----In October 2018 I asked

"Do you have anyone representing you on this issue?"

And you replied

"I made an error. It is the debt management center of Dept. of Veterans affairs.

I am  life time member of both VFW and DAV.  Thank you for your rapid response"

It seems this regarded a debt that the VA did not waive.

Others suggested contacting your congressman or calling the White House hot Line ( 1-855-948-2311)-Have you done that?

I think you should contact whoever holds your POA.

Have you ever scanned and attached here the VA decision that gives a rationale for the debt?

If not cover your C file # and name prior to scanning and attaching it ,and maybe we can determine if the VA was right-or was wrong.

Some debts created are valid. Some are waived.

There are 15,446 overpayment decisions at the BVA since 1994.

"A waiver of overpayment of special monthly pension benefits in the amount of $24,390.00 was not timely filed."

(waiver denied)

"1. The overpayment of Department of Veterans Affairs (VA) benefits was validly created in the amount of $6,963.00 for the removal of the Veteran’s spouse as a dependent, effective February 1, 1996.

 

2. Waiver of recovery of debt in the amount to be determined resulting from the overpayment of additional dependent compensation for the period of February 1996 to February 2005, except for one month between November 1996 to December 1996, is granted."

It all depends on VA's rationale for the overpayment and if a waiver was filed in time ( I think it has to be 180 days)-not sure. the letter from the VA about the overpayment will give the time deadline for appeal.
