This is what I received. DAV made sure the VA remembered and considered that I dumped their power over me, so punish me by not changing a thing. The VA obeyed its superiors.

  21. Gaston,

I am almost 65 years old. I do not have a terminal illness diagnosis with a date, but statistics show this and that. Example is People with my calcium score have a life expectancy of 4 1/2 years after diagnosis. 2 1/2 of those are gone. I barely survived a stroke, and may have already had another, but they found a 13 X 5 hypodensity in the brain after I was admitted with BP of 204/101, but normal heart rate. It went to 227/109 and stayed for hours, but it was brought down artificially. I have CAD 30% rated and hypertension be but denied.

I have been in the NWQ since June 13 2016, but sitting in the active claims since mid April

i am supposed to have a DRO, which should be around end of Nov. That would be about 310 days from January 16, 2016. It won't surprise me if they don't remand it to mak sure I die before resolution. It is a scam designed to drive vets to suicide. The VA causes these suicides by making guys wait years for a resolution, and the claims go through dozens of hands, but why? They aren't allowed to make a decision, but dozens study your claims anyway, then it gets passed on to someone else that looks at it, but aren't allowed to make a decision except deny. These are groups or teams looking for a reason to deny the claim or send it back into the process, that's all. There are good, honest, correct claims, that are denied over a small worded phrase ruining people's lives, and that is bullsh... These raters are looking for mistakes in the claim, technicalities that will allow them to deny a claim, incorrect dates, politically incorrect medical name for the injury or illness, or anyway the VA can escape liability, and put the veteran back in the system without an award. The VA is not looking to honor its commitment, but to save the governments interest.

Why the SOC or SSOC? What would that do? If the facts don't make any difference, why would any SOC. It is all lies anyway. It will say it was not incurred or aggravated by military service, or not service related. I will see what I can dig up. By the way, I have and am in the process of changing all my doctors. They are not interested in anything except the number of clients they can see that perticular day. Money money money. I will try to find tat decision. Thank you.

  22. Thank you Broncovet.

I did email "Bob" once, but called him on several occasions. I don't believe he listens to those messages, and he never answers the call.

I didn't want to get a lawyer, but may have to. When they get through with their fees and charges, the vet gets pennies on the dollar. Even claims agents are crooks and expensive which goes to prove "it's who you know", that can pull the right string to get it done. Such a corrupt government.

I sincerely appreciate the guidance, and just so you know, I am working with a VA employee that seems sincere and like they are trying to help me expedite the process. She got my claim reopened immediately after the first low ball decision. She just told me she has put me in a hardship status, but I don't know if that is true, or just to make me feel good. I don't have a diagnosis yet as to what the hypodensity is,, but it can't be good, just not as bad, if you know what I mean.

I don't have any friends, but have family, but I don't tell anyone but my wife and the VA what is going on, and my wife will take over.

my guess is that 80% of all claims are artificially prolonged. 10 years to resolve a claim? Impossible. That can not happen, but yet it does, because we allow it. That is the only reason, we allow it. We allow veterans to get screwed to death, literally. How shameless this is.

My claim from 1983 is reopened, as far as I know, and they were asking for new and material evidence. When I was with DAV I said well, the NEHMER ruling for one, should do well because it did not exist yet when I filed, but came into play afterwards. The VA would not release my treatment records fan an appeal. They still won't release many, and told me they would not release them, citing some FOIA Chap 5&6.

i was supposed to be separated from active duty after Vietnam, because of the lengthy recovery period (over 120 days), and my permanently defective conditions that are listed in the Regulations for "physical capacity and stamina". It's the heart, gastrointestinal system, respiratory system, endocrine, geneatory system, blood disease, etc. I had all that, defects in all that, and the Army documented it, issued it in my permanent health records, along with being non deployable to half the world.

I was sent "HOME AWAITING ORDERS", and while there, I got orders to PCS to Alabama, 800 miles away. I should have had a PEB locally to determine if I was fit for duty, because I was found unfit in Vietnam. I did not receive a board until traveling to Alabama, and never did receive the "recovery period" that was ordered, "over 120 days". I was put back on duty about 35 days later, still ill. They discovered I had over 6 months active duty, and being well over 30% permanently defective, would have meant full retirement with full pay, with full health care, and all other benefits the military can offer. It screwed me out of all of that, and when I filed in 1983 they would not give me nor the VFW access to my treatments in Vietnam or for 7 months afterwards. I did get some treatment records this year from Vietnam showing the chloracne, swollen legs, arms, ears hands, rash on almost all of the body, large wheals on the back and trunk, abdominal pain and cramps,  bone pain requiring pain medication, itching skin, right side pain in liver, blistered hands, neck, ears, mosquito bites, fevers, irregular heartbeat swinging very low to very high, flexural atopic dermatitis, and some are missing, showing urinating blood, diarrhea. Just shows the cramps and pain. I have the documents showing all of this

