Instead of making a decision they remand my case back to the St.Louis,MO RO Talked to Karl's assistant & what this means since I filed claim in 2,002 I have to go thru the VARO again. Since the BVA didn't make a decision I have to start all overbut I will be covered by the new Lawyer Law. My claim will still be from 2,002 but it being entered after 2,007 if the RO turns it down I can then bring in a Lawyer. Not really sure if the RO low balls me I can bring in a Lawyer or not. Its real hard for some young kind (the 25 year old DRO) to look you in the face and turn you down if you got the proper ducts in a row Jim Delay, Delay, Delay another thousand Vets will die today. Betty Betty, Yes, I have a copy of the BVA remand letter & suppose they sent one to the RO also. But, this time I have 6 VA Docs stating I need A & A & 2 IMOS Also, I have a copy of the letter awarding me A & A when I was on pension. I also put in for A & A for my Wife & the BVA wants to know why the RO didn't even bother to check her SS Records. The way I read the Remand they are real close to telling the RO that they have no idea of what they are doing. Of which I agree. HA But, the BVA hit me the only way they could to keep me from bringing in a Lawyer on my claim as they remanded it & didn't deny or approve which one needs to get a Lawyer on one's claim. Now when I re-present my evidence to the RO I really see no way they can deny it but with the VA who knows? Every Doc I see at the VA wrote me one & I have other evidence. This time I also am going to collect an abundance of evidence for my Wife. My Daughter(Who has a Master's in Psychology) is going to write up all of my evidence this time & fill out a KILLER cover letter. If the RO low balls me or will not go back to 2,002 on the claim I will be able to bring in a Lawyer as it's after June,2007. If for some reason I should get denied I will just keep on plugging along until I get what I want. I am presently on 100% Compensation T & P & it took me 9 years to get that & think the Lawyer I hired was the real kicker. So, will try to keep U up dated on the next move by the RO. I am going to hand deliver my new evidence & my wife's to the RO in St.Louis,MO & get a date stamped copy. But, seeing as nothing is certain with the VA the only thing I'm certain of is that they will not discourage me with all the hoops I have to jump thru. Again, Gary, this is just from my claim, but my buddy letter, just happen to be a Nurse. The first BVA Council tried to hide her under the wood work, but not this one. Her credentials alone were given a lot of weight as being a witness to the abuse in service of me and also to my medical treatment and meds. Your daugher can use her credentials also to write a letter of her life with you and she will also be given a lot of weight.
