What is my next step? File your NOD and Appeal the effective date to 23 yrs ago and get a veteran's law firm to represent you. 0 Berta Posted January 23, 2019 Share Posted January 23, 2019 It seemed to me ( cant find your other topics, )that you might either have a 38 CFR.3.156 claim for a better EED or have the basis for a CUE claim. What is the decision for- meaning what disability (ies)and ratings If they denied you in the past- it does not matter when, and service connected you now, for the same disability -as long as they had established medical evidence at time of the denial, and it raised to at least 10% NSC-you might have CUE basis on tyhe rating sheet. Can you scan and attach any past denials and include their evidence list? Cover your C file, name, address prior to scanning it. This could be as well a 38 CFR 3.156 approach for a better EED,instead, but we need more info -it would help if you also scanned and attached here their recent decision as well as that evidence list. 0 Berta Posted January 23, 2019 Share Posted January 23, 2019 (edited) PS they cant be sued for backpay- there are 2 ways to get it- as I mentioned above, if the evidence reveals they owe it.
