Berta
I am working on a local claim involving "Aggravation"of a NSC conditionby an SC condition. I sure do not mind repeating this info- there is more on this in my past posts- it is often overlooked as a potential means to service connection. "Consequently, because the Board finds that the preponderance of the evidence supports the conclusion that the veteran’s cardiovascular disease was aggravated by his service-connected PTSD, service connection is warranted under 38 C.F.R. § 3.310(a) and Allen." ORDER Service connection for cardiovascular disability is granted. http://www.va.gov/vetapp98/files2/9813272.txt The veteran had significant private medical opinions to support. “Thus, pursuant to 38 U.S.C.A. § 1110; 38 C.F.R. § 3.310(a), when aggravation of a veteran's nonservice- connected condition is proximately due to or the result of a service-connected disability, such veteran shall be compensated for the degree of disability over and above the degree of disability existing prior to the aggravation” This can be used often as one potential way to gain service connection. And also a good claim to study regarding any SC PTSD as causal to or aggravating to nsc heart disease claim-for secondary heart disease SC award. stillhere
Berta, They did a great job of connecting the dots. To bad it took the VA a few years to see it that way. I in my case am a firm believer that my DB2 has caused all of my secondary conditions! Stillhere
HadIt.com Elder john999 Posted July 17, 2007 HadIt.com Elder Share Posted July 17, 2007 Between the risks of cancer, DMII and secondary heart disease the agent orange is bound to kill me. There is a strong link between certain types of heart disease and DMII. I guess it would be wise to try and get an autopsy to prove exactly what you die from for DIC purpose. Question
Berta
I am working on a local claim involving "Aggravation"of a NSC conditionby an SC condition.
I sure do not mind repeating this info- there is more on this in my past posts- it is often overlooked as a potential means to service connection.
"Consequently, because the Board
finds that the preponderance of the evidence supports the
conclusion that the veteran’s cardiovascular disease was
aggravated by his service-connected PTSD, service connection
is warranted under 38 C.F.R. § 3.310(a) and Allen."
ORDER
Service connection for cardiovascular disability is granted.
http://www.va.gov/vetapp98/files2/9813272.txt
The veteran had significant private medical opinions to support.
“Thus, pursuant to 38 U.S.C.A. § 1110; 38 C.F.R.
§ 3.310(a), when aggravation of a veteran's nonservice-
connected condition is proximately due to or the result of a
service-connected disability, such veteran shall be
compensated for the degree of disability over and above the
degree of disability existing prior to the aggravation”
This can be used often as one potential way to gain service connection.
And also a good claim to study regarding any SC PTSD as causal to or aggravating to nsc heart disease claim-for secondary heart disease SC award.
