Rater Is Moving Fast!

Hi to all,

I am most definitely in a maze and can't get out, for now I am in a daze!

Here is the latest and what I would call my last stand!

The Rating Specialist at The Appeals Management Center has sent my claims file for the second time back to the two ( quack) psychiatrist.

The Rater wants Answers. She wants a " New Opinion".

At this time the boss of the two quacks has the orders and demands.

They must answer each of their accusations and changing of my medical records.

She wants to know how in the world the following are in agreement.

My Doctor Of 30 years - Result of service

First C&P - More Likely than not and more likely a result of service

Military doctor - letter May 10, 2005, to clairfy his shorthand that the librium was for nervous/ anxiety and the cafergot was for my headaches.

Dr. Jones Military Psychiatrist - In consulation for nervesness and headahes and irrability.

Dr. McMahon - Military Board Certifed Psychiatrist - Consultation for same and recommends discharge. Recommends discharge for unsuitability.

Pastor Burch- three letters did not have nervouness or take any meds before service. Has known me for 50 years. Anxiety began in service

THE BVA AND AMC WANT TO KNOW WHEN DID HER ANXIETY BEGIN?

The two Psychiatrist - does not APPEAR she acquired a psychiatric disorder in service.

IF THE TWO PSYCHIATRIST DO NOT WISH TO GIVE A NEW OPINION. I AM TO HAVE ANOTHER C&P WITH ONE DOCTOR.

* I WILL NOT GO IN THAT ROOM BY MYSELF.*

If it comes down to another C&P, what in the heck do I do. I am to find out next week, if I have another C&P.

Do I begin with showing the new doctor the proof of the lies in that dumb stupid C&P by the two psychiatrist?

It has to get better, don't it.

Sending back to the old shrinks who were not the least bit helpful does not sound like a hurry to me. Since you have credible evidence already that should override the quacks if I were you I would just send a statement that I wanted a decision and to rate with the evidence that they have.

Somehow I can't believe that the quacks are going to be helpful.

I know that this is a lot to think about and the only other thing would be to get an outside medical opinion if they come back and try to hurt you.

I know my post was harsh, but that's tha way I see it. You have a huge retro possability that they will try to avoid. Obviously there is something in the 2 phsycs report that leaves an opening for future scrutiny that they want cleared up. Now, with that said, another possibility is that the 2 phsycs director cannot clear up that discrepency and they will be forced to award your claim.

Bottom line: Another favorable medical opinion can never hurt your claim. Make sure they state they have reviewed the entire claims folder and if they can knock down the 2 phsycs opinion that would be icing on the cake.

I did not consider your post harsh at all. I have a pretty thick skin now. Compliments of the VA System.

What the AMC does is anyones guess.

I will work to get the claim rated. Perhaps they can't read English!

Once they get the statement their looking for to deny your claim with, you will need to send in another IMO rebutting their IMO.

In their SOC, the rater will take a statement in regards to your favorable evidence and leave out words or add words until it means nothing. They create whatever reason or bases they need. Facts have little significance to rating specialists, like your service records, if they left you with any.

You may want to give some thought to make sure that the IMO you obtain next, is from a "COURT" certified doctor.

I now have three IMO's the raters refuse to reconize or grant any weight to. The BVA has remanded my claim back through the Appeals Center to process, since ST Peterburgs raters can't provide an honest evaluation of evidence.

No action on BVA remand by the AMC since June/06

The AMC sent me a letter dated October 06, 2006. ( This is what it states).

We asked the VA medical facility who conducted your Ausgust 2005 examination to review and make a new medical opinion in your appeal.

They sent the claims file back to the two quack psychiatrist. per the remand.

7. After the above development has been completed, the veteran's claims file should returned to the board of VA psychiatrists who participated in the April 2005 examination for clarification

of the provided opinion. They should be requested to review the record and reconcile their opinion as to etiology in light of the evidence added since their examination of the veteran, including the

May 2005 statement of Dr. Brian C. Cxxxxxxx and the January 2006 statement of Dr. Michael Pxxxxx.

The Two Psychiatrist stated read letter of Dr. Brian Cxxxxx and letter of Dr. Michael Pxxxx. Does not alter out conclusion.

This should and does satisfy the remand.

October 3, 2007, I receive a letter stating they are seeking more information from my doctor, Dr. Michael Pxxxxx. The AMC received his POWERFUL LETTER - October 15, 2007.

NOW WE ARE STARTING ALL OVER AGAIN.

The AMC has mailed me the same darn letter this year. October 31, 2007. Same letter as before.

We asked the VA medical facility who conducted your Ausgust 2005 examination to review and make a new medical opinion in your appeal.

I SPOKE TO MY NIECE LAST NIGHT AND SHE SAID " THEY CANNOT DO THIS".

THEY ARE FISHING.

She said for me to go ahead and place into the record for them to

RATE MY CLAIM WITH THE EVIDENCE THAT THEY HAVE.

She said she didn't know if it would stop them, but I would have it in the record.

I am using some of Hurryupnwaits information and sending it to them.

1. Letter received November 3, 2007. Review and give New Medical Opinion from the two psychiatrist.

Remand has been satisfied with the October 06, 2006 request for New Medical Opinion.

I shall remind you.

Mariano V Principi Vet. App 305, 312 is applicable to this issue.

This claim has been at the Appeals Management Center 780 days. I do not feel that this is following the BVA remand that states. " This claim must be afforded expeditious treatment", Advancement on the Docket signed by Nancy Robin. March 06, 2006.

All the evidence is with the Appeals Management Center. Decide this claim with the evidence that you have on record, as of this date November 3, 2007.

At least when you get this new rating decision you can start to attack it. These two shrinks who slamed you are poison. You need a completely new C&P exam or an IMO. Get a decision and then move on to an appeal with some new evidence. That will get you out of the AMC. Your claim is the poster child for the VA needing an overhaul. What Allan and Pete are saying I agree with, and their are others whose claims have fallen into a black hole. It is pathetic but new evidence is probably the way to get out. Pound them with evidence when you get this thing back for the AMC. Keeping a claim in La,La Land for years is a damn crime.
