Dbq From Private Physician Still Going To C P Exam

Question

What will happens if c p examiner doesnt make a nexus as my private physician did. Depression secodary to sleep apnea.

The VA will weigh the Private IMO against the VA C & P exam opinion.(if they have the private IMO)

If the private opinion follows the IMO criteria here particular with a strong medical rationale, the VA should consider it and give you an award under Benefit of Doubt.

Make sure you get a copy of the C & P exam as soon as you can.

It is often a good idea to have those C & P copies already , when getting an independent medical opinion.

They might contain other areas of medical rebuttal the IMO doc can make.

In one of the IMOs I got from Dr Bash he found an additional ratable condition I still have not claimed.

In his second IMO (I made sure he had the SOC and SSOC, he started off with 'The SSOC is medically inaccurate' and gave a full medical rationale why the C & P doctor was wrong.

Benefit of doubt is the terminology VA uses for most awards, that have negative opinions and an equal (or greater) value of positive opinions.

That is why the IMO criteria here is so important for a IMO doctor to follow;as, if they forget one specific thing, the VA can pounce on it.

One thing I have noticed over the years is if an IMO doc gives a very good rationale and then follows it with excerpts from established medical texts or abstracts....I have seen BVA disregard C & P opinions for the same claim that do not contain any supporting medical literature for a negative VA opinion.

Also we dont know VA doctors credentials for C & Ps unless we look them up at www.healthgrades.com. if in fact they are listed there.

An IMO doc should be more then willing to prepare their CV along with the IMO.

Dr Bash's CV is about 10 pages long.

A CV (Curriculum Vitae) of expertise can help outweigh the opinion of a VA C & P doctor.

I submitted an FDC in Sep 13, and the RO requested that the VA in Dallas submit DBQs for all my conditions since I am being treated there. Instead the Dallas VA set up 6 C&Ps at the Ft Worth VA on 2/14/14. I was irritated because I am Treated for Everything at the VA, well documented. I had to drive over 300 miles for the Exams, and I was very nervous. It was a long day, but it actually went well, and now by the looks of the Exam Reports, I should be 100% very soon. Just go in there be honest, and as long as you are well documented, you will be fine. God Bless and keep us posted.
