0 Navy04 Posted March 14, 2015 Share Posted March 14, 2015 Not bad news completely, the Remanded conditions, usually require the VA RO to look over the conditions and medical evidence, and either decide the claim or require you to go to new C&Ps. 0 Tdaddy52 Posted March 14, 2015 Author Share Posted March 14, 2015 Thank you but before I continue let me say it is a Honor to be on board with some of the most Greatest Advocates of my time ,they Remanded the following Right Knee 1995,Left Knee 1999, Right Thumb 1999, TDIU Deferred until exams. As you can see I never gave up on these cause I know I have them dead to right and SSI Judge said that I am Unemployable since 1993 because of my Knees and right thumb/hand that was injured in Army/Service in 1983. Your SC 50% would rule out a Scheduler IU Claim but there is always the Non-Scheduler but that has to be decided by the VA Comp Department Director. Do some research regarding SSI Vs VA ratings. The bid difference is SSI is all or nothing where as the VA has Stage ratings. The SSI award can help but doesn't mean your VA IU is a lock. You have to be able to prove you can't earn in excess of $12,400 (65) or $11,400 (66) individual earned income. These figures are what the VA raters look at. Unless your unable to do even Sedentary work verified by Medical and Employment Specialists, you could have a problem. Did you use any type of Representation on your claims? Have you ever availed yourself of a couple FREE Legal consults with VA Accredited Appeals Lawyers? Your possible Retro has to be sky high after all these years. Free VSO assistance is good but there has to be a reason that your claims have gone on this long.
