0 DocC03
Buck, Thank you. I will keep an eye on the date. My 70% rating was before my TDIU rating. I wonder how this was not considered by the V.A. when I was granted TDIU??
0 HadIt.com Elder Buck52 Posted April 16, 2016 HadIt.com Elder Share Posted April 16, 2016 (edited) I think you mention you was 100%TDIU? OR if you were 90% IU That they gave you extra scheduler with CFR 38 part (b) that render you unable to work b/c of your SC Disability that made you IU. ok now if your rated 70%for PTSD 90% &70% is a 97%rating bringing you up to the 100%stand alone and with that the added 70% for PTSD should meet the SMC S.1 Critter If you have a 90% rating and then a 70% rating and 2-10%ratings that is a rating of..97.57 rounded off to the 100% and should meet the criteria for the SMC-S 1 You will always have a 100%rating with the VA It's Just The VA uses a special calculator table rating chart for SMC jmo ...........Buck Edited April 16, 2016 by Buck52
0 DocC03
I might have been confused. Let me try to break it down. All my disability's add to 90%. Being paid TDIU. Individual ratings are as follows. 70% PTSD 50% headaches 10% ears 10% ankle 0% hemorrhoids 0% back Does that change anything or am i still good to go? 0 HadIt.com Elder Buck52 Posted April 16, 2016 HadIt.com Elder Share Posted April 16, 2016 (edited) Unfortunately using VA Math your ratings of 70% & 50% 10% 10% add up to is 87.85% rounded off at the 90% rating you need additional rating of 50 % to70% to get to the SMC with these ratings. I know that don't make a lick of sense thats just how the VA does it the more and worse your disability's are the more closer to the SMC After you reach the 100% stand alone then you can use the SMC calulator table to figure your SMC Ratings. usually a 60%rating with your 100% will get you to SMC at least you would meet the SMC Criteria . jmo .......................Buck Edited April 16, 2016 by Buck52
0 DocC03
After reading what Asknod replied to my initial question a couple weeks ago, I researched based on his answer and it seems that what he stated is also what I found true. Since I am paid at 100% for TDIU based on PTSD then the remaining disabilities 50%+10%+10% equal at least 60% then I am operating on the assumption that I do qualify for SMC-S I know that his is one of the most confusing situations in the V.A. I have already applied/reminded the V.A. to look at SMC-S so I will let everyone know what they say. Regardless I appreciate the information everyone provides. Thanks you Missy1974
0 Moderator broncovet Posted April 17, 2016 Moderator Share Posted April 17, 2016 I agree, Doc03. It appears you qualify for SMC S (housebound) under the Bradley vs Peake criteria, where the "statuatory" 100% can be TDIU. If the TDIU was based on PTSD, then your 50% headaches 10% ears and 10% ankle would combine to an additional 60%.

Sorry I didn't get back to you, sir. My brain fart. I received a panel denial at the CAVC and became engrossed in that. The answer is yes. File the 526EZ pronto. It makes no difference with SMC claim

70% for PTSD is the TDIU. 50+10+10 =60% for the headaches etc. as long as the headaches have nothing to do with the PTSD and you're golden for SMC S. If the PTSD happened after the 50/10/10 for the T
