Q: Who is considered a spouse for purposes of VA benefits?

A: VA recognizes a Veteran’s marriage if the marriage was recognized under the law of the place where at least one of the parties resided when they were married or when the claimant became eligible for benefits.

VA now recognizes all same-sex marriages without regard to a Veteran’s current or previous state of residence.

I would say date officially recognized & removed.

Sure- They'll go back to date of divorce. DMC will be contacting you with an offset, if they have your current address, otherwise it'll just offset your award in ful until it's PIF.

You can get dependency for minor children, even stepchildren.

I did dependency for 6 mo as a VSR and it's extremely complex, AND VSRs LOVE the development game, they'll use anything, whatsoever, to avoid processing because it's so easy to get in trouble.

We had an authorizer who literally returned every, single claim. She'd find some pretext, or feign a mistake just to do so. Boiled my blood.

I'm holding back the difference so it won't sting too much when the decrease is finalized. Still waiting on them to decide my competency claim so I can get my back pay.... A bunch of BS that my competency claim has been waiting nearly a year for them to make a decision, but any decrease in pay takes them less than 6 months.
