Entitlement to Smc S?
Greetings to all and hope all are doing well as can be currently 90% (100% TDIU) from PTSD at 70% alone. Other disabilities are 30%, 20%, 10%, 10% and two 0%’s. Just awarded rhinitis today which gave me the other 10%, so this didn’t change my overall percentage. Also I have an appeal that was granted this year from 2016 and currently I’m at the end of that just waiting to have a rating and effective date if that matters, which should be any day now. Do I qualify for smc s now? I know once my appeal gets rated I will be but was curious to see if it applies to this new claim that was granted. Thanks for your time and any insights are appreciated.

Can I claim SMC S
I recently received a BVA award for HTN rating pending with 4 others being remanded to RO. My current ratings are Sleep Apnea 50, DMII 20, CAD 60, Back L5 S1 20, L-Knee 10, R-Leg Neuropathy 20, DJD L- Leg 10, depressed Mood 50, L-Leg neuropathy 10 Neurogenic Bladder 10, Sciatic Nerve Neurogenic 10. I was at 90% for several years and in Oct 2019 I had LAD by-pass surgery and was awarded 100% P&T. My goal was to continue to work my boss and I have known each other for 35 years so we worked out a plan so I would not have to travel much that lasted about a year so I have been unemployed since 1/2021. Any info on if I should file a claim would be Helpful, I thank…

SMC S Etiology Question
Does anyone have experience with housebound regarding mental health? I am diagnosed for anxiety but not receiving a VA rating for it and I am 100% for PTSD. To be awarded SMC-S one qualifier is 100% rating and a secondary rating of a separate etiology of 60% or higher. If I get rated 60% or higher for my anxiety, will that qualify me for SMC-S? Thanks. Respectfully,

SMC is to be awarded without the need to file a separate claim.
This is not a question, just passing on. A.B. v. Brown, 6 Vet. App. 35, 38 (1993). Veterans may claim SMC, or it may be raised by the evidence of record. See Akles v. Derwinski, 1 Vet. App. 118, 121 (1991); Bradley v. Peake, 22 Vet. App. 280, 294 (2008). SMC is “to be accorded when a veteran becomes eligible without need for a separate claim.” Bradley, 22 Vet. App. at 294 (emphasis added). TransportRoom (cavc.gov) Vet. App. CAVC Decision No. 21-539

Housebound/SMC S question?
I've been encouraged by a fellow Veteran and friend to apply for Housebound/SMC S. I'm not sure I would qualify and don't want to tie up time and resources other Veterans need. I'm TDIU P&T. 50% Depression 10% Right Shoulder 20% lower left leg radiculopathy 20% lower right leg radiculopathy 10% GERD 10 % Tinnitus and a couple of 0% service connected. Also I have/had non=service connected prostate cancer and I'm pretty much incontinent. I do have a AUS but it's not perfect. I've been TDIU for over 10 years at this point. Due to my back problems I have problems standing and walking. The time it takes t…

Eligible for SMC?
I have been so appreciative of this site so far. It has given me more information than any other place on the internet in the past few years. I am currently 100% P&T. However, talking with some friends, they said I should be eligible for SMC. From what I read on here, I am not. Here is a list of my current ratings: Lumbosacral 40% Left femoral 20% Left sciatic 20% Right femoral 20% Right sciatic 20% Cervical 30% Right upper radiculopathy 40% Left upper radiculopathy 30% Tinnitus 10% PTSD deferred UPPP with nasal regurgitation deferred (currently 0%) Painful scar secondary to UPPP 10% Headaches secondary to UPPP denied but found DTA error i…

Here is an updated opinion from CCK SMC-S January 2022
Here is an updated opinion from CCK, pay close attention to the examples. Having a TDIU rating based solely on a PTSD disability could meet the requirement for the 100% part of the SMC-S criteria. SMC(s) Today’s Special Monthly Compensation series will focus on SMC(s). The amount of compensation for a single veteran without dependents at the SMC(s) level is $3,521.85 per month as of December 2020. This compensation can be provided in addition to SMC(k) as long as the service-connected disabilities are not the same in both claims. Qualifiers There are two different paths that can make a veteran eligible to receive SMC(s) benefits: You are entitled…

SMCs 100% schedular and 60% combined ok??
Dear Hadit, First off I am so blessed to have this community, after 18yrs I was able to receive 100% P&T schedular in 2018. My question is Smc s. I am not housebound and need to work. I have researched the below and found many different answers. 1. For Smcs Is it ok to be 100% schedular p&t plus an added 60%? The gov reg sounds like it's a single 100% plus a single 60% but elsewhere, like on the law firm sites, it says 100 schedular is ok. 2. So if 100% schedular (+60%) is ok, can the 60% be combined? Me personally I am 100% schedular and then have a bunch of others that add to 70% using VA math and calculators as well as bilat calcs…

smc SMC-S1
I wanted to ask a question about SMC-S1 specifically from the CAVC–Buie (5) v. Shinseki (0) (2011) case. My situation is similar, and I was not awarded SMC-S1 upon 100% scheduler award. My interest is why does this continue to happen? Is it due to few Veterans even know about the SMC-S1? My thoughts are this is true or veterans just do not fight this much so the VA continues to now award the SMC-Veteran's because they use the bullcrap argument that more than one SC was used to give the veteran the IU. Reading the Buie case shows clearly that it does not matter in what order the SC were given as long as there is the 60% or more for one SC and the other qualification which …

TDIU and SMC S
There has been a lot of discussion here on SMC s and maybe this BVA case will explain our points on it: https://www.va.gov/vetapp21/Files7/A21012520.txt or this one: https://www.va.gov/vetapp21/Files11/A21018338.txt or search the BVA for TDIU and SMC - the denials are as important as the awards and remands.

