  1. Berta, I will do my best to get someone to post the actual documents. It may take time. I don't know a NOD from a reconsideration and we rarely get copies of anything filed. Even though we have tried.

    I am sorry, sure don't want to take up time unecssarily. You astound me with your knowledge.

    I do recall he was rated 100 percent on the malpractice for loss of use of hands. He was already 100 s/c percent prior to the surgeries. He was not catastrophically injured prior.

    Update: PVA sent me some of the paperwork, need to get two more.

    When I get it all, am going to get someone to post it here. Also making files and sending those out to every place I can think of, news, politicians, etc.

    We did file an IG complaint on the C&P examiner who lied and also diagnosed supratentorial overlay.

    That totally had an adverse affect on proper treatment and was a patient safety issue. He missed his window of opportunity for rehab due to the VAMC's both lying.

    Spinal cord injuries are clearly seen on the MRI. Both VAMC's must have been blind by choice.

    VARO first said he would get nothing, as yes he already was 100 percent.

    But the R rating made it much more per month.

    PVA still is his rep. They say they check every 90 days to see if the claim is decided. PVA said that the only claims that were treated like Jimmy's, taking 11 years, were the claims where the VA was at fault, medical malpractice. PVA says they do not expect a favorable outcome on this VARO appeal and it will have to go to BVA before he gets his money. It has already been in reconsideration for well over a year at VARO. VARO does not like people speaking out about malpractice and punishes the veterans. Grrrrrrrr.

    Can BVA help at this point? I don't know.

    The person who told me to contact the hotline was an attorney for the government. I had called to ask him where they stored all the lies that VAMC wrote. He was really nice and very sad about what Jimmy has been through.

    VARO basically said it would not pay back pay due to not enough evidence. There is more than ample evidence. Except for the lies from the VAMC, who tried to cover up what they did.

    Next week, I am going to make hard copies of the important issues and starting mailing out letters.

    I was told by a high ranking official to call the IG hotline or write a complaint. I just am at a loss as how to word the complaint.

    Veterans who report malpractice and other illegal activities should be protected. VA hospitals should be held criminally responsible for illegal activites and doing this the in my eyes are tantamount to reckless endangerment causing serious injury or death in some cases.

    I think you have my email address. There is more that I am not sure I should put out on this board until the dust settles but it sure sounds as though you and I are sadly on the same page................and on the same list.

  4. Hi Berta!!! I subscribed to this but didn't know it was replied to.

    Yes, that is Jimmy's claim!!! The tort got tossed out as the Judge ruled contract doctors were not covered. However, in the discovery, I got the

    addicted doctors file, so at least got some proof.

    We have never had a chance to get a copy of the c file as they say it will slow things down more.

    The BVA actually send Jimmy's records for an IME. He called it like it was..........negligence and malpractice.

    We filed the claim right away in 2003.

    This is the worst year ever for my emotions about this case, likely because my husband is so very sick and the look in his eyes is that he has given up the VARO ever treating him fairly.

  5. I think if there was criminal fraud going on at the VA then FBI could investigate. I think the Attorney General would have to let the FBI loose on the VA. Somehow I don't think that will happen. The FBI is pretty good at catching bank robbers and framing retarded terror suspects like in Tampa recently.

    Isn't it illegal to shred medical evidence, cover up wrong or criminal wrongdoing, LIE, etc?

    Hey, if anybody would investigate objectively, there would be a lot of handcuffs needed :biggrin:

  6. Thank all of you for the help. VARO is the one holding his back pay hostage for the 1151. In his fragile condition he is unable to travel to Nashville and has never been given the opportunity to participate in his hearings, even though he could have used a local video system.

    The two VA hospitals Mountain Home VAMC and Augusta VAMC are responsible for the lies and mistreatment, and then covering up what they did.

    Do you think sending in the story to the news would help?

    These monsters maimed my husband. If he had the back pay, it would not fix his spinal cord, but would at least help pay for all the additional help we need. We have a caregiver in two afternoons a week. We pay a small fortune to hire people to help us. We REFUSED their offer of his going into the VA nursing home. VARO owes him over 8 years back pay.

    Reporting malpractice should be protected speech??

    My husband has been retailiated against by the Nashville VARO since he reported the illegal activity and malpractice at the VA hospital. His claim is 11 years old. The BVA found it to be malpractice. He has a R rating.

    The VARO is refusing to pay his retro, he only had a few months backpay.

    My source says the Nashville VARO has a policy in place to do this to patient who are victims of medical malpractice. He is likely not going to live long enough to go through another BVA appeal.

    Employees of the hospitals are protected. Who protects the veterans? We proved our case. Shameful delays, addicted doctor, even the Augusta Spinal Cord hospital tried to cover all this up.

    Any ideas appreciated!

