Request For Eed For Increased Rating, Or Cue?

Got a increased rating for sc issue. The rating information I've found is exactly the same for the issue when first claimed and now. This sc issue I've had for years was rated to date of discharge but I believe at a wrong low %.

My approach - claim for EED explaining & showing the va Imo reports then & now read exactly same for that condition. The rating criteria, as far as I can find, hasn't changed and the increased rating shows the lower rating was wrong from start.

Am I right to proceed with claim for EED fix? or should I go CUE? (may have asked this before, but double checkin ole cg here)

Right. Berta is definitely the one to ask on any CUE question. She's been educating and correcting me on CUE for years and has definitely earned her place in heaven with all the help she's given us all!

I'm afraid I didn't understand your situation - thought the original decision was final (over a year old and not NOD'd). So your claim is still open back to date of discharge, right?

In that case, I'd absolutely appeal now. You can't CUE a decision that's not yet final anyway (but if I understand it correctly, they can CUE themselves at any time), plus CUE's are the most difficult cases to win. You have a much more lenient standard of proof requirement when appealing a decision that is not yet final.

Correction: Claim for increase with EED is being rated and dfas is reviewing? If lucky, could know something in next few days. nod on different issue remains 'in line' for now.
