Can I reopen a service connected claim

Question

I have a claim for my medical records on CD.

While that request is pending, can I open a service connected claim for increase?

A request for a copy of you records is not a claim. There is no reason that you can not apply for an increase in a service connected disability. You can do this at any time.

Fat an easy answer is do you have New and Material Evidence, or evidence that you have not submitted is one way to re-open a clam. Has your condition worsened? If so, will need proof. Your lay statement is not sufficient to re-open the case, as we vets are not deemed competent to render a medical opinion.

The last denial gives a good idea of what VA found lacking in the past claim and this needs to be overcome in a re opened claim. Often the best N & M evidence of all is an Independent Me4dical Opinion.

and/or current treatment records that show an increase in disability.

Thanks folks.

I have an IME with medical documentation.

The new (medical exam) and material (test results and doctors opinion) evidence is present.

I think the material evidence portion directly addresses the decision for a previous 0% rating.

In addition, it addresses the present severity and how the disability affects me on a daily basis.

 

In lieu of the evidence, I am even more convinced a claim really hinges on the professionalism of the rater.

Some people judge strictly on evidence and some look for holes in evidence to deny.

I hope a honest person gets the claim; however if not, then BVA here I come.
