If you are taking the date of 9/15/2011 as the date of a BVA decision from e-benefits you might be looking in vain. The accuracy of that information in e-benefits is directly related to the competancy of the individual or records at your local VARO which is where that data is pulled from. I was told I have a BVA decision on 9/30/2011, only problem is I have nothing at BVA, called the number listed for BVA on e-benefits and they confirmed they didn't make a decision and that the data for those entries come from the VARO. 800 number claims this indicates the decision is older than a year and it cannot be appealed anymore. Only problem with the theory is I have already NODed, selected the DRO option, Had a DRO hearing, and been to an appeal C&P, And the file sits in the central file area and is not checked out to anyone. Don't let misinformation get you chasing your tail and foaming at the mouth like a rabid dog. About the only information I trust from the 800 number is where my file is, I would only consider information from e-benefits as confirmation of some other information you come by. Mistake. What kind of "misinformation"? ....oh you know...... the kind you get from the 800 number at VA. Does any one else see the irony in this? My claim goes to the BVA on remand and I have no idea when it will be decided. It has already been in appeals for five years with no end in sight. 71M10 Posted November 11, 2011 Share Posted November 11, 2011 Not trying to be political, this is an observation I would make on any politician that holds the power to fix the backlog. The latest recurring "We Can't Wait ", "America can't wait" Slogan being used by out chief executive made me pause to think. Veterans Can't Wait!!!, But we can, have, and will continue to even though we shouldn't. Some politicians want additional stimulus funds......resolve veterans claims and that retro goes into the economy. Housing is depressed, Pay the SC disabled veteran who is living with family/friends, the just compensation for thier injuries and many will take that backlog and buy a place to live. With an executive order the president could lend/lease legal types to the Veterans Administration from other departments/agencies with the sole purpose of them serving as special masters to make initial decisions on claims waiting to be decided. Don't "pink slip" those Air Force officers, keep them and temporarily assign them to VA to adudicate claims. They are intelligent college educated (or equivalent) and have been trained to read and follow government regulations. Send them to the equivelent of OCS for VA ratings specialists( a new take on the 90 day wonder) and put them to work!
