Clothing Allow

Question

Hi,

Does anyone have experience w/ clothing allowance. Is the amount the same for all or does it vary based on SC% and other issues. ANyway to find out the amount by call the VARO?

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Here is the criteria for clothing allowance if anyone needs it:

"The law provides for payment of an annual clothing allowance

for each veteran who, because of a service-connected

disability, wears or uses a prosthetic or orthopedic

appliance (including a wheelchair) which the VA determines

tends to wear out or tear the clothing of the veteran, or

uses medication which a physician has prescribed for a skin

condition which is due to a service-connected disability and

the VA determines causes irreparable damage to the veteran's

outer garments. 38 U.S.C.A. § 1162.

The implementing regulation, 38 C.F.R. § 3.810, provides in

pertinent part that the annual clothing allowance may be

granted when the following criteria are met:

(1) A medical report discloses that the veteran wears or uses

certain prosthetic or orthopedic appliances which tend to

wear or tear clothing (including a wheelchair) because of a

service- connected disability and such disability is the loss

or loss of use of a hand or foot; or

(2) The Chief Medical Director or designee certifies that

because of a service-connected disability a prosthetic or

orthopedic appliance is worn or used which tends to wear or

tear the veteran's clothing, or that because of the use of a

physician-prescribed medication for a skin condition which is

due to the service-connected disability irreparable damage is

done to the veteran's outer garments."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

I applied for the clothing allowance. They sent me a letter and told me to bring in a pair of pants that had been damaged by the leg brace and the ORIGINAL script for the brace. The doc did not give me a script he just call the local brace place set me up an appointment. I went they tested me, fitted me and made the brace.

I sent them a letter and told them they had the letter from the doc which stated a AFO was need in order for me to have locomotion due to loss of use of the leg and foot form a loss of propositional sense as a result of the dejerine-roussy and that since this had happen only seven months ago none of my pants were torn yet from the brace. I NEVER HEARD FROM THEM AGAIN. No letter, no payment this year nothing. Now according to the reg Berta posted as long as the medical evidence provided the need for the item that was proof. Guess not here in Alabam!!! Any ideals??
