  1. Tbird I hadn't had any success but I will tell you what they told me, my doctor and

prosthetic said I would benefit from a stair lift and a walk in tub but I was denied

and didn't push it any farther, but your luck could be better than mines. If you push them

enough you could get what you need. I just quit with it Good luck

  2.  Have you ever heard of a regulatory or procedural review?

A "procedural review," as indicated in your electronic records and eBenefits, is generally associated with an internal review of a claims file to ensure a claim was processed correctly. When VA initiates certain actions, a three digit code is assigned to the action and is entered into the computer for tracking purposes. Since the three digit code has been entered into the computer system, it looks like a new claim has been established in eBenefits. We apologize for any concern this matter may have caused you.

Hopefully, no one's saying you can win without evidence. The IMO /IME is basically like going to a sit-down restaurant instead of the chow hall. You're more likely to get someone to take the time to listen to you.

The RO looks at the DBQ/ opinion- In fact, my buddy got an opinion from a VA examiner, and the RO used their in-house MD to deny it anyways!! So there's really no sure thing.

In short, they have - private or VA- to provide reasoning for the opinion. The VSR is supposed to read through it before marking RFD (Yeah, right) and the rater definitely has to.

If it's an increase or a 'presumptive,' then the opinion and in-service event is 'presumed.'

    And congrats!

maybe I didn't read this correct WHAT ARE YOU SAYING?

Well, the link in the OP is one way. Most of us didn't report things in service, for various reasons. You read through sick-call rangers STRs and just realize how dumb that was.

In any case, you want to get an IMO and bring in the appropriate DBQ with your evidence.

Some things are the VA's problem (Like contention book filers), some are your problem (like getting evidence).

I will say, on any gov't payouts, there's always going to be tax-evader thinktanks who'll find one or two egregious fraud cases and try to make it look like everybody is a fraudster- They want you to thrust and take the bayonet for their wars, but don't feel you deserve any pay ... Please don't repeat their propaganda.

The reason the VA started hiring college women as raters to replace Veterans is because Vets are A-holes in some respects. Instead of being for the Veteran, they'd just deny based on their feelings. I can tell you this still occurs, two of my buddies were mocking a personal trauma increase claim- Like old men are supposed to know anything about how a woman feels after she's been 'assaulted.'

The whole fricken row (of men) joined in ... All great guys, but definitely not who you'd want as raters.

The VAWell, t\ is certainly far more liberal in granting than it used to be, and laws/media exposure isn't the only reason.

Well, the link in the OP is one way, to do what you have evidence in the file and we cant win a claim , but now we can win

with no evidence just get the IMO JUST DONT SOUND RIGHT TO ME. Evidence always can win it just might

take  some time to get them to look at the evidence to me 10 years for them to read ny evidence but they paid off

    finally.

  7. You know what people on SSI have to live on $770.00 per month and pay their bills and

no food stamps. BUT the POTUS don't want to pay that to the poor. Then they wonder why

people have to sell food stamps to get by. Cut congress pay $165,000 a year and cant vote

or come together on anything we had 8 years they couldn't and still cant agree on nothing.

That pay scale could be a little more now for congress

  8. Just a question HOW CAN YOU WIN WITH NO EVIDENCE OF ANYTHING ON RECORDS

ON A DISABILITY. This kind of stuff raters have to look at claiming sh** you can prove

evidence wins not your lay statements from you or your buddies. VA I guess suppose to

believe everything we say should be true  but its not easy and you will e surprise how many

vets file Bogus claims and VA has to look at this kind of stuff and make a decision. Waste of

time this add to the backlog. jmho

You Better care buddy ,unless you already have succeeded in every claim you have had. NOT

Don't tell me where to post important news - such as  pending legislation like this is. HR 457

You dont run this site. Tbird does.

This Bill, when it is signed into law  law ,can impact on Thousands of veterans, their dependents and widows, not to mention the men and women serving our  country now.

I guess I was supposed to post the Nehmer AO decision and info from NVLSP on  IHD,Hairy Cell B Parkinson's info in Social----

But You do not tell me where and what to post.

And I bet you do not even have a clue on what the VCAA is anyhow.

Have you ever heard of the Pelegrino Case?    Nope I didnt think so. That is why you didn't get the EED you wanted. Broncovet told you it was a CUE but you did not heed his advise.

