  1. My husband just went through that process. He had a great attorney who fought for him all the way. Your attorney should file an appeal soon, they always deny things the first time, don't give up. It took us since April 04 until November 21 to get a fully favorable decision, the last hearing being 11/5/07. Guess SS wants to hold on to their money as long as they can.   2. My email is yuma@ejourney.com as requested, thanks--Sandra. I have been reviewing my files but had an emergency so will get back to them this week. I have learned that VA takes their own sweet time in responding to claims, hoping the claimant will give up but not this one. When Roger got 100% and I was entitled to coverage dating back over a year, I submitted claims to Champva; one claim I had to submit 3 times, even going so far as to find the necessary codes on my own as the hospital had purged their records and could not help me, but I finally got paid-but I still have some claims they haven't paid so guess I'll have to rattle them again, trying to phone them is such a hassle but think I'll try that. Dealing with VA has taught me to never give up; just keep track of what needs to be done. Sandra
  3. I have asked questions before and received great advice. My question now is what do I do? The letter states" we are writing to let you know that the AMC will be developing additional evidence concerning your appeal, recently remanded by the BVA. The AMC, rather than your local RO will be developing your appeal." Remand is for 1--whether there was a CUE in a January 1978 rating decision which reduced the veteran's service connected colon condition to noncompensably disabling, 2--entitlement to an effective date earlier than January 31, 2005 for the grant of TDIU, 3--entitlement to an increased disability rating for service-connected irritable bowel syndrome with history of amebic dysentery, currently evaluated as 30 percent disabling...... Among other things the CVAA redefines the obligations of VA with respect to its duty to notify and assist veterans in the develooment of their claims. In this case, the veteran has not been advised as to the evidenntiary requirements for a claim for CUE in a prior rating decision, an earlier effective date award, or an increased disability rating. When I called a SO at the RO and asked him what I should do, he said do nothing--they will get the information. I do not believe him and feel I should provide more info and argument in this claim. The VA violated the 5 year rule in lowering the rate to 0% --am I right in my thinking that in order to prove a CUE, VA must have violated a rule? I have been fighting this for 4 years and am uncertain as to what I should do. Flip aided us in getting TDIU and we appealed the effective date, but haven't heard from him in over a year. I am hopeful someone will advise me the course of action t take. I have fought this long and don't plan to give up just yet. I know there are people here who have knowledge about what to do.   4. Hi again: I have some questions for the great people here;I am trying to figure out the process for HISA (Home Improvements and Structural Alterations) Program. The info states "A prescription from a VA, or fee-basis, physician for HISA modifications is required and must include the following". My question is that I don't know where to get the application for the physician to complete--there is also a form # 10-0103 called Veterans Application for Assistance in Acquiring HISA-this form is for the contractor to complete. I have this form(10-0103). Has anyone dealt with this program? ALSO, in regard to the Independent Living Program, Testvet briefly described this program-could this be given more detail. Roger got 100% PTSD and TDIU, P&T, the decision stated "Your disabilities are felt to be preventing you from being able to get a job which could be classified as substantially gainful employment." How does this program work? I am wondering if we could get assistance in regard to a handicap toilet as he also has IBS, and also a window installed in our dining room,-such installation would provide him with clear vision to our front entrance door giving him the knowledge that no one is sneaking up on him. Currently that is the feeling he has. This relates to the PTSD. Any info on this will be greatly appreciated. We applied and got his disabled veteran license plate, we live in Michigan. I still can't believe it only took VA a few months after the C&P exam to give their decision; we have been struggling financially and believe me when I say the deposit made to the bank account the first of the month really allows us to breathe easier.(The retro payment took care of a lot of outstanding items, now maybe we can relax).   5. Greetings to all on this site. After a year of appealing I finally got my husband a l00% rating for PTSD and TDIU. It has been a long, long road but with the help of the people here and conferences with Flip, we finally succeeded. I would like to take this opportunity to thank everyone for giving me the strength to keep going on this. You are great people.   6. I am wondering if I can get my medications through VA-my husband currently gets 30% compensation for IBS. We pay for our own BC/BS but don't have prescription coverage-I was recently placed on Plaxil which costs $145.00 for 30 pills and am scheduled for a heart catheterization in 2 weeks--I have a leaky Mitral valve--cardiologist said I would have to take Coumadin also. My husband also has a claim in for PTSD and could possibly get l00%--would that help the situation? Thanks -Sandra, wife of Roger
  7. Can anyone tell me what "My HealtheVet" is? I went to the vbn@ezboard.com and the guys were discussing how to get a copy of their c&p exam for ptsd and mentioned it. I went to Detroit for my c&p exam for ptsd in December 05. Also, how can I get a copy of my C-file-I mean, the recent filings in the file--I got a copy of the complete file last year but don't have any copies since then? If anyone on this board lives in Michigan and goes to either Saginaw or Detroit, I would like to communicate with them via email or landline also. Thanks for any info you can give me.   8. I have a ptsd exam scheduled next week. I printed out the C&P Exam for ptsd; it gave me an outline of subjects to be discussed. My question is to anyone that has already had the ptsd exam--can anyone give me specific questions they were asked? I am quite up-tight about this exam and would like to have some idea what members here have experienced. Thanks--farmall.