The documents seem to mean nothing as evidence to The St. Louis VARO and DAV because they have both had them for 2 years. I was evacuated out of Vietnam after 3 weeks to Japan for more tests on my way to USA. Those results are missing too. I could go on and on, but the bottom line is that the VA has withheld all my medical records, all treatment records, effectively preventing me all my life from proving my case. Just a week ago I got 2 documents showing LD (Line of Duty) Upper Respiritory Infection and confined to quarters for 24 hours, with the organism or virus, accute, diffuse, and unknown. I had all these illnesses but they were strange and unknown to the doctors, but are documented yet denied. The 1983 fee based exam showed spotted lungs and atopic dermatitis. The Report left out the spotted lungs and past URIs. The VA says I didn't have any condition related to conditions I had in the service, but I have the Atopic Dermatitis still, and it is documents as a problem on May 26 1971, at the 24th Evacuation Hospital, Long Binh, Vietnam. The VA gas had all that since at least June 1983

  23. I am in the NWQ and  have been since June 13 2016.  My claim just got pushed back to April 4, 2017 as a completion date and it could be longer.  How is it possible that the in NWQ is going to benefit any veteran or even the VA?  I have documented proof of the illnesses I have now that began in Vietnam but the Raters that view them cannot see what's in plain sight,  or they are just continuing the tradition of ignoring the facts,  in order to deny or at least delay benefits.  I don't have the luxury of waiting years for the VA to correct this situation and it is a clear and unmistakable error going back to 1971.  There is so many things wrong with the system that it cannot be fixed and it will screw around till way after I am dead before it ever gets any repairs.  Half of the employees should be fired and the other half trained because they do not know what they are doing.  I don't think they understand what evidence is,  or how hiding and destroying it affects the veteran and his dependents.  Many do not know what any medical terms mean at all and cannot relate them to the veterans disabilities.  How could my claim get pushed back an additional seven months when it's been sitting there for two years or more already and is cut and dry.  The VA completely screwed up in 1983 ( A clear and unmistakable error) and so did the Army in 1971 ( another clear in unmistakable error when I should have been discharged medically), and they don't want to admit it.  They would rather I die than to admit a mistake  and properly compensate me.  The VA was wrong, and they know it, but the upper level  management  lie to its employees to take some of the guilt away because they get paid well enough to let veterans die without it bothering them.  It's easy to mark claims incomplete and put them in a bin to sit for years and years while we veterans die waiting.  I saw where two of my claims were marked incomplete but the bedrooms employee I'm working with says they are not incomplete but I expect they will never be viewed in my lifetime.  I have never seen so many dishonest actions in my life from one organization,  And it's the people at the top that are ruining the system not the average employee.  The upper level administrators lie to it's subordinates without telling them the truth about where those claims go,  or how long of a wait,  or why they wait without being resolved.  They are doing the governments dirty work and don't even know they are letting people die,  or be denied the benefits they are fully entitled to. How long do we sit in this fony NWQ?  There probably isn't a time limit or a death limit as to how many will die before it's fixed, is there?  Isn't the in NWQ supposed to speed the process up?  It is a total failure or is purposely designed to kill more veterans.  It's not a mistake that we sit there for years on end but is a design to allow the veterans to die.  300,000 veterans died and no one even noticed.  That's how good the VA is at hiding and covering up our deaths and destruction.  Is there not anyone that can force the truth out of the VA's management?  No one is accountable for anything,  And 12 veterans day discover the truth.

If you have a valid claim, a VA accredited lawyer does not cost you any up front money. He only get's paid from your back pay. Should be 20%, may go as high as 30%.

I don't have years to wait. I am already past due for a hard cardiac event and the VA knows it. They are waiting me out, and just pushed my claim back to April 2017. Hell, I may not even be alive, and that is what they are shooting for, don't you think? They intend for me due before a resolution just like 300,000+ other vets. By far the most corrupt murdering machine ever. Let 300,000 pet dogs die and see where that gets you, or 300,000 refugees that are here, or 300,000 illegal immigrants? 300,000 American Vets did, and the VA loves it. The VA puts on this phony bullsh!t like they care about the suicides. Hell, they are happy about it. Less paper work, a ton of savings, and their lives and well being were used up anyway, right! We are worthless and the VA lies about everything in order to keep us that way. Study my case, look at my records and tell me they have not been waiting me out. They started the lie 45 years ago in my case, but these dumb clucks believe the VA, believe they are serving a good honest organization. They don't know who is behind the curtain!
