I hope this is true, i am currently on disablility from social security, and have had to move in with family struggling with living off of 700 dollars, and still pay for medical expenses and medicine, there are some months i have to miss monthly and bi weekly appointments with docs because i can't afford it, and dont feel like being a burden on my family financially because i am enough as it is
  2. I have been impressed with the care and attention at the exams, and so far all of them have been by doctors, to my knowledge. I havent requested copies of the C and P's yet but i will when im finished. I requested a character of discharge review, and they made a decision on oct. 12 but i have not recieved a letter and when i call they say its in its final stages however my C file is here at the C and P exams, no way they are working on it, makes me wonder if they are just waiting to get the C and P's before they tell me i was not approved

Like many people the VA is now moving along with my claim i received a letter stating that i needed to sign over a consent form to release medical records to them from a hospital, because the one they have is over 60 days old( more like a year and 4 months old. My question is this, i do not want them to go through the process of getting these records, i have enough evidence and this is just going to delay the process and i fear this new found luck (beggining of fiscal year) is going to pass by and im going to be waiting till next october. Also they have requested records from themselves, when i have already given them these. So my question is what should i say can i just say that i do not want to delay my claim any longer and am not submitting anymore evidence nor do i want anymore to be gathered. Also they asked for direct deposit info, i personally would like to get a check, is this possible? I just want to go to the rater and get this over with so i have either a positive outcome, or i can hire a lawyer and stop dealing with this all by myself,

So the DAV rep has been no help? i think we should just write our congressman, i hear good and bad things, but what do we have to lose, FYI you can ask the rep on the 1800 number to tell you the last time your file was handled(you must check it out electroinicaly) one time mine hadnt been touched in 4 months the rep sent an electronic message to the RO and that sped things up but then it slowed to a standstill yet again
  7. 1.6 if they didnt change my eed because i switched from schizo to paranoid schizo typo error on my part, im at the point where im just going to call my VSO rep and yell or my congressman, and maybe a little of the 1800 number, its funny cause yesterday i called the 1800 number and they said average was 6-9 months and didnt say a single word about mine being 17 what would u do? im in chicago

Im not sure what the hell it was that they gave us but it has messed me up so im a battle buddy out there to help them in whatever way i can, talk to them, letter to support their story, anything hopefully they are not messed up like me

  10. So i have been told that psychosis is a presumptive, but it is only for pow's, which makes since. I wonder if schizophrenia would be a chronic disease, because it doesnt list any mental diseases when giving examples, this might not be as easy as i thought
  11. went through the hearing and everything, deadline they set, was 11/15/10, came and went and they sent me a letter, asking for evidence, listed what i sent and alot is missing, so i assume they made a favorable decision, but i did not recieve a letter, now trying to get all info into a nice little binder or something and send that thing in, chronilogical and everything, ive been trying last couple days to do this but, havent been able to, crazy mood swings when i start to attempt to do anything, letter just pretty much through me over the edge that they want more info, when everything i gave them is enough, need a freakin lawyer i suppose, but all the good ones say wait till decision before signing with them, my SSA lawyer says he would do it for free, but doesnt think i have a case, i had to tell him about presumtives and everything, so im kinda iffy on it
  12. im 99% sure that you can still get SSDI while recieving other payments, however you cannot get SSI which is income based, if it meets a certain limit, which more than likely it does, check the SS website, call the telephone number, or visit local office
  13. i was not even aware you could win any type of monetary compensation from your service, no matter what happened to you, besides Va benefits,not their fault i went crazy, but the rest is BS, no lawyer, even if i had a lawyer, there is no recourse, then i have to appeal to the board of corrections, until something happens or i give up, i dont think you can take it to court

