Weird C & P Exam

Question

I am 60% sc for kidneys and 10% sc for hypertension but they only give me the 60% rating.I had a C & P exam for a stroke.I found it very strange that the person giving the exam informed me right off the bat that she had worked for workers comp claims. She started off questioning me about why I wasn't on SSI that had nothing to do with the C & P exam concerning my stroke.There was also another lady with her that was supposed to be in training to give C& P exam but she was not dressed in a lab coat or have a name tag. I felt very uneasy with the questions they asked because they had nothing to do with my C&P exam or my sc disability or stroke,they were more personal questions about my life.They also questioned my wife about her employment which had nothing to do with my exam.I have had 2 other C&P exams and the doctors did not go off topic of my disabilities.I felt like when I was being questioned about SSI they were hinting that I needed to be out of the VA system.I got the feeling that they were not concerned with the symptons I am still having from my stroke and with my blood pressure that they cannot seem to get under control.She more or less told me that I could be working at Mc donalds as they hire people with disabilities.My question is does a veteran have any rights in a C&P exam and did they go out of the bounderies of the exam by asking these questions and making these comments? I would sure appreciate any help from other veterans.

By all meas apply for TDIU -at the 100% rate of comp.I assume you are not able to work at all.So ASAP.

On question # 18 tell them Yes and apply for SSA disability benefits. The SSA web site has info as to the SSA disability criteria.You might instead be eligible for SSI but that would financially impact on your VA comp or vice versa.

Under #25 Remarks refer them to additional p[age of any other information you should consider. Make the point to explain to them the paralysis that affects your arm and hand. Is it the dominant hand? Tell them you claim the migraines as secondary to these SC disabilities as well as the "floaters".

Floaters are no0t a ratable disability but were noted in my husbvand's optician records and they were one of his first manifestations of transcient ischematic brain strokes.

She stepped way over the bounds here and I feel that you should contact the director of that VAMC.

Your stroke could have been due to the HBP and/or the kidney problem.Can you state the exact medical terms for your SC kidney disease?

I will attach the TDIU form.

It would pay to get a copy of the C & P exam results ASAP.

I got a copy of my C & P today. In it the C & P examiner denies documentation of authorization of ankle foot orthosis but i have a copy of my records where the doctor authorizes left AFO for drop foot and was issused a foot brace through the VA.Also she documented that there was no vision problems on screening but i have records of damage to blood vessels in my eyes and floaters and blurred vision due to my strokes and uncontrollable blood pressure that are documented through Va eye doctors.Also she failed to put down my vital signs or my blood pressure readings.This is just a few mistakes that were made in this C&P exam.I was also told by the examiner that she was a PA and she had another woman in the exam that she was training to do C & P exams,In the report it states that she was actually a FNP-BC....since a family nurse practicioner is allowed to give this exam what reason would she have to lie?I do not believe she was training this woman since she did such a lousy job on her exam.She also informed at the beginning of the exam that she had worked for the state of Louisiana in the workman comp claim department.I was in perfect health when I went into the service, now I am service connected for my hypertension and kidney problems.I am starting to believe that these health problems I am having may be connected to all the exposure I had to CS gas and exposure to exhaust fumes from the tanks I drove in the service.From what I have read the VA and government will not recognize exposure to CS gas.Any advice or information would be a big help.Thank you all for your time and help.
