Housebound Question
Hello all, I was re evaluated for PTSD this month and was raised to 100% for Combat related PTSD from 70% also made P&T, I have the Following conditions : Tinnitus 10%,Lumbar 10%,Radicuapathy-secondary 10%,Pes Cavus 30%,IBS 30%,Sleep apnea secondary to PTSD 50%, Should I be eligible for SMC-S Housebound ? I was wondering if I should follow a NOD or submit a new Claim? Thank you for any guidance

SMC (s-1)
I may be getting ahead of myself but I received a retroactive payment today so I looked on EBenefits. It stated that I was awarded 100% T&P SMC (S-1) for a nephrectomy I had done in September due to cancer on my left kidney (Service-Connected). I have been rated at 70% T&P since 2009 for sinusitis, torn labrum, and a few other things not related to my kidney at all. I guess my question is was this payment for the 2 months I was recovering at home or is this a permanent payment I will receive in addition to my disability payment? SMC-S For Surgery
Hello All! I have been looking back though the history of my compensation claims because I and in the process of trying to get an earlier effective. I had surgery on my service connected ankle on 12/5/14 and I applied for temporary 100%. It was granted and I was paid at the 100% rate from 12/5/14 to 2/1/15. I was also given SMC-S during that same time but I didn't know this until a couple of years laters when I was looking under the benefits section in eBenefits. Just approved for smcs-2
I am currently paid 100% va disability compensation. I was just approved for smc s when i look at the table for smc s it says 3776. is that what my new payment will be or is that on top of what I already get. I just can’t seem to get a straight answer or find the info.

SMC-S, Returning to work Question
So I have called peggy more than once, also the DAV. No one can seem to answer my question. I was rated TDIU P&T + SMC-S by a BVA decision in late 2017, I recently filed for an increase on my knees & back which have gotten progressively worse since the last C&P in 2013. From that request of increase I am now rated 100% P&T. Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of degenerative joint disease, right wrist (also claimed as arthrodesis) rated 100 percent and additional service-connected disabilities of tinnitus, left shoulder strain, adjustment disorder with mixed anxiety and depressed mood claimed as post-traumatic stress disorder, painful scars, right dorsal wrist, independently ratable at 60 percent or more from 12/23/2016 to 03/01/2017. tdiu how long does it last
I was awared 100% tdiu by the BVA going back to 8/2016 as of 2016. My question is will the continue permanently and there wasnt anything saying is was or not.I was 73 when was granted . thanks again

SMC?
I am currently 80% IU p& t with 2 appeals still currently active. One is at the board and the other one is having a dro review. The one at the board is a TBI appeal and my dro review is a increase for migranes, which is currently 0%. My question is if granted the max for migranes which is 50% will this open me up for any SMC?... Current ratings are as follows 70% for ptsd, 20% for left shoulder strain, 10% for left ankle sprain and 0% for migranes.

Tidings to all, I have been a background lurker for years and have used much of the information found on hadit to assist me. Labeled: Major Depressive 70% but receive TDIU 100% Permanent and Total Stress Incontinence 40% Migraines 30% Scars 10% Lumbar 10% Tinnitus 10% Breast 0% I filed for TDIU for Major Depressive back in October 2015. CONFUSION!!!!!!!!!. For what it is worth here is a September post from a veterans wife "Hello everyone. My husband was just awarded sc for sleep apnea by the BVA. They sent it back to the RO to be awarded. This will now give him SMC-s since he is 100% for PTSD alone and the sleep apnea award will put his other combined totals above 60%. Do I qualify for SMC’s ??
I’m going directly to the point after this. Do I actually qualify for SMC’s1?? I have 100% PTSD P&T 50% Sleep Apnea 20%TMJ 20%Right Knee 10%Left Knee I know I’ve a 70% combined rating and 100% for single disability. The requirements for Statutory SMC is to be 100% for one single disability and another 60% for a disability or combination of disabilities independently evaluated at 60 or more. The issue here is if the 50% for sleep apnea secondary to my ptsd condition can qualify for that combination of ratings? Or not?

Would I qualify for SMC-S / housebound?
After my heart attack in early April I have brain fog and am trying to determine if I qualify for SMC-S or housebound. I'm 100% P&T for 10+ years and filed a claim for heart attack at the beginning of May. I am not medically cleared to return to work yet. Bilateral ratings 20%, 20%, 10%, 10% = 48% Single ratings 40%, 30%, 30%, 30%, 20%, 10%, 10%, 10%, 10% Factoring in the bilateral and singles, I calculate 96% I also have a separate single rating of 60% I looked up SMC-S laws and found: Would I qualify?

I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. 5,10, 20 Rule

The 5, 10, 20 year rules...
Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.
Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.
Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.
If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"
At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.
NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

Example for 2020 using the same disability rating
1998 - Initially Service Connected @ 10%
RESULT: Service Connection Protected in 2008
RESULT: 10% Protected from reduction in 2018 (20 years)
2020 - Service Connection Increased @ 30%
RESULT: 30% is Protected from reduction in 2040 (20 years)-

While the BVA has some discretion here, often they "chop up claims". For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.
I hate that its that way. The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel. -

Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!
My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.
Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!- 13 replies

I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it.
