I have a tendency to do the same thing:  Look up "1" case, and then assume it applies to "my" case, without looking at other cases.

Its easy to do.  "One" example of how this does not work is because you have to be ELIGIBLE for benefits before you can get an award.

In this example, I could have all 3 caluza elements...and still not get benefits because I failed to meet eligibility criteria.

In other words, we have to consider all regulations, not "just" one regulation or case law.

Berta I used that e mail to send over the equitable relief papers.

I get e mail saying they are forwarding it to the leadership team s veteran benefits administration.

? Is the the process for equitable relief

Or are they send it as a irs and this is not process of the relief.

Never did this before

Since the Secretary is the only entity who can grant Equitable Relief, I assume the "leadership team" is the Secretary's team.

In the successful ER cases I posted in this thread they hinged on administrative error, and all other forms of resolve had been exhausted, by the petitioner.

When thousands of Americans faced annihilation in the 1800s Chief

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.
