C&p Exam For The Third Time. Any Advice?

I have exam 3 of my shoulder exams this month. I do not know why this is the 3rd C&P examination but I would greatly accept any ideas on this. This is the 3rd exam for bilateral shoulder injuries that I am claiming. Why would I be going to another one?

Just send to your nearest VA Medical Center ROI office a VBA-10-543a or stop by the next time your there and hand it to them. I have always done that and received the exam copies in less than two weeks in the mail. Don't let them tell you that you have to request them through the VARO that's BS your have a right to a free "full copy" of all your medical records including your C&P's DBQ's from the VAMC. I know when I send it in I just ask for a copy of my all my records that cover from say 1 Aug to 5 Sept 2012 and so happens my C&P's fall into that time frame and they will be in there guaranteed. It's always worked for me and these extra requests for records they have never charged me for them since it only covers a small reporting period. Just my 2cents worth hope it helps.

There are multiple reasons a C and P exam could be inadequate, and most of these have nothing to do with the Veteran.

One obvious reason is that the examiner was not qualifed to make that determination. If the examiner was a psych doc, and was asked to do a knee exam, then he would unlikely be qualified.

Another is the examiner did not answer the VA's questions. They may have asked for a range of motion, a nexus to service, etc. etc. and the examiner may or may not have provided difinitive answers.

Sometimes the examiner says something like "without speculation, I can not opine on the Veterans etiology of the disease".

Well sometimes that is ok, and at others it isnt. If the examiner needed an xray, or other tests for his opinion, then those tests should be ordered before doc makes an opinion.

IN other words if the doc says something like, "without an x ray, I cant opine on how old this fracture is, if indeed there is a fracture"...then the examiner speculation could be "cured" with an xray and another opinion.

On the other hand, if the examiner says that the medical science link (nexus) between ...x condition and y condition is unclear, then the

exam may not be able to be "fixed" without a second or third examiner opinion.

are you confusing clinic appts for physical therapy and then they changed their minds and said no as a C&P exam? C&P exams are not normally done in the clinics where they do physical therapy or see the surgeons for what they want to do, normally a C&P exam is done in the C&P clinic and it specifically states it is for a C&P exam

the reason I am asking is your statement . I went a second time due to Ortho setting an appointment. Nothing happened from this appointment. No continuing of PT or surgery or anything. I went in two weeks ago and asked for an Ortho specialist to start pHysical therapy again and this is what happens. Should I just assume that this is normal.

The only test that occurred was with me placing my arms directly in front of me and seeing if he could push them down. Needless to say it didnt take much effort from him to do this.

your appointment letter would clearly state it was for a c&p exam. if it didn't say that, it probably was for c&p.

my cp examiner said that it was medically impossible to answer the question . so we sent a letter to the appeals board asking them to change the wording to make sense and reschedule another cp. ..this could be simular to yours?..
