I could be wrong, but...I thought that once you had an award for a condition, did not file NOD or appeal (did you?) within the time limits, it was treated as an increase from time filed for increase, so that date was the "start date". The lawyers usually get paid a portion of the retro, so he will work VERY hard to get it back dated, so who knows? Now, if you get awards for things denied the first time...that seems to get a little more "gray". Someone else with a lot more knowledge on this (probably most of the "old timers" here that have been fighting the good fight a lot longer) will surely chime in and straighten me out. Congratulations!
I cant remember 100% but I know I try very hard to file NOD or appeals when ever needed. I know I had one appeal with this lawyer at least 2 years ago. I have paid the lawyer for the small retro I got and I plan on keeping him and hope to pay him 30k next time. I know he will do a better job then me. I almost didnt type that I thought about doing it myself.

If you try to get an EED back to 2008 I would use the attorney, that much retro the VA will fight you for it anyway they can and if you don't know VA Law very well its best left up to the attorney.
I think it would be a big mistake to not to deal with the VA for your other conditions unless you have a good private insurance but that's your choice.
As for as the time frame on retro is any ones guess.

I filed in 2008 and was low balled for ptsd and denied other conditions. After a couple years I hired a lawyer to wave his magical wand over my claim. I just got my brown envelope a couple day ago(3 weeks after emailing Allison) and was rated 100% permanent for ptsd. The letter also stated that my other claims would be looked at and most likely need c&p's I assume.
2 concerns I have.
My retro date is from my last C&P exam which was only a few months ago. My lawyer wants to go for a earlier retro date which makes sense to me. Anyone know a time frame to resolve a issue like this? I almost want to pursue this action on my own but feel I'd be kicking my lawyer in the balls.
I really dont want to bother with the VA about the other claims. The VA stresses me out/reminds me of the army and I would much rather cancel the appointments (thoracic spine pain, funky healed broken foot, chronic cough/sinusitis) and not deal with the VA. Is this a foolish move?
I would also like to thank these forums. I'm mainly a lurker but I have lurked a lot when feeling very hopeless about my claim. This section would give me hope to not give up.

30 years of taking differant meds,they did nothing for me accept give me bad side effects.The one anti-Depressant I never been put on is WellbutrinSR,and it's been around a long time.This med started doing wonders for me within days.So I have to stick with what works,feeling grateful.
Bad side effects scare me a lot but thats great you found something that works. Have you got to try yoga yet?

I called the 1-800 # and got some answers after being disconnected twice! There was a double claim for ptsd and the newer on was closed b/c there is a older one in appeal status. I have a lawyer representing me so I'm not sure what thats all about. My ebenefits account shows no active claims so its not being updated. The 1-800 # told my they had all my additional evidence that has been sent to them so I'll just wait for the brown envelope since my Ebennys is kaput.

My claim was closed last month and I havent heard a word. Ebenefits is not showing me much. Called the 1800 number yesterday and scheduled a call back for today. The VA called and hung up instantly............never surprises me.

I feel like I had a fair exam a week ago. There were a few things I forgot to mention but most of the main symptoms were covered. Guess I'll wait and see.

It took 3 days after my exam to show up on blue button,everybody's case is differant.My examiner did my report the same day,that's probably why it showed up so fast.
When I click the blue button it gives me two options. The first one brings up some info but it has zero importance. The 2nd one''Download or send my Health Summary (VA CCD)'' says its updating. It has said this for weeks now. Im guessing this is the one I need to be looking at.

Thank you.I am definetly committed to sticking with the Lexapro for 4 to 6 weeks.And im going to try Yoga,my vet center has it a few times a week.I heard it can do wonders,for alot of emotional issues.
I have done yoga at a vet center and at a normal studio. It might just be me but I'd rather pay to do yoga at a studio rather then going to a vet center.

Go to my Healthvet blue button.You have to have a premium account to view your records.I had to do an in-person authentication,to get the premium account,I think that is standard.To check the progress of your claim,you can check that on E benefits.Hope this helps.

Just remember they evaluate everything, eye contact, the way you dress, the way you walk, your demeanor, etc.. When I was checked for my back and knee, the examiner tried to trick me, by saying the stairs out the back door were shorter. They watch you from the moment you show-up until even as you leave the exam. Be honest but don't offer any extra info, unless it is important to your claim. If it's for a mental health exam, you may want to bring some notes, so you remember everything. I had to, as I frequently forget things, when I feel I'm under pressure.

Remembering things is a huge problem for me. Example: I'll have a flashback of a forgotten event. The next day I wont remember what the flashback was about nor do I want to remember. I guess I'll have to start writing stuff down. Thanks

Where do you get the c&p results from? From release of information at the VA or online somewhere?

The news of this C&P comes with joy and fear. I have been waiting a LOOOONG time for this appointment but I understand its going to suck, a lot. It already sucks and now I have to drive on a Army base which will bring back memories that have left my mind. Any words of wisdom from anyone who just went through this?

Sorry but I didn't know where to ask this question. I'm going to try out living in the Philippines and need to know what I should send the VA. I have a P.O. box in the states that I'm going to use as my mailing adress(sister checks it). But my physical adress will be in the Philippines. So hopefully if I have an appointment it can be taken care of in Manila.
Cliffs: I'll have a mailing address and a physical address. How do I tell the VA this?

Just a mention of coughing will not get this granted - you will need more evidence of some kind.
Study IMO information.
i understand i need more evidence....thats my problem.
if i were to get a IMO on my conditions that will take some time .i really screwed up by not being active in this but what should i do with my board hearing on oct 19? reschedule or show up and give them a buddy letter or 2.

sinusitis/rhinitis/allergies- not service connected, not incurred/caused by service.
pretty much when any of my conditions are denied the reason is that its not service connected. i have a buddy letter from my platoon medic stating that i went to him for back pain and coughing.

i forgot today is columbus day........i went to the va and it was empty with half the lights off, kinda creepy. i will go there tomorrow to look at the rating decision.
