  1. Hey every one I need advice as to what I should do? I was med boarded in July 2009 by the Army for PTSD and injuries, I was placed on TDRL and was given a 60% rating by the Army and also CRSC. * crsc combat related compensation. Retired as a SSG. then a few months later The VA rated me at 100% in 2011 the Army moved me from TDRL to Permanent Duty Retired List rated at 80 %. In 2015 of February the VA did a C&P evaluation on me for PTSD, TBI & MIGRAINES i did not request this evaluation they do this for PTSD, TBI & Migraines because they say it will get better however the results said that nothing has changed and that I will remain at 100% service connected for those disabilities and my knees, back and shoulder. Well in Sept 2016 they wanted to do another C&P and the results were not good, I received a letter 2 days ago stating that they lowered my Migraines from 50 to 30% and my TBI from 40 to 0% they left my PTSD at 70 % so the letter stated that I am no longer 100% but at 90%. the lowering % of my Migraines and TBI will cause me to loose 1300.00 . Now I have not worked since 2009 with the Army and I have kept all of my appointments and continue too as well as I take my medication for Migraines that I have which are 5 a month and cause me to bed rested. I cant believe that I have been rated 100 % since 2009 and now its down to 90%. I believe I should have never waived my Army retirement for the VA which is like gambling. Any advice would be very appreciated I am worrying that in 2 months from now that my family will take that 1300.00 hit. Also your prayers would be appreciated.

    The Facts

    Filed for VA benefits Feb 2008 while in a warrior transition unit and receiving PTSD treatment , physical therapy and med board process.

    was placed on TDRL by Army and rated 60% July 2009

    VA  awarded 100% for combined rating an injuries and ptsd, Tbi and Migraines.

    SSDI was awarded in Sept 2009.

    2011 The Army placed me on Permanent retired list rated at 75 % combined rating.

    2015 The VA re-evaluated me on PTSD, TBI and MIgraines , they sent me a letter stating that nothing has changed and that i will remain at 100%

    2016 The Va re- examined C&P  for PTSD , TBI and Migraines, The examiner for Migraines wrote that I only have one Migraine a month that lasts for a few days. This is not true I average 5 a month .

    The examiner for PTSD and TBI stated that the last examin given by the last examiner did not test me correctly and that the test was inaccurate and invalid. This recent examiner also stated that I was malingering.

    I have been treated for ptsd, migraines since 2007 by several drs from Walter Reed to the drs at the Army Clinic in Alska and VA drs. in Texas. I moved to florida over the last summer and this is where the VA did the C&P examination.

  2. OK so what you need to do is get a copy of his DD214 scan it or copy it and put it up on here BUT Black OUT his NAME and Social Security / Service member number.  

    You should put it up on here and 2 other sites that will help you, I will place the links on the bottom of this page.

    I'm curious did he serve in the middle east? Gulf War?

    does he have a current diagnoses from a private Dr.?

    Is he taking medications for this diagnoses?

    Set an appointment up with his primary doctor at the VA clinic, trust me on this, always take the nurses name and dr.s name and time with date of whom you have talked too. They have a duty to assist. If you run into a wall with them go to the patient advocate and also take that persons name down, time spoken to that person. Mean while submit a claim with a VSO.

    Get a copy of his C-File Mean While.

    If you have any medical records of when he was in the Airforce go though them with a comb look for anything that is missing pertaining to his illness.

    File SSDI with social security mean while.

  3. HI All, & Happy Thanks Giving and Merry Christmas!

    Retired 11 Bravo paratrooper in need of advice.

