Remanded Appeals Council Claim

Question

Called Court Of Appeals Friday and was told remanded claim was appealed. He said Claim was at Balt. Md. with a motion to pay attorney fees. Does this probably mean i will be receiving retro pay.

Sounds like it why not call your SO and see what they say?

Veterans deserve real choice for their health care.

And I think Pete- his SO wouldnt have a clue on any of this-yet-maybe maybe not-

Mark-have you called your CAVC attorney yet to see if he or she knows whats what?

then again- maybe no Holy Moly-

Did you recently hire a lawyer to rep you who might have had to file a Motion to get paid?

or

"was told remanded claim was appealed"

Did a lawyer balk at the fee and the lawyer filed the Motion to appeal it? ????

or is it just a Fee agreement?

Hard to say what has happened here-I sure hope it is a good sign though-

the VA isnt going to pay any attorney if there isnt any retro.

Yes I meant in first reply that he said the earlier decision that was remanded back to the appeals was reversed. I received SSDI on a second claim but retro date only went to Sept. 2005. The first retro date was March 2004. The Federal court(district) said both claims were to be combined and redid by a new ALJ. And yes the local office only knows it is at Bmore Md. I think this is the payment center for vendors(lawyers). guess i just wait for the letter.Thanks to all

OH- I didnt click on this right- Baltimore MD the SSA office-

If the VA is paying you 100% based on same disability that SSA is- you should ask the VA for more money-then again why is the VA only paying you 80% and not the TDIU rate now?

This retro can help with VA retro in many cases-

my husband's PTSD SSA award date was the controlling factor in his EED from the VA.They would have paid him 3 years at 100% but since he died the widows egs only paid two years of it to me-

makes me wonder where that other year of 100% went-
