ptsd Question About Va Claim Processing

<br style="min-width: 0px; ">I am getting the temp 100 for hospitalization for ptsd<br style="min-width: 0px; "><br style="min-width: 0px; "><br style="min-width: 0px; ">I had a claim in for reconsideration of 30% ptsd, tdiu, and housebound a and a<br style="min-width: 0px; ">they denied the increase and therefor i guess the tdui too since i would not qualify at 30%

I am trying to understand why the file did not support the increase.<br style="min-width: 0px; "><br style="min-width: 0px; ">According to the cnp doctor I am unemployable but the vso said it was denied due to no evidence to support and I dont see how that is possible when i read requirements for 70% I see that all over my records so i am not sure what is not suporting.<br style="min-width: 0px; "><br style="min-width: 0px; "><br style="min-width: 0px; ">So that is that let me know what else you need id be happy to give you the info.

can someone tell me what i have missed and what the deal is.

File a formal Nod before the one year time limit and I would ask for a DRO hearing at your Va Regional Office. Get your Mental health doctor to write a note in your progress notes that your are unemployable. I would also file for Social Security Disability if you cannot work,If you win based only on service connected disabilities it would be strong evidence to present to the VA.

Yes I have SSDI got it in 2 mos using only my va medical info. no exam at all I will start to work on the letter cant i doe a request for reconsideration. let me know.

What do you get the SSDI for?

If it is solely for the PTSD-make sure the VA is aware of this and ask for Recosnsidration based on this evidence and send them proof of the SSA award.

A Reconsideration Request does NOT stop the year NOD clock.

If they do not act on the reconsideration request make sure you mark your calendar and file the NOD within the year timeframe.

If VA was aware you receive SSDI,what was their exact wording in the decision as to why this evidence did not garner a TDIU award?

I got the paper today a resident phycologist stated that I did some kind of test and she feels i was not truthful on it and said i answered as if I was malingering... plan and simple. I am so blown away that i dont know where to go from here. That same resident told me I was to out of touch with my feeling and had concentration skills so poor its hard to have conversations with me. so she stated this info. She then just said my 30% will stay the same but i am 100% for this month due to hospitalization. I have requested a copy of my cfile and cnp's cause the cnp doctor said i should be unemployable.

her statements killed the entire claim.

btw my issue is if I am so out of touch with reality and my feelings how can any test be accurate. ..... I am not sure how to proceed from here.

I believe you posted that you asked for a "reconsideration" and was informed today, that you were denied...

JMHO... If so, then you should have your vet rep submit a NOD "Notice of Disagreement" asap. Is the resident psychologist a new PhD? Google the name and see if this person has a bio. You can claim that there is conflicting evidence in your record and that the "novice psychologist" conducted an incompetent exam and request another exam with a different doctor. Have you ever filed a NOD?
