100% Tdiu But Doesn't State P&t

Hi All,

Just got a VET his 100% TDIU but decision doesn't say P&T and he didn't receive any paper work for Champ VA for his wife and dependent, nor Educational form. He called VA 800 number and was told just because his rate is 90% and he is being paid at 100% doesn't mean he is P&T. My question is this true and if true why when he is being paid at 100%.. What do we do to get him P&T.

Furthermore, does this mean that he won't get commissary priviledges.

He may not be. Some conditions are not static and will require re-evaluation in a few years.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

COMMISSARY AND EXCHANGE PRIVILEGES

Honorably discharged veterans with 100 percent service-connected disability, and their dependents and unremarried surviving spouses, are entitled to unlimited exchange and commissary store privileges. Certification of total disability and DD Form 1172, Application for Uniformed Services Identification Card - DEERS Enrollment, will be provided by VA. You may contact the nearest VA regional office for assistance.

This form is for 100% P & T veterans but it also state that a veteran that is 100% total disability can get privileges.

Both ratings and TDIU are only given P&T status when it is clear that the veterans disabilities are not likely to improve. When deciding on this question, the VA uses any evidence in the medical records, but they also consider things such as the veteran's age, education, etc. Unless they find reason to believe that it is unlikely that the veteran's condition will improve, they tend to withhold P&T. This means that the veteran will be re-examined at some point in the future to see if he/she still qualifies for their current rating or for TDIU. Until they decide his condition is static, he will be subject to losing TDIU or having his rating decreased at some point in the future.

Congrats on the win, and I agree with guys above. I my self have been 100% for the last 18 months, but only Temporary, even though I am Permanent Navy and SSDI disabled. Just have to play the game and ride it out.