Basically they said that because I signed a paper admitting guilt and knew i was going to get a OTH discharge, voluntarily, and spoke with a TDS lawyer, that i knew what was going to happen. Then they address the Mentally incompetent issue. "Furthermore, The analyst noted the Applicant's issue that he was mentally incompetent and determined that the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct, which led to the separation action under review" So for my Beliefs that i was brainwashed and given LSD and put through all these mental tests, and thought i was special forces and that the CIA was monitoring me, and my drill sergeants, and they wanted me to go back to basic training and take the LSD again and be brainwashed, and brainwash a wife, and we would be together premanently because of the brainwash.....what relief or assistance could i have gotten if i believe this was true? im sorry "obtained" I took all the action i thought was nessasary went to the IG, told my commander, i was sent to the mental health ward, where i shut my mouth and kept on believing, then i went awol to follow these delusions (i have Paranoid Schizophrenia by the way) Returned to fort know where i went to basic 4 years earlier to try and get back into a BCT cycle just to make it to the last day to be brainwashed ( i thought they did it to everyone) was scared for my life that they were going to have guns and possible shoot me because they didnt want me to see. Also tried to get my wife( which worked better than most would think, but not married to top it off the girl was married, and i had known her and her husband for 5 years you bet i feel like shvt now but i was out of my mind) So what kinda relief was i to get if the Army discharged me from the hospital and sent me on with my training, even though i had a no weapons profile(dont know how to get a copy of that) for a month, and still my commander knew and sent my downrange, i showed my DS and he handed me a weapon....I didnt care, i just wanted to be brainwashed again, i wasnt going to shoot anyone, i thought i was the only one that was in on it, besides the DS's.... So i was somehow suppose to magically figure out that i needed help and that nothing i was believing and remembering was true, Give me a break. Hell i was still believing this when i signed the admission to AWOL, yeah i went AWOL, i mean how can you not admit it. And i thought that once i was discharged that special forces was going to pick me up and take me away, for some more training. In fact when i arrived to the AWOL processing place at fort knox i thought i was in a training mission and treated the cadre and intake personnel officers as opfor, wouldnt give up any info but name rank and social, they put me in LOS the whole time i was there. And i had to sit there and extra week because i wouldnt sign any of the documents because i believed i was being tested and give up nothing but name rank and social... So i signed the document, but i mean i was incompetent at the time, so it shouldnt even be legal, and the day i left fort knox to go home, the very next day i was at the VA Psych ward because i thought the government was tapping my phone, and wouldnt let me access special forces sites, and i told my brother i might kill myself if they kept messing with me, he called the cops, and well obviously i was in the hospital, The doc said she would write in my report that i shouldnt be held accountable, but she never did( and i cant get ahold of her, no voicemail, her office is on the locked unit, ive called at least 20 times, left messages with the nurse station, the only way i can think to get her to write that for me is to admit myself there again) but i have no VA care because i havent met the 2 years..... So without this upgrade, if the VA denies me SC due to OTH, all i can do is appeal, i was hoping with a new dd214 i wouldnt have to prove i was insane, which is a big time saver because its hard to prove, and people are retarded like the discharge review board, that says u should have gotten help...hello i didnt know i needed it F retarded people.... Anyways sorry for the rant...just pissed Anyone happen to no anyone that appears in front of Review cases in Dc for free or cheap? preferably someone of higher quality than a VSO, but ill use them if i have to Told my doc this today that i got denied, hes like what were you suppose to do realize you werent crazy, and the best part is the vote was 0-5 against me i didnt even get one vote Also another question what are the legal aspects of me being incompetent that they must follow, because they didnt, as i said i was on watch the hole time i was being out processed because i was nuts, never said i was going to hurt anyone or myself, they could just tell something wasnt right with me and would not let me be alone, my lawyer knew and said to take the OTH and command knew because my mom told them, but still the letter they submitted for my discharge( which is attached ) says not signs of mental anything
  15. dial the 1800 number, hit 1 then 1 then 0 gets you to a live operator, if they arent too busy....They always seem to give me pretty accurate info, haad one guy on the phone even speed up my claim because they hadnt done anything in 2 months...they just told me the other day they were get records from st louis archives, and waiting on them, i have them, but do not feel like making a copy of 100 plus pages and paying for them

[ not sure what 60 rates at, but its gotta be documented , they just arent going to give you a higher score because you have one 60, im talking about multiple 60's, and 60 isnt that bad i dont think, 40 is suicidal and homicidal all that jazz, ive had a 10 a 20 a 45 and a 60 i think from the VA but i doubt that the rater will care, but it will help me on appeal, from what ive read gafs are not slam dunks and can easily be ignored like imos
  18. thanks for yalls recommendations but i have had stopped up ears because of earwax before, not sure about the eustation tube thing, but it seems more nuerological to me, theres no fullness nothing, just in an istance, it will totally go out, its really wierd, its not like it is muffled or anything, its just not there and it comes back minutes later, its happens to both ears at different times, nothing trigers them, that i can tell
  19. Every now and then couple times a month, i will lose my hearing in one of my ears, couple minutes....anyone know what this is, maybe its from medicine im on risperidone, any kinda rating for this, seeing the auditory doc on thurs