Cue is for dummies who doesn't know any better. There is no attorney who will file

a CUE if you still have appealing rights for what? I got 6 digits retro and still getting more

without a cue just the time it took. I am ok I still GOT 6 digits in the bank and no bills

8 YEARS OF RETRO with a good attorney

  10. I agree this should have put in social  news or where ever it can get but not in claims question.

I really don't care because the WH agreed with something she or you says should be the law.

How will this help vets that's all matter Veterans.

It will never be but if you complain enough you will get a BS response from the WH.

If you are good people will response to you but every info you or me says is not the law

for VA benefits. It ant getting any easer . Everyone who answer questions also helps

and just a little common knowledge can help in a lot of ways. Don't bet all your money

on one horse race and expect to win it all.

  11. You

    1.  I agree, in at least SOME or most states.  In at least ONE state, you had to sign a form saying you were 1. Ready, 2. Willing. 3 Able to go to work in order to get unemployment insurance.

However, to get TDIU, your doctor had  to say you are UNABLE  to work due to SC conditions.  In this state, TDIU and unemployment insurance are not compatable.  You cant tell the state you are able to work, and then tell the VA you are unable to work, and not get in serious trouble.

My advice is to read up on YOUR states unemployment requirements (they should be online) and see if they are compatable with VA requirements.

I do NOT recommend you lie to either your state or to VA to get benefits, as this will likely catch up to you and bite you BAD.

    2.  Waiting to file for social security disabiltiy will cost you retro, file sooner rather than later.  Many Vets legally collect VA benefits and social security disability.

    3.  While SMC S housbound is supposed to be "inferred" that is, its unnecessary for you to file for it, you get it whenever you meet the criteria.  However, expecting the VA to always follow all their rules will almost always lead to disappointment.  Go ahead and file for SMC S housebound if you think you qualify, and you probably do, under Howell, if you can not work.    If you got a recent (within 1 year) decision awarding TDIU that did NOT award SMC S, then you could/should file a NOD and dispute that they did not award SMC S under Howell and Bradley vs Peake.

    Howell and SMC S

    https://asknod.org/2014/08/25/cavc-howell-v-nicholson-what-smc-s-really-says/

    Bradley vs Peake

Much has been written on Bradley, but here is a fairly short summary:

    http://ptsdlawyers.com/bradley-v-peake-housebound-rate-160-percent/

You cant both  IU and unemployment benefits. Unemployment you have to be willing and able

too look for and apply for work and accept jobs for unemployment's benefits. IU you sit

    at home and collect

  12. A) A). can i collect state unemployment insurance along with 100% IU?

You cant collect both if you are consider IU you are unemployable and cant work no more

    you cant get both.

B)B). Should i wait to file for SSDI until after back surgery? For what you are 100%

or getting paid because you cant work no more I would file now for SSDI.

C). when should i file for SMC-S Housebound? Thanks for the help and concern.....RLTW

You will be granted this when you become housebound or your rating is high enough.

  13. With all the lies he has already told and is still telling them, how can

we trust him??. Blaming everybody for his mistakes and then just

lie about what he wrote and accuse people of. I'm 58 never have I seen something

like him before in my life. He hadn't done nothing for me lately but trying to take away

benefits we already earn. What we should do is IU claimants start filing claims for secondary and

SC disabilities and increases If you can to make 100% but remember they might check everything.

If we don't do nothing they will try to cut our benefits and that's jmho

Should i have my boss clarify the fact that my loss of time is due to my symptoms and not the misunderstanding the first c& p examiner had?

it should help and not harm the claim. To get IU your doctor should say something like

your PTSD prevents you from any type of work including sedentary work and how  it will

affect you. I didn't see that on the C&P

    I see  a 50/ 70% rating.

They are not supposed to be able to use his prison time against him if this PTSD is S.C...if he got out of the military and had a PTSD Dx & went to prison then his social behavior can't be used against him  because of his disability. (for rating purposes)

this examiner did a favorable exam  in my opinion.

you cant collect comp, while in jail is this correct?

My boss is going to write a supportung statement claiming that that just isnt true.  I have full time work available, 40 hours a week, buy due to my back ailment and ptsd symptom as well as meetings, groups, therapy and physical therapy i am not able to work full time

Don't post everything on an open forum for everyone to see, keep somethings to your self just

a word of advice but Good luck
