The new criteria for PTSD claims as of August 2010, requires a VA MH doc to diagnose you with PTSD.

VA doesnt care if your private PTSD doctor is Sigmund Freud.

The entire regulation is in our PTSD forum here.

Let us know why they denied you for PTSD,in the reasons and bases section when you get the decision.

Did they give you a VA C & P exam for the PTSD?

If so,have you obtained a copy of it?

no c p exam for any condition i will udate everyone with my paper work as soon as it comes in. Thank everyone, I would never had made it without you guys and this site. I have been in bad shape for years, after 10 years in the Navy I lost everything. Now, I am getting my life back peace by peace.

You could try a FDC using a DBQ filled out by your civilian doc. Two different VSOs have told me that route is faster than the appeal process. However, you're the guy in charge of your claim. Might want to research this further in hadit before pulling the appeal trigger.

thanks for the info on the fdc for ptsd, can i file a new claim and appeal at the same time?

I have also been told that FDC for reconsideration is better than appeal, but John Dorle told me there is a risk to your effective date in doing it. Basically what he said is that the VA would be under no obligation to back date the effective date if you do an FDC for reconsideration instead of doing an appeal.

That's interesting. DAV seemed pretty positive the effective date would go back to the claim I asked to be reconsidered. In fact, the RO screwed up the effective date of the claim in question and DAV thinks we can win that easily. But DAV could be wrong.

Seeing as I'm now set up to find out the hard way if John is right or DAV is right, will have to let everyone know. I'm probably going to wind up appealing on one or more conditions anyway after the reconsideration, so maybe that would protect the original effective date?