  8. Long time, no post. Sorry and hello to all :)

    Jimmy won his medical malpractice case at the BVA level. We thought it was finally over. Nope.

    Nashville VARO seems to have a habit of punishing those who speak out about malpractice and only gave him

    ONE year retro. So, he is still owed pay from 2003 to 2011. The VA maimed his cervical spinal cord in 2003;

    Since then, thankfully he has fought successfully Agent Orange Cancer and a host of other serious illnesses, and is the same awesome hubby. We have much to be thankful for.

    I wish the FBI would arrest the people who deliberately cover up wrongdoing and haul them off in handcuffs.

    That is about as likely as VARO not being adversarial to veterans.

  9. TBird, Please do not give up! Contact Medicare and tell Medicare this bill should have been sent to VA. Medicare will request the money back from the provider. Call the provider and let them know Medicare is going to ask for the money back. The VA won't pay a deductible. The VA pays less than Medicare plus your part, so of course the provider prefers that. Call your patient rep (aka known as the Director's

    cushion)and put in a formal complaint. Let him/her know you have reported to Medicare the bill should be sent to the VA. I deal with this a lot and it takes a LOT of my time. Medicare is easier for the provider to file, but stand strong and make the VA pay what the VA owes!

    I read alot of my information from some posts I receive daily ie. www.vawatchdog.org , our troops newsletter, veterans today network, military network, flwacvet, veterans issues per col dan, on yahoo too, also check hadit a few times a day and some others too. BYT I started to write this message at 3am and saw where I didn't send it, so now I am. Have not found particular cases at certain facilities actual confirmed numbers. Will search. The va will not let vets know how many, where, nor the public know the extent of this contamination process. Cover-up I think has remained their motto.

    Hope you can keep up with all the news and rule information. Remember wash your hands alot...the flu is out there and spreading...buy hand sanitizers too, if you can find any. Tell others to wash their hands after touching anything...prevention is the best measure. Have a better day today than yesterday. ;)

    Thank you for all the sources! One of the sources did send me a link to the VA page under the Public and Intergovermental Affairs tab that gives a list of all hospitals, number exposed, number tested, etc.

    About being careful with the flu, thank you and yes I am. Showing my age here :huh: , back in 1976, I had the swine flu vaccine. Got home, and turned on the news. The vaccine had been stopped!

    Va says now 28 vets infected after being tested related to this outrageous contamination incident...

    3 NOW POSITIVE for HIV (one at each center)

    6 Positive for Hepatitis B

    19 Positive for Hepatitis

    I agree about passing this information along to others. What about the veterans who passed away prior to this being public? Their spouses, partners, etc. could be infected and have no idea of the need for testing.

    Personally, I am very vigilant in trying to keep my husband out of harms way, however, when he is taken into an off limits area (scope, surgery, biopsy, etc.) there is no way to monitor what is going on nor do I have the knowledge to know what should.

    My husband nearly died from an infection during the questionable time frame. He had been scoped and biopsied at the local VA. A private doctor performed the surgery and the doctor said in 30 years he had never seen anything like it.

    Yes, I am jaded about VAMC care. My husbands spine was mangled and maimed by an impaired physician and a VA staff who didn't properly protect him.

I recently submitted a formal request to the VA Bay Pines,Fla. for a formal meeting to allow the VA Hosp. to apologize for the sub-standard care I've received and allow me to voice my concerns, pertaining to my care and delay's as noted in my Med.Records. Per, VA directives they must allow this meeting to take place, to address any adverse events. Is this the case?? thanks, williamn

    4 years ago, I requested a meeting at the VAMC to discuss my husband's

    treatment plan and concerns regarding his substandard treatment. When we arrived for the meeting, we were shocked to see nearly every department head at a conference table waiting to reply to our concerns. You are welcome to email me privately, I am not good at posting to this board. As for a formal apology...........we are still waiting. I would like to know the source of your information as to the VA directives discussing adverse events, as it seems the time has come to request another meeting.

  14. We woud like to thank all the people of this board for your help and encouragement! If not for HADIT, this success story would not have happened!

    The VA, PVA, ILS, everyone told us that there would be no home adaptions allowed through the ILS program. The Hadit members who were so willing to share their stories gave us ground to stand on and

    the will to keep trying! Thank all of you so much!

    Our home is now much more wheelchair friendly! A step in shower is in place! The wheelchair can enter the house and access about 1/2 of our home! YEAH!

    While we did not get everything we needed (for example a roll in shower for the wheelchair)........we are very very thankful for the adaptions that did happen!

    As most of you know, my husband is using a power chair and getting him in and out of the old shower that was in a cast iron tub was not only difficult it was very unsafe.

    We have not been granted the home adaption grant, which would have of course done a lot more, however

    you all have kept us keeping on when it seemed like a losing battle!
