Question

this is from a award letter from a c and p exam.. Service treatment records from june 7,1993 to 1996 show treatment for right ankle pain. VA examination dated march 31,2009 finds a current strain of the right ankle wiht flexion from 0 to 30 degrees. Examiner notes pian wiht plantar flexion. the examiners opinoion is that, due to lack of chronicity of treament, the current strain is less likely than not related to treatment in service. Service connection for right ankle strain is deniend since this condition neither occured or was cuased by service.

Ok happen in service and thier is a current strain? i do have a bone spur on my heel now...my left ankle and heel are sc... what does DUE TO LACK OF CHRONICTY OF TREATMENT MEAN? does this mena they think it might be like a acute sprian and if i show medical eveidence of treatment from now on that it will be sc?

I agree with john992. You need to be sure that there is not another explanation for your current symptoms that would be secondary to your service connected conditions. Only a doctor can address this. I would not depend or rely on the current C&P as being a complete assessment.

If you file a claim as secondary to an already service connected condition it could result in a new C&P. I have read BVA cases where this was done when the first C&P exam did not specifically address both direct service connection and secondary service connection.

If the report from your primary doctor saying that you had pain since the military was based solely on your verbal statements without any record of treatment the VA will not give the primary doctors report weight. This is due to the fact that there is no verification that the problems you were having were not due to inter-current or unrelated causes.

“A medical opinion which is based entirely upon a reported history from a veteran himself lacks a clinical foundation and accordingly lacks any

significant probative value.” BVA Citation Nr: 9925065

The only way around this is if the primary doctor specifically reviewed the Service Medical records and stated that the condition in the military would more likely than not have produced the post service symptoms of pain that went untreated until the time you finally decided that you needed to see a doctor.

Heres how it works:

C&P exams are now very lucrative as they get $500 for usually less than an hours work. QTC does not require you are a doctor, but only a PA or nurse practicioner.

PA's and nurse practioners making more than $500 per hour is very lucrative.

VA C&P examiners can aslo be PA's or NP's.

There are only about three types of C&P exams that are required to have a

DR or a specialist -

MH - Audiology and I think Opthamologist.

Do you have a link to show that VA pay's $500.00 for a C&P exam?

I think this amount is off quite a bit.

No, I dont have a link to the schedule of payment of QTC C and P exams. However, if you have a link contradicting the most recent increase to $500 for a C and P exam, I really would like to see it.

All I can tell you is I personally know a QTC C&P examiner,

Psychiatrist for MH C&P exams.

He most definetly does not receive $500.00 for each

individual C&P exam and the exams are rarely completed in an hour or less

when you include the time spent on the exam after the claimant leaves.

The way it usually works around here is:

If someone makes certain statements, as tho they are truth and facts,

others always have the option to request where the source for

these statment's can be found.

We have found over the years that when a poster can not back-up

their statement by simply supplying a source -- from there on out,

little weight is given to their statements, thereby producing questions on

the validity of their posts, statements and information.

Members can come on here and post anything, but it is not fair

to all members and Hadit in general when generalized posts are made

repeatedly with no source for verification.

ok guys if they get 500 dollars it doesnt matter bc we all know that almost all of the c and p dr are trying to denie us ..it like anything the goverment does they try to discourage you or do not tell you all the info ......but anyways i like to thank you for all your post and it helped me alot on deciding what to do or not to do......this va game sometimes gets me down untill i come on here and here some encouragement and ideals.....

Very good. If you are posting that C &P examiners make less than $500 per exam, then I am sure you dont mind posting the link to back it up. s.
