Actually the alj was not an evil man all..The lawyer and I went in, the lawyer gave his brief, and the ALJ asked questions pertaining to my daily living. The Voc person rattled off a few jobs that I could do, and the alj shot them down.. I was shocked to say the least. It was done, ALJ said he would approve a year before date of application. The only advice I can give, is if your are at the hearing level dont go at it alone. Medical evidence is a must. I would like to say thank you to all hadit members for posting their experience, THATS WAS PRICELESS... B) Now if I can just get this C&P out of the way for IU..... Any Veteran who is 40% and is awarded Social Security probable is in order for an increase in VA rating. I am currently at 40% with the VA and was awarded another 10% sc for HBP, but was not give compensation for the HBP. Am I 40% or 50% disabled? This is all connected to diabetes type 2. TBird had to do that cause of abuse on the site. You should be able to get 100% in some form or another but you have to ask and you have to provide proof such as your Social Security award.If it has been less than a year appeal the last rating and ask for TDIU Good Luck Veterans deserve real choice for their health care.
