What is up with this reply anyway.

2 weeks ago [i think,] I had sent a query to Iris for a status report on my sons claim and was told that they were trying to determine if another C&P exam was needed to help determine the claim.

WE then talked to my son's SO who went upstairs and pulled my son's file and showed these people that there is UNREFUTABLE MEDICAL EVIDENCE in the file that he continues to have phlebotomy treatments monthly for his already service connected blood cancer and doing this exam is frivolous and a waste of time.

They agreed to take the file to a rating specialist to see if it was ready to rate.

Today Iris is still saying the same thing about another C&P exam.

What the h-----. What more could they need, More Blood??

If you file the Iris under Service complaint- it goes to the VBA and then to the RO- so you might get a different and better response.

I did not get a reply on a service complaint I filed last year-

I didnt have to- it was directed to attention of Deputy Sec Gordon Mansfield and I could tell from the Covers screen that with days- the claim started to move again.

ROs do NOT want service complaints to be filed.

In 2005 I filed another Service complaint because the VA said they were waiting to schedule a C & P for my husband at the local VAMC.

I pointed out that I wanted permission from the VA to be present at this C & P since the veteran had been dead for years already-and I could not understand how a C & P could be done on a vet who was interred in the VA cemetery so I would bring some of his cremains with me to the VAMC.

That is when a so called VA expert suddenly wrote an opinion based on 3 or 4 clinical records and Dr. BAsh knocked her IMO down very easily with full medical rationale.

The veteran's medical records remained at the Bath VA for 3 months because of the "C & P" exam-

the VA expert remained In Buffalo- many hours away from Bath VAMC.

Her opinion as she stated only regarding a few records- when the entire stack could have been kept there at Buffalo in the first place.

Knowing this could be a key factor in breaking down the VA expert's opinion- I asked the VA Iris twice if the records were still at Bath.

The second reply was so funny-in Caps (I know the rep who wrote the email reply)

MRS. SIMMONS I TOLD YOU ALREADY THAT YOUR HUSBANDS MEDICAL RECORDS HAVE BEEN AT THE BATH VA FROM OCT TO DEC ( or whatever the dates were)

I was just jubiliant that the VA had confirmed that the "expert" never saw 99.9 % of the clinical records.She did not even know that the VA had caused Rod's death.

Dr. Bash also made this point in his second IMO.

SAVE Iris responses-you never know when they themselves might become probative evidence to show the VA screwed up.

I never advise putting your phone number on the response-ask for hard copy email or snail mail---

Phone call responses have no documentation and they can say anything by phone.

I have printed out all the Iris Replys [ Just in case i should ever need them]

After i got the first reply i fired another reply back to them and i got another reply back this morning saying " Please keep in mind that all the medical evidence in your file will be read and you may not need another C&P exam"

My reply was to THEN READ THE EVIDENCE and quit wasting time.
