Question

I am venting more than anything.

Well the veterans affairs broke me down.

I took a lawyer to handle the adjustment disorder appeal to the court.

I got two appeal to the court a petition for extraordinary relief and.

Two more issues that I don't even have a bva decision for.

So that will be four different appeal going at the court.

Crazy part my whole case was remand by the court all together.

 

So I refuse to try an fight all these court appeals pro se. Again.

I really believe this was done on purpose.

Hoping I would miss deadlines or just give up.

I had so much trust in the court but I just can't understand why I can't get my petition for extraordinary relief address or rule on.

Told it's been in a judge chambers for the last two months.

I have done over 4 case at the cavc pro se.

Now they have hire new clerk and I got to fight them to put my motion in or anything. To do with my case.

Everytime I send something like I been doing I got call the supviser before it put in on my case now.

Everything now is a big process with this these new two clerks.

There are three different clerks on the 3 different case at the court 

I got like 3 different va lawyers handling these cases.

They feel like they don't even have to talk with you to get the case address.

The bva is hold my smc r and o remand by the court a year ago.

I got two soc one may one Nov.

Its been sit there two months and my cases is advance on the docket because of my need of higher level of in home care

Smh.

You can't get any contact with the board so it just sit no one can tell you anything.

Well let see how the lawyer thing goes.

You don't speak to the lawyer before they get on your case.

They just appointed a lawyer from there pro Bono list.

 So I could get a new lawyer that never did a case or a experience one form a top firm is the way it works.

My hope is when he take the one case and see everything.

And if he call me to address it I will let he handle everything.

He just got to be up on smc benfits before I turn that part of my case over to a lawyer that I have never even talk to.

Just me.

Ok I am done it time for a break from all this after I get all this back at the court.

I need a vacation! Lol

The va is getting really hard to fight now.

But crazy I think I enjoy fight the case and doing the court cases.

And writing the briefs to the court an doing motion to the court.

Make me feel like I am doing something with myself.

But I can't handle 3 or 4 cases going at the Court at the same time.

I will miss something  smh

So I send the paperwork for the pro Bono program.

 

I get a call they tell me the electric signing didn't show on my paperwork I had to do it again. Smh.

I did it I just want them to do the court appeal for the adjustment disorder effective date and smc l for this condition. 

It at the cavc and the rba is due Feb 9.

I just don't like that you don't talk to the lawyer before they are on your case in this program

it can be a good firm or it could be a new lawyer just starting out.

But whatever I just don't got the time to be doing 3 different appeal at the court at the same time. Crazy

Done venting on this issue lol

Good idea getting an attorney.  Now, trust what he says, and dont be a law professor and teach him his job.  

The government moves slowly.  Yours is not the only case, incredible as it may seem

Yea I will let them handle the one issue.

They will not be handle my smc effective dates under the Howell v Nicholson.

So you guys will still see me posting lol.

I don't expect everyone to understand my case it was the same way when I did the cue and got the 8 yrs tdiu retro.

The law can be interpreted many ways.

That why we have judges.

And I am not the veteran who sit around and say that the way it works.

I had a cavc remand.

The ro remove the adjustment disorder an have it as new appeal  an new docket number 2021.

I was 100000 in line how many years would It had take before someone would address my case. An see this was a cavc remand.

Well I have decision now.

They did the same thing with the cavc remand of my smc effective dates change it to a new appeal even remove it from legacy.

An I never requested to be put in the new ama system.

And put it at the end of the line.

Well I now have a bva decision on this Also

But still got this issue process under the ama system.

Do you think a judge and no one seen my statement you can look at the nod you have to check a box to opt in.

 

This is a appeal started in 2018 last time I checked after the ssoc you can't process a legacy appeal in the new ama system.

 

I try to point the va games with the docketing out to veterans.

Because I believe this  is why many veterans are waiting years to get decision on cavc remand and bva Remand.

Ok I will put it this way the two issues which were removed from the cavc remand docket

Effective dates and adjustment.

Both will give  me a effective date of 1993 or 2001 for smc benfits

Funny both of those were removed.

Ok if you apply for smc benfits you ever seen them act like each smc is a sperate claim and appeal. 

Some trust everything the va and bva do.

I am not one.

That why I fight for my benefits.

 I have never wait years to get a decision at any stage.