Basically i have two discharges in question here, upon graduating AIT i recieved an uncharacterized dd214, because i was coming off and going to a reserve unit...I got an OTH after deciding to go active duty, after AIT, I was insane at the time i went awol, but didnt bring anything up because i wanted to fight it and stay, in, no court martial...... I sent in the EZ form, no response, went to Jesse Brown VAMC in chicago, was told that my OTH discharge disqualified me from healthcare benefits....My disability that occurred during service is Paranoid Schizophrenia, but under the OTH discharge, and within a year of the Uncharacterized discharge, my question, how the hell can i go see the VA about this, would love to not have to pay for docs, meds etc......but most importantly, would like to have the option to stay at a VA mental health ward, when needed, as my insurance only covers 3 times a year...have a claim pending so i do not have service connection yet, even though it occurred during service This is the response i recieved when i asked a question about my healthcare benefits at the VA site Dear Mr. , Eligibility for most VA benefits is based upondischarge from active military service under other than dishonorableconditions. Active service means full-time service as a member of theArmy, Navy, Air Force, Marine Corps, Coast Guard, or as a commissionedofficer of the Public Health Service, the Environmental ServicesAdministration or the National Oceanic and Atmospheric Administration. Dischargesthat are honorable, general or under honorable conditions qualify aveteran for most VA benefits. Dishonorable and bad conduct dischargesissued by general courts-martial are disqualifying. Discharges that are not given under “honorable” conditions fall in three large categories. Dishonorable Discharges Uncharacterized Discharges Other Than Honorable Discharges Dishonorable Discharges Wheredishonorable conditions exist, VA must deny benefits unless the veteranwas insane when he/she did the things that caused the dishonorabledischarge. Uncharacterized Discharges There are three types of uncharacterized discharges. Entry Level Separation - These discharges are acceptable for most VA benefits. Void Enlistment or Void Induction - These discharges must be reviewed on a case by case basis. Dropped from the Rolls - VA has to review all of these discharges to determine if dishonorable conditions were involved. Other Than Honorable Discharges Ifyou were given a discharge from active military service under Otherthan Honorable (OTH) conditions or your discharge was upgraded from anOTH discharge, a VA Regional Office (VARO) review and decision will bemade before routine health care may be provided. You may make anapplication for VA health care by completing 10-10EZ and the VA MedicalCenter will forward the enrollment form along with a copy of yourdischarge to the VARO for an administrative decision. You will benotified by the VARO regarding their decision. Mailed in form to two VAMC's as there are two close by me, never heard anything back from them, i guess i need to send another certified... Care may be provided for SC or adjunct conditions for OTH character discharges if: Injury or illness was in the line of duty. Initially diagnosed during OTH service Injury or illness was not due to your own misconduct, and Release from active duty was not for misconduct or a reason that would bar receipt of benefits (how to upgrade discharge). Veterans who have multiple periods of service and at least one discharge is OTH: 3 periods of service, 1 honorable 1 uncharacterized, AIT and one OTH Ifyou were discharged from active duty with a discharge of other thandishonorable and at a later date (re)enlist in a branch of the militarywhich ended with a discharge of “Other Than Honorable”, you areeligible for VA health care provided you meet the time in servicerequirement. If you re-enlist without a break in service for twoor more enlistments and you receive an “Other than Honorable”discharge, you must submit a request to the Veterans BenefitsAdministration (VBA) Regional Office for an administrative decision todetermine if you are eligible for VA health care. Regional Officemakes administrative decisions regarding your character of discharge.If you have further questions, you can contact Regional Office at1-800-827-1000. Yeah, thats true, but the date they decided i became disabled is one day after discharge date, when in fact i was disabled many months before, and not working, hell all the medical records they got were before my ED, but they were trying to say well i was in the army so.....its your discharge date, whatever, im not gonna fight it because i dont want for it to be decided that it needs to be reconsidered and then denied
