  1. I have a similar issue. I was denied SSD in June 2012 and at that time was 40% SC through the VA. Put in my appeal. Then in October of 2012 was granted 100% through the VA, sent in my new rating letter to the appeal board which sent it back to the judge for another review. They had me do a review with a Psychologist just of couple months ago. I got a phone call today from my lawyer saying that they are wanting to set up another hearing in front of the SSD judge. That time and date hasn't been said yet though. So i'm hoping for the best on this one. Wish i didn't have to do a hearing, those things make me want to blow up!

  2. Ok, I got a letter from my DAV rep saying they reviewed they the most recent VA decision and i went from 30% PTSD to 100% PTSD. And according to the E Benefits site current progress is:

    Current Progress Description: Your case has been received at BVA, and BVA has mailed your decision to you (and your representative, if any) and will be returning your claims file to the VA Medical Center. Please note that transit times vary, and there may be some lag time between when BVA forwards your claims file to its appropriate location and when that location receives it.

    My question is, ebenefits now has 2 new claims that i filed back in June 2012 for TBI and Carpal Tunnel. Should i continue with these 2 claims or withdraw them?

  3. Got a letter from my DAV rep today. I'll sum it up.

    The DAV has reviewed the most recent VA decision concerning your claim for benefits. A combined evaluation of 100% has be assigned as a result of the following actions.

    1. Evaluation of post traumatic stress disorder, which was 30 percent disabling, is increased to 100 percent effective November 24, 2009.

    2. The issue of entitlement to individual unemployability is moot.

    It says the VA has the right to modify the decision prior to my official notification. So we'll sit back and see. Sounds like good news to me though! It's like a burden has been lifted off me.

  4. I have two NOD's in. Ebenefits says one on 12/08/2010 and one on 12/21/2010. But both say under the progress tab that the appeal is pending at the BVA under the progress office tab. But it also says the case is with my local VA that made the decision. I asked for a DRO De Novo on both. Just curious as to what this means.

  5. New thread. Well i went to my hearing for SSDI yesterday. My lawyer seems to think we did pretty good, guess i'll find out. I was nervous as a pet coon in there the whole time, wore me out completely. At the end of the hearing i was surprised that the vocational expert couldn't find any job that i could do with my limitations. I was sure he'd be the one to be completely agains me.

    To update my thread, i had my hearing that was in February moved back for to tomorrow (May 30). So i will be going to my hearing in the morning. It was put off because the SSA only had records for me up to 2010, so i got the rest of my VA records from 2010 to present send to my lawyer along with a second doctor opinion letter, from the one i'm seeing now, and a mental impairment questionnaire filled out by the same doctor. So i guess we'll see what happens. I'll keep everyone posted.

  7. Your ssa attorney should have already had you have your doctors fill out the RFC forms. These forms when filled out in your favor WILL make or break your case. I believe this may be the reason she wants to postpone your hearing. getting a hearing postponed is really not a good idea if u can avoid it by getting those done before the hearing DO IT. Attorney's beleve it or not DO NOT have any sayso over hearings. You will be denied again.Also google SSA GRID RULES and this should give you a good idea how they measure disability/vocational/age etc. Good Luck and you will win with a good since at how ssa looks at things.

    That's what i meant to say, the letter and RFC forms have been in my attorney's hands for about a month now. I just recently sent the 135 pages of medical notes. I'm going to google the grid rules now. Thanks for the input!

  8. Well, i got another Dr letter and my attorney sent me a couple sheets for a Mental Eval for my Dr to fill out. Plus i have another 135 pages of mental health notes. All to add to my claim. It's on Feb 27, my attorney was saying she might push it back another month to get more info, but that's what she was talking about and that's all i have to add to my claim so we'll see what happens i guess.

  9. I knew my age and VA percent would factor in. I didn't expect a SSD hearing so soon though. My lawyer has helped someone i know that is 26 as well, he had his hearing in August and was granted SSD about 2 months later with full backpay. But he also had TDIU from the VA before his SSD hearing. What are Residual Capacity Forms?

  10. Taking the advice from the people on this site and applying for SSD back in June 2010 for PTSD, got denied and i appealed. I now have a hearing at the end of February. Just wondering if anyone had any advice for me? I have most of my ecidence in, i will be getting a letter from my psychologist and psychiatrist before i go to the hearing, so that is more evidence i will have for my case. I also have a SSD lawyer that will be going along with me as well.

    Right now i'm 40% SC, 0% hearing loss, 10% tinnitus, and 30% PTSD with the VA, but have an appeal in for that. I'm young, at 26 years old, and haven't worked since 07 due to my service connection, dealing with it day to day sucks. My psychologist told me to write down how i think PTSD affects my work, relationships, and daily life and he'd write me a letter, will the letter need a GAF score in it or does SSD use that? All my evidence is coming from my VA file that they have already, i just have a bit more to add with these letters. Any advice is appreciated. Thanks!

  11. The counselor said voc rehab is not for, but said if i wanted to i could still use my post 9-11 GI bill for school? I tried school once and had to quit because it was to much stress for me with what's going on day to day. What kind of miracle does he expect me to pull out of my hat to try again, i swear these people try to steer ya every which way but right! Will they send a letter saying voc rehab was denied?
