  1. Absolutely, but look for being re-evaluated frequently. They put you in the system then check social security, call you in cut you and make you fight to get it back.

    I worked 21 years was cut from100% to 40% one time. was employed Fed all the time kept telling the reviewers I was not drawing disability for unemployability but for disability. Good luck.

    If your not using computer to order your MEDS you should try that been using it 2 yrs now and more problems with Austin traffic or waiting at pharmacy for prescription.

    Aso down here in Austin, DAV runs a shuttle, but things are better here, you might check on that, if you haven't already ruled it out and can't drive.

    Sorry about PCP have similar feelings about mine now, fortunately specialist is very good.

  3. Sorry about your loss, also your fight but that's standard. Personally I'm 100% since 68 45 days out of AF. on disease can only get in Africa or East Asia. Told them never been in Africa, Wasn't in Nam on vacation. Got SC in 72. Keep fighting get a for profit Dr. see outside shrink/neuroligist whatever it takes submit their produced write ups. Go to VA manual first get wording for rating officer, necessary in symptoms, conditions, prognosis.

    I worked 21 yrs. at 100%, don't let em down grade u cause your working. But you could find, work for cash when u need it til u get the 100%.

  4. At a 100% you can count on a future C&P I think. I am 120% filed 68 finally awarded 71, had C&p abot every 4 yrs. I'm guessing now but think reason is VA linked to SSA and I worked after VA rehab program til 1997.

    So I'd get your C&P file, br ready to show how your condition is worse, or present current evidence it is unchanged since last C&P.

    The biggest problem u got is ur correspondence with the NOD went to Waco.

    Try the E-Mail (sirus) site and ask what happened. Last time I ask on mine 2/22/08 and Nat'l Ofc said Reg'l office should reply in 5 days or about. still waiting kept copy of e-mails. Hope the DAV's not representing you there. Think there working full time for the VA.

    But definitely pursue your valid claim, you don't know what changes congress will make in the future and what affect it might have, comp, a&a, widow benefits, etc;.

    The higher rate $ amount tables can be found at va.gov

    The "S" rating hasn't been used in years it is housebound, and it's a little lower, than aid & attendance.

    Look at 38 USC 1114(a) "Start there (b), ©, --there are 8 pages of law on the different letter classifications;

    (l)A&A (k)thru (n) and intermediate rate provisions.Then (o), (p) maximum rates. Then R1,R2 R2 needs professional daily care, contrasted to R1 need for regular daily care. R2 is in lieu of long term home/hospital.

    M onward are amputations and injury to different body parts, legs, etc then eyesight & hearinglosses were added.

  7. I was given 10% sc on my right knee in 1973 upon discharge from the Navy. I filed for an upgrade Feb. 08. Took til Jan. 09 to get a C & P. did that and xrays too. I keep geting the runaround about not being able to get my medical records from my surgery at VA hospital in 1974. What I really want to know is does anybody have a guess what percentage I might wind up with? My knee is totally shot with arthritis and instability. I need a cane just to get around. Should I apply for my left knee also as it is also worn out due to having weight shifted to it all these years. Any help would be appreciated. Thanks.

    If you can get a medical statement that the cause is due to aggrevation from the other knee then it's service connected. If not file a claim anyway and get it non-service connected for beefits down the road. Hope your not dealing with Waco,

    Look up rquirements for %'s , might as well file for upgrade on other knee.

  9. I'm applying for VocRehab today. I will let you know if I get it. 1-800-told me I'm entitle to training.

    I took the Voc.Rehab program starting in 71, ending 74 with a B/a in accountanting to go to work for fed. Figured I'd use my 10 pts. preference and 6 yrs. svc. It worked. While on Voc. Rehab.as 100% drew Social security Disability you should look into that too. You can get rehab you need it to get a career so get as long a training as you can get. A specialty program after BA for example. Don't have a high school diploma for all go get a GED then apply they'll give an apptitude test but go for the long haul, use your years of service What U.S. Gov't facilities are around where you live or within commuting distance or train for what they hire.

    Pay starts low but increases on regular scale, plus cost of living yearly, 12 holidays, 2-3-4 days vacation, 4hrs. sick pay per pay period. good luck

    I ritered on disability from the fed. in97. the ss sent me a ltr. annualy telling me I didn"t qualify for ss. I knew that I didn't pay any last 21 yrs. was on SSDI 6 before that 6 in svc. before that so no 40 qtrs. hit 62 now ltr says I can retire if I want. cause I qualify don't need 40 qtrs I'm on disability. Suggest u research Social Security Title of Law because they are just like VA they even swap records annually.

  11. skunk, I like u am fairly new to this great site, and also like u in a fight with them I'm not going to give up on. Now what I think on ur sit. U also have learned on research here-have u looked at their manual to see what the rating officers are~~required to do~~at that manual u will also find references to law, and reg's. U are going to need the dates of each claim u filed to compare the law to see what it was & what their reqt's. were. Their is an address where u can e-mail and get ur military records but I'm sure u know of that. Also has anyone ever considered PTSD seems I read 15 years to surface somewhere on that one. Ask rep if old records are in current claim folder.

  12. Greetings all,

    I am reposting the following here in the hope that I can gain some insight in what to do next.

    I had a service connected claim of obstructive sleep apnea with CPAP which was denied because the VA found no evidence in my SMR.

    I am a tad miffed because in my service medical record shows my diagnoses of Obstructive Sleep Apnea and to start CPAP therapy in September 2007, but this wasn't even referred to.

    I had my CP exam in October 2008 and showed the doctor my SMR with the diagnoses and sleep study results listed on it, but not the actual sleep study. The doctor stated that I had subjectively reported I had sleep apnea but no evidence was given that I had it.

    Now my question is should submit a letter of new evidence that includes copies of the overlooked medical records, my actual sleep study refered to in those records, my reciept from the CPAP machine I was issued, my last sleep study on Nov 2008 showing I still have sleep apnea and the print out showing my treament compliance or should I send in a Notice of Disagreement? The whole claim has not been rated yet as they have deferred one decision.

    As a side note, thedeferred rating of one of my conditions left me right at 40%. Any guidance on this?