    I recently had a C&P exam review of my TBI , Migraines & PTSD last Tuesday 11-22-2016. I was medically retired by the Army in 2009 The Army rated me at the physical evaluation board at 70% for PTSD and other injuries were rated at 20% but my question here is the C&P I was just given. They had me do a 338 questionnaire by sitting at a computer then I had to drive to a different location  that was not stated on their letter of the appointment. When I arrived the Dr. proceeded to ask me questions pertaining to my PTSD symptoms since my last C&P in 2015, she asked if I feel that the symptoms got worse or the same and I answered I felt as if they were the same.  Symptoms are ; suicidal thoughts, anger issues, flash backs, nightmares, nauseous, anxiety, startled, uneasy, no social life and I have not been employed since being medically retired from the Army in 2009. I was Mede vac'd   from Iraq to Landstuhl Regional Medical Center in Germany hospital then 30 days after I was flown to Walter Reed for 2 1/2 months treated for PTSD and other injuries. Then I was flown to a Medical Warrior transition unit in Alaska for more PTSD treatment which consisted of 30 days at a VA medical hospital in Rose burg , OR all while on active duty, then back to my unit in Alaska for 2 operations and occupational therapy then the Medical board process. So I have been unemployed since 2009, and receive social security disability. I recently moved to Florida from Texas because my situation has got to the point where my wife needs help from my mom to watch over me when I experience very bad moments, I guess it was too  much for her to do all while working and raising a son. I have been taking my prescribed medicine for PTSD and have kept all my appointments. I pulled my health records from my VA Health and in the C&P record the DR. a  neuropsychologists  stated that she gave me a MENT(   Morel Emotional Numbing Test), for my PTSD and that the results suggested that I am Malingering ! she said that I surpassed a cut off score and that according to the manual for the test it indicates the the testee is Malingering. She also stated that the last C&P review was inaccurate because the neuropsychologists did no testing on me.  I am 100% SC  PTSD & major Depressive disorder 70% Migraine headaches 50% TBI 40% strain cervical spine 20% Strain Lumber spine 10% Tendinitis, left shoulder 10% Degenerative changes Left knee and patellofemoral syndrome 10% Also Degenerative changes Right knee and patellofemoral syndrome 10% , Tinnitus 10%, Irritable bowel syndrome 10% , Sprain left ankle 0% Sprain Right ankle 0%, Hearing loss right ear 0% and Erectile dysfunction 0%. These were the rating since July 27, 2007 a VFW Service Officer helped me with the claims while in recovering from my injuries while I was still on active duty. Since then I have had a C&P review in Feb of 2015 and then the most recently a week ago. I have never submitted any other claims since applying for benefits and waiving my Army pension in 2009 why would I malinger?   I guess they review the TBI , PSTD & Migraines every year now. The C&P is in the gathering of information stage. What should I do while waiting for their decision? Should I be talking to a Service Officer ? I just moved to Spring hill Fl from Fort Worth TX and I do not know of a reputable Service Officer. Do I need an Attorney? I have medical ins through tri care standard and medicare should I start using a private Dr for PTSD I do use one for all my physical injuries because I do not trust the VA to inject my knees and spine . Any help from you guys will be a God sent to my family and I .  Thank you for your time and I hope this topic helps others in the future.

    I'm going to cut to the chase and tell you what you need to do in order to help your self achieve your goal. The VA does not get paid to sympathize nor give us the benefit of the doubt on any level. You must acquire as much proof as you can about any medical issue you have. Search for any medical records during the time you served in the marines. Also find your enlistment records when you took your physical exam which will help you establish your base line. Good luck !

    What you have probably received is the VCAA letter telling you what you need to win your claim. You need evidence. Without evidence don't expect much. jmo

  5. What I did was purchase Term Life INS. It is less expensive and for the amount that I give SBP I covered both my wife and myself and still had money left over. Yes you can cancel call SBP to cancel they will send you a form to fill out, Good luck!

    I was forced into SBP plan almost 5 years ago when I was placed on the TDRL list I am being evaluated at the end of my TDRL DFAS sent me a bill for SBP plan. Because I am going to be retired formally from the Army does this mean I can submit my request for termination to DFAS >?

    I was wondering what ever happened to your case? what did the army settle on, and I feel your pain I have been medically retired since 2009 and have not been seen by any Army medical re-evaluation doctor since being put on TDRL last 2009. also have they reduced your CRSC? I just applied and got an award letter this feb2011

    I am almost at the end of my 5 years being on TDRL and they are now getting around to doing my final medical evaluations. My concerns are that I have stabilized due to medications that I have received from the VA and without them my conditions would be more severe. My reevaluations will show of course this progress. I was asked a year ago when TDRL attempted a botched medical attempt that a VA doctor called and said that he wanted me to stop my medications for 48 hours so they could evaluate me? I replied I am on medications for TBI , Migraines, balance disorder and seizures, PTSD and I am also a single parent this would not be the preferred method. I am sure we all know that medication only last for so long and it also causes other organ damage in the long run. Does the TDRL results affect the VA pension & CRSC anyone have major issues upon reevaluation? Should I look for an attorney just in case cause I know the Army screws everything up.

  9. Good, luck land let me know how it went. No it is not tax free but your Va is. Crsc is a supplement that your Dpt. gave to the Va and the VA paid the difference which is in total what you recieve from the VA. so basically you will get back what the Army or Navy gave to the VA but it wont be tax free. Only what the VA gives you will be tax free. If you are getting 100% put in a claim for Social security and if you have that already you need to notify them that your 100% dissabled by the VA so that they can up your amount. Alsoif you own a home usually your state waives your property taxes. Let me know what happened I am going to fill my CRSC application tonight. I got my information from an ambassador to the CRSC program.

  10. This was the first time I ever went to a C&P exam, I have five problems submitted for disability from the gulf war. 1990-1991.I received my letter and went to my examination at the VA. The letter stated only (medical exam)with the date & time.

    I arrived at the VA and proceeded up to the C&P examination area. I arrived and the DR conducting the exam offered me lunch and to sit down. After asking me several questions he examined me.He went through my medical conditions and asked me about them.

    When he was done I was finished and left the exam area.

    Is this the normal way for this type of examination?I was expecting to be drilled about all my conditions but was not. Is this a good sign or a bad sign about my painful conditions?

    Any responses would be appreciate.

    No its not normal practice. Make a note of what occured and the name of the Doctor that seen you. Did he examine you? your body? personally I think that his recomendations will be in your favor, because he would not leave himself to beasked during an appeal why did he not examine you? If you are not satisfied with you outcome you can appeal it .Good luck