Do I qualify for SMC-S
I am 100% P & T for a service connected aortic aneurysm. I am 10% SC for hypertension. I am 20% SC for painful surgical scars , bilateral lower extremities. I am 30% SC for ischemic stroke with right homonymous hemianopia. I am 10% SC for tinnitus. I am also 0% SC for bilateral hearing loss. I am also 0% SC for peripheral vascular disease of the right and left lower. I represent myself , so I need advice as to if I qualify for SMC-S and if I do, how to go about filing for it.

SMC-S multiple items
I know the regulation reads 1 condition at 100% and another 60% on top of that to qualify. However, If I have multiple joints (psoriatic arthritis) effected by the same condition that total to 100% and still at least 60% in other ratings, would that qualify for SMC-S?

Bone Cancer
I'm 100% disabled for prostate cancer and filing for SMC for stage 4 bone cancer. I can't find what percentage it would be ratebale for and I have not been scheduled for a C&P exam. I've submitted all CT scans & MRI scans with letters from my doctors. In addition I've also filed for diabetes 2, neuropathy, sleep apnea and tinnitus. I've had a C&P exam for the diabetes & neuropathy with no decision yet also no C&P scheduled for the bone cancer. My question..what is the secondary rate for stage 4 bone cancer would it be SMC-S or somthing else? Will I receive SMC-K compensation for all the additional issues ? thank you for any help

SMC Questions
Hello All, It's been a few years since I last signed on and it seems most of my data has been purged from my profile. I received my 100% P&T rating in the spring of 2016 backdated to the summer of 2015. My conditions have seemed to worsen over time and I am now considering applying for SMC for being both housebound and relying on my wife to care for me due to mental and physical issues. I do not have a service connected mental health diagnosis but have seen VA Psychiatrists since 2011. It appears that being housebound is a SMC S rating but I am unsure of where what I'm calling "aid and attendance" falls. Any help would be appreciated. Thank you!

Need a 60% rating to qualify for SMC-S
Hello all, I've been trying to figure out a way to a rating increased to 60% so I can receive SMC-S. I'm already rated 100% P&T, hence the need for one disability to be rated at 60%. I've been looking through my ratings and I think my best bet is to try to get my 30% rating for insomnia disorder with bruxism increased to 70%. Of course, my insomnia has worsened a lot since I received a 30% rating for it in 2014 and I have extensive medical records showing how bad it's gotten. I even take Provigil now for excessive daytime sleepiness. I know there is not a specific rating criteria for insomnia so the VA rates it analogous to mental disorders. I have also been diag…

SMC’s
I was at 100% for, 60% back, 20% left and right sciatic and femoral nerve impairment, 60% neck with left ulnar nerve impairment, 10% left knee strain, 10% Tinitis, 40% bilateral hearing and 30% PTSD. Also loss use for left foot that was part of back claim. I asked for review for all disabilities. They came back with 100% PTSD. They took away separate nerve rating of lower legs and added it to back claim. They then moved me to SMC-S. In appeal in DC is right foot drop which I was first diagnosed in 2006 by private doctor. Also loss of use for left snd right hand snd left and right shoulder and bilateral buttocks all on appeal at regional level. We are waiting for dec…

Why am I still getting SMC S1?
In February 2020 in eBenefits under the benefits tab the following was awarded to me after hernia surgery in Dec 2019 (hernia was a va comp disability; I file d for temp total disability for the convalescence time of the surgery; convalescence time was 30 days-Dr. Order). I began receiving the extra pay for the SMC- S1 in February 2021. My VA letter showed the showed the I had now been rated at 80% but with the inclusion of the SMC- S1 it is a lot more money than 80%. In May 2020 I called the VA 800 number and asked if I am still supposing to be receiving this amount of money with the SMC-S1? The guy said what's your latest letter say? I told him the amount (including …

SMC (s-1)
I may be getting ahead of myself but I received a retroactive payment today so I looked on EBenefits. It stated that I was awarded 100% T&P SMC (S-1) for a nephrectomy I had done in September due to cancer on my left kidney (Service-Connected). I have been rated at 70% T&P since 2009 for sinusitis, torn labrum, and a few other things not related to my kidney at all. I guess my question is was this payment for the 2 months I was recovering at home or is this a permanent payment I will receive in addition to my disability payment? Of course I can wait for my paperwork to get here but curiosity is killing me! SMC (S-1)Effective Date : 09/20/2019 Entitled …

I had surgery on my service connected ankle on 12/5/14 and I applied for temporary 100%. It was granted and I was paid at the 100% rate from 12/5/14 to 2/1/15. I was also given SMC-S during that same time but I didn't know this until a couple of years laters when I was looking under the benefits section in eBenefits. I am also service connected for bilateral pes planus with an effective date in October 2010. SMC-S, Returning to work Question
So I have called peggy more than once, also the DAV. No one can seem to answer my question. I was rated TDIU P&T + SMC-S by a BVA decision in late 2017, I recently filed for an increase on my knees & back which have gotten progressively worse since the last C&P in 2013. From that request of increase I am now rated 100% P&T. I have been in Voc Rehab for the past two years and trying to get myself to at least a part time position, I am still young and I want to be productive, Not saying those that cant work aren't but when i was volunteering it was a horrible experience, I was bossed around and treated worse than cheap labor and when I couldn't do somet…
