Appeal To Nod Denial

Hello,

Just a brief update to my NOD denial of 30 Jan 08.

1. 1-25 Feb, I sent three separate letters to the VARO, each with additional information, and each with a copy of my new and material evidence.

2. Yesterday, I received all back as duplicates (!) and the VA letter said that I should send them new and material evidence since I had not provided any. The document has not yet been a part of any decision. So...they are asking me for the same document they just returned to me!

3. Incidentally, the new and material evidence is from a board certified cardiologist and his summary of findings include the exact wording necessary to bump my rating from 10 to 30 percent.

Isn't that convienent that they somehow did not recognize the very form you sent them.

It is shameful that they use these obvious delay tactics.

At least thats what I think they are, because I honestly do not think anyone could be that stupid. I just do not think its possible.

Send it back in reply to their new request, but send like 30 copies.

I agree it is just a darn stall tactic. They are good at that.

Send it back with a letter, to clarify, you are definitely sending

" New and Material Evidence."

Do as I did, just keep throwing it in their face until they read it.

I picked that up from Carlie and it worked for me.

Yes, good ideal about sending in the letter clarifying it as "New and Material".

I am actually doing the very same with a claim I have, it has "New and Material Evidence" in bold, italic, underline, and highlighted for them to see it on my Statement in Support form.

Yes, good ideal about sending in the letter clarifying it as "New and Material".

I am actually doing the very same with a claim I have, it has "New and Material Evidence" in bold, italic, underline, and highlighted for them to see it on my Statement in Support form.
