can the VA rate me at 0% not service connected for a TBI?

 They can rate 0% but still service-connected .

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

As stated above, 0% SC is a Start. Means that you can seek treatment thru the VA for it, and you can always submit a new claim for an increase if it gets worse. Good luck

If the rating is less than a year old you also have the option of asking for a Reconsideration or filing a NOD (Notice of Disagreement) against the evaluation that they awarded (0%).

If it has been over a year get ahold of a rating schedule for the TBI and determine whether or not your symptoms justify a higher percentage. Then file for an increase.

0% really only entitles you to treatment at the VA for said condition like the others have stated. It's a start, but it's not necessarily the end.

thanks for all the help, but the VA stated in the claim that it was 0% not service  connected, it was sent in for a reconderation and came back 0% not service connected . I was told if you get 0% it is service connected. does anyone know if you can get 0% not service connected?  Thanks Ken

Sorry, I guess I didn't read it all correctly in the original post.

0% not service connected would apply towards Pension purposes (even if you didn't apply for Pension) as far as the rating is concerned, and the condition would NOT be considered as service connected.
